****** *******, my prior property manager, is accusing me of leaving debris behind at my old apartment and is not trying to give me back my full deposit. When leaving the apartment, I cleaned it better than what was given to me when I first moved in. I filled holes in the wall, as well as painted every wall in that apartment in which I spent my money on the paint. ****** inspected the apartment and told me that it was in pristine condition and that there was nothing wrong. About 3 weeks go by and I am still waiting for my deposit. She now claims that there were garbage and debris on the side of the apartment that was left behind and that she must charge me for removal of this debris. Whatever was left behind was not mine and I have camera footage that it is not. She still claims that the downstairs neighbor witnessed me leave this debris behind. The only reason why she is taking his word over mine is because she is friends with the neighbors mother. ******* behavior has been highly unprofessional and when I try to reach out to her about my deposit, it takes days for her to respond, to the point where I have to threaten with legal action, in which she then responds immediately. This matter and her behavior, once again, is highly unprofessional.

This is a landlord/tenant dispute and does not belong with the BBB.  However, there was a large amount of debris left behind, including an L shaped countertop and cabinets that went under the cabinet.  The landlord has reimbursed them $325 plus an additional $195 of the $720 that tenant stated improperly he is due.  The amount withheld from their deposit is $200.  I have already spent my time picking up the unbagged debris and dumping in my own trash bin, and I still need to hire someone to pickup the balance as it is too large and heavy for me.  This tenant and his girlfriend's constant texting at all hours including after 9 pm is unreasonable and do not deserve immediate response.  As I do not hold their security deposit, I needed to rely upon the owner to remit. There was a heavy snow storm the Friday the tenant vacated and I could not do the walk through until the following Tuesday as the City of **** was under state of emergency and travel was limited.  The interior of the unit was definitely in pristine condition, however the 4 feet of snow that had fallen covered the front sidewalk of the unit and was not visible until December 17 after temperatures had warmed up and the snow was melted off.  See attached photos.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Hello. We only just received a response via mail from BBB in regards to our complaint. It said we only had 5 days to respond, but was sent out the 6th and we just received it in the mail today. Here is our response to this complaint: all of the pictures sent with the companys respond are not valid. The picture of the tire was already confirmed to be the current tenants which was notified to ****** and she acknowledged this so sending a picture of it is, once again, falsely accusing. As for the pictures of the trash, I took that to the curb myself on Dec.21st as soon as we reached **** because we had been unable to put trash on the curb at the time of our leave due to the immense snowbanks and the pause in garbage collectors during the horrible weather. The broken cabinets also sent via picture were not ours which we stated multiple times. We were told some random contractor saw us bring it downstairs and put it on the side of the house. However, we asked for the date this was so called seen as we have cameras that would very easily provide proof that this never occurred. We asked for this on Jan 5th, and were told by ****** that she would get it to us on the 6th. We have not heard from her since. As for the constant messaging and late night messaging we had reached out to her very little despite our turmoil. We reached out when we deemed fit, which is very reasonable as the issue required immediate attention as we were relying on our deposit for our new home bills. We reached out one time on Dec. 21st via text after attempting to call on Dec. 21st with no answer and left a voicemail. We then attempted to call one time Dec. 23rd and left a voicemail with no response. We did not reach out Dec.24th and Dec. 25th in respect to the holidays. On Dec.26th we finally received a response via text message to which I immediately tried to call her at 2:45pm in the afternoon, another reasonable time, to which she immediately declined our call. She was with a client but could find the time to send photos and send text messages. She refused to ever talk either us over the phone no matter what and would only respond via text message to which we could never get anything sorted out. So we got shorted $200 from our security deposit for someone elses greed.

    Regards,

    ***** ******
