      Commonwealth Financial Systems, Inc.(CFSI) acknowledges receipt of Complaint # ******** on behalf of ******* ****. Please be advised, Commonwealth Financial Systems, Inc. is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debt with the collection agency, the original creditor has sold/charged off the original debt to our client who then assigned it to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debt.

      •The account in question is the result of medical services provided by ********* ********** ** ******* ******* on 12/05/2018. In compliance with Regulation F of the CFPB’s Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debt on 02/01/2023.  We then waited fourteen (14) days, the reasonable period as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the account was sent to be credit reported.

      Please be aware the above referenced account is no longer being serviced by Commonwealth Financial Systems, Inc. (CFSI). The account was closed and scheduled to be returned to our client CF Medical LLC, and a request was submitted to the credit reporting agencies to remove all tradelines associated with the account from credit reporting.       I am rejecting this response because:

      I dispute any liability for the alleged debt with  ********* ********** ** ***************. I have not entered into any contractual agreement with Commonwealth Financial Systems, Inc. (CFSI). As a matter of my rights under the Fair Debt Collection Practices Act (FDCPA) and other applicable laws, I had previously requested the original contract from them but they failed to provide it.

      I kindly request that the necessary measures be taken to rectify my credit report. It has come to my attention that Commonwealth Financial Systems, Inc. (CFSI) has officially confirmed their disassociation from the management of the aforementioned account. In light of this information, I am formally requesting the removal of said account from my  credit report. Your prompt attention to this matter would be greatly appreciated. Thank you.

      This company is going against credit laws tremendously. 1.I have never had an account with this company COMMONWEALTH FINANCE, REMOVE from all credit agencies from reporting. 2.“consumer” means any natural person obligated or allegedly obligated to pay any debt. According to 15 U.S. Code §1692a (3) 3.This letter is in pursuing 15 U.S. Code §1692c (c) Ceasing communication 4.I am the “consumer” mentioned in 15 U.S. code §1692a (3) You are COMMONWEALTH FINANCE the debt collector 15 U.S. Code1692a (5) I am invoking specified remedies under use 15 U.S. code §1692c (c) (2) as a creditor I am demanding you to terminate all farther efforts pursing to 15 U.S. Code §1692c (c) (1) 5.I am the executor under the 15 U.S. Code §1692c (d) pursing to 15 U.S. Code §1692d A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. The above referenced accounts were reviewed fully in conjunction with the consumer's complaint and we hope the following information was found sufficient in addressing the issues and concerns set forth by consumer.

      Commonwealth Financial Systems, Inc. (CFSI) is a third-party collection agency that collects on behalf of our clients, most of whom are medical debt buyers. The accounts in question are the result of medical services provided by ******** ********* ********, the original creditor of the account. ******** ********* ******** later sold/charged off the original debts to our client after they had become seriously past due. Our client, acquiring all ownership rights upon purchase, including the rights to collect on the accounts, has assigned the accounts to our office for collection.

      In compliance with Regulation F of the CFPBs Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debts on 07/03/2023.  We then waited fourteen (14)days, the reasonable period of time as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the accounts were sent to be credit reported. The supporting documents were forwarded to consumer. We will continue to note the accounts as disputed and have informed the current creditor of consumer's dispute.

      Should ************** have documentation showing proof of coverage for relevant dates of service, we will gladly forward it on to our client for review. Following notice by the credit bureaus the consumer was disputing the account on the basis: Not my Debt, our office conducted it's reasonable investigation and confirmed the accuracy of information in our records, and that being reported to the credit reporting agencies. A copy of the document verifying the debt was forwarded to consumer for their record 7/20/2023.
