Please be advised, Commonwealth Financial Systems, Inc. is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debt with the collection agency, the original creditor has sold/charged off the original debt to our client who then assigned it to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debt.

      •Please be advised, the HIPAA law permits creditors to share information with its Business Associates necessary to collect on medical debt. The HIPAA rules require that covered entities and business associates enter into contracts to ensure protected health information is appropriately safeguarded. Commonwealth Financial Systems, Inc. operates under a Business Associates Agreement with our client which certifies that we agree to not share private health information with anyone other than the consumer, or authorized party, and we further agree to keep records secure. Our company has been fully compliant with HIPAA requirements concerning privacy of medical records.

      •The account in question is the result of medical services provided by ******* ********* ***** on 07/27/2018. In compliance with Regulation F of the CFPB’s Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debt on 02/01/2023.  We then waited fourteen (14) days, the reasonable period as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the account was sent to be credit reported.

      •As per consumer's request, we will cease and desist collection activity in relation to the debt and return it to our client, informing them Commonwealth Financial Systems will no longer be servicing the account. A deletion request will be sent to the 3 major credit reporting agencies for the tradeline(s) to be removed from credit reporting. • I hope my response has addressed the issues and concerns as set forth in the complaint.       I am not liable for this debt with Commonwealth Financial Systems. I do not have a contract with Commonwealth Financial Systems. They did not provide me a contract with my signature as I requested. Not only that, but they are reporting a $910 medical debt on my credit report under 3 different account numbers totaling in 3 collection reports on my credit report. All without providing me any verification proof other than a Drs name. Account numbers are as follows - ******XXXXXX, ******XXXXXX, ******XXXXXX Not only are they inaccurately reporting this debt on my credit report under 3 different accounts, their response when I asked for verification was a violation of HIPAA.

      The accounts in question are the result of medical services provided by ****** ********* ********** ********* **.  There are three accounts ********************** references in complaint. Each account on record is linked to it's own service date and are not duplicates.

      In compliance with Regulation F of the CFPBs Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debts.  We then waited fourteen (14) days, the reasonable period as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the accounts were sent to be credit reported. A billing statement was then provided by the current creditor and forwarded to consumer for all three separate accounts.

      I received information from you attempting to collect an alleged debt with account number *********** . YYour initial communication to me of the alleged-debt was within 30 days ago. Please be further advised, I dispute the validity of the alleged debt in its entirety. Further I request verification of the alleged debt, including, the name and address of the original creditor, along with a copy of a signed contract with the creditor. Where’s my HIPPA release form? I am aware that you have directly violated the regulations of the HIPAA Act of 1996. I never signed a HIPAA form to authorize your company to have access to my medical records or procedures that I went through. Additionally any attempts to harm my credit history and rating by updating or changing dates after you have been informed that the debt is expired, is a direct violation of the FDCPA. Any abuse to my credit rating on your part will be met with all recourse available to me by the law. You are illegally attempting to collect an alleged debt and money that I do not owe. As per the law, cease and desist all collection activity, including credit reporting. If you fail to comply with this complaint, I may turn the matter over to an attorney.
