Contact diamond equity about selling a home in north carolina they are based in Georgia sent rep **** ***** all requested information an offer was made for 150000 we rejcted due to low bid 454 days later we contacted them and wanted to accept they stated they had no info we resent everything and the new offer was less than 50%Business Response

The real estate market conditions have dramatically changed in the past 454 days, and our offers are only good during the first 7-14 days upon underwriting approval. Market conditions are deteriorating further now, as of Nov 2023 and I suggest anyone considering a sale make a deal and get to closing as fast as possible. Pricing may not be as good as it was in 2022, but very likely much better now than it will be next year. Last time the market crashed, it took 7 years to reach the bottom.
We will not contact this complainant anymore, as requested and wish him the best in finding a buyer for their property.

I contacted Diamond Equity about a property I am looking to sell.I was contacted by ** who was initially courteous,He then called me and provided an offer on the property for less than $300k if its worth, proceeded to berate me and my intelligence, provided me with misinformation (including incomparable comps for my property), and then continued to text and contact me after I asked him to stop communicating with me. It was very predatory behavior.Business Response

I signed a contract with Diamond Equity/****, who was represented by *************************, on Sept. 28, 2022 to buy my property at *****************************, Atlanta. The contract had a closing date of no later than November 4,2022. After around two weeks into it, they stated that their attorneys were finding many issues with the title and getting it cleared. Their only option for me was to go with a separate attorney they worked with to go through the Quiet Title process that required me to pay a $10K retainer and me to extend my contract with them for 6 months. I told them that the option was not something I was willing to do. I expressed to them that I did not believe the Quite Title process was needed and that my title and documentation was sufficient. They said they tried a few more attorneys over the next couple of weeks, but always came up to the same conclusion. I worked with **** 14 days past the contract end because he stated that he wanted to see if he could find a way around the process. On November 18, however, he still had no other option for me. I told him we would just have to part ways, and we ended our business at that point. He ended telling me that his company would like the opportunity to buy the property if I could get the title cleared to their satisfaction. A few weeks later, I contacted another company that has been interested in buying the property, and explained to them the situation I had experienced with Diamond Equity. This company, *************** Reality,, told me around 2 weeks later that the only hold on them selling the property was an Affidavit of Contract that Diamond Equity/**** had on it which they had filed right after my contract with them was signed that I was not told or aware of being recorded against it. I and *************** Reality have been asking for a signed release of this Affidavit since December 20, 2022. Diamond Equity has stated that they will only sign a release if I pay them $25K. They have agreed to sign a release of the Affidavit of Contract this week that they have placed against my *** ******* ****** property.

I found a house on the mls advertised as a traditional deal but it wasn’t disclosed until I got my settlement statement that it was a wholesale deal. I don’t do wholesale deals and legally in Illinois you have to disclose that it’s a wholesale deal. I noticed on the settlement statement that the house was a different price than what they told me and I was being charged a 48k assignment fee. They sent me an assignment contract without disclosing a fee or that there was an assignment fee. I didn’t even know what an assignment was. They told me the week before closing that they didn’t want to have to do a double closing which was a red flag. Why would there be a double closing. I wouldn’t have agreed to this which is why I pulled out the second I knew. I expressed how the house was too high and cutting into my profit margin and they came down 2k when i originally pulled out of the deal. They contacted me back trying to keep the deal. They knew the entire time they weren’t being transparent and forthcoming. They also told me the closing fees would be one price and they were 2500 over what they told me. Long story short after we got wind of everything we canceled the deal. They’re trying to keep my earnest money and we were still within 5 days of attorney review because they sent a new contract with an assignment. Now we haven’t heard from them and it’s been two weeks. They’re trying to keep my 4K earnest money, which is stealing. This is why I don’t enter deals like this because you have to deal with shady stuff like what I’ve dealt with. I also like to add that upon my research I discovered that the couple that owned the house are 91 years old and didn’t owe any money on their house. They owned it for 30 years. How predatory and greedy. The attorney, agents, field managers, etc all work under this company. I was totally left in the blind. I’m very displeased and this company is shady at best.Business Response

We buy & sell real estate under contract law in the United States.
By law, we enter into written agreements which direct the actions of both buyer & seller.
We abide by the constraints of those contracts, whether we are buying or selling.
*** ***** agreed to buy a house from us, and paid a non-refundable earnest money deposit when she signed the legally binding agreement which defined her closing date, as well as the fact that the earnest money deposit was non-refundable.
On the day of closing, she decided she no longer wished to move forward, and defaulted on her obligations under that agreement.
Per the terms of her agreement, she forfeited the earnest money deposit when she defaulted.Initial Complaint

Diamond Equity Investments have been constantly bombarding my mailbox with flyers soliciting me to sell my properties, which is NOT FOR SALE anywhere. I have gone though the links on the fliers, and even called and had a live person remove my name and property addresses from their list, but to no avail. They have also been sent a cease and desist letter on September 6, 2022, but yet still insist on sending me these fliers. My request is that they provide me with valid contact info for Dan B******, and also cease and desist from any further mailings or phone calls, be it direct or by hired call centers. Seems this address was never added to the system and ******* **** has several properties which were being mailed, as shown in the pictures attached to the complaint.
Now that the mailing address has been added to the Do Not Mail list, no further communications should be received by *******, as we will no longer mail them.

I am rejecting this response because:Opting out was attempted numerous times, and even with a live person. I have continued to receive these unwanted solicitations to purchase property that is not listed for sale. They have also been served by certified mail with a cease and desist letter.

Diamond gave me a closing date of 8/28/21 for the purchase of my home. I signed a lease and gave a deposit to Advantage Properties to move into and apartment on 9/1/21. Diamond told me the title to my home is not clear. The deed only has my name. This company wants me to find the stepchildren of my late father's deceased wife. Diamond informed me these children are heirs to my father's deceased wife but, she was not on the deed. My complaint is this information should have been founded before giving me a closing date. I would have not signed a lease and gave a deposit to Advantage Properties who were kind enough to refund my security deposit but not first month's rent.Customer Answer
