      I used to live in Pennsylvania for a short period of time. I was advised by a family member to use this form for my complaint against a real estate company. I have a diagnosis of ADHD and possibly, Asperger's. This issue happened in November of 2021. I've faced discrimination by employers that put me into a difficult situation that necessitated that I breach the lease agreement to move back into my mother's house. I paid 750 to breach the lease agreement and I signed a document that basically said I owe rent until the lease ended or until a new tenant moved in, my lease was set to end in August 2022. Davis Real Estate would not let me leave without signing the paper, so either way, I would owe money for each month the apartment was vacant. I was devastated financially and in tears. Due to my disabilities, I haven't had good luck in keeping employment. What really hurts me, is that after a new tenant moved in, Davis Real Estate not only took my entire security deposit, they charged me extra money on top of that, for damages that they didn't bother fixing before I moved in and didn't bother fixing until I left. $250 for paint, 2 bulbs, 4 drip pans and a sticker that was on the floor. $200 dollars for cleaning. $40 for item disposal. 100 for electricity that I shouldn't have owed since the Watsontown Borough removed me from that utility and back to Davis. Then a 98$ admin fee, just because they felt like it. The kicker is that the lease agreement is so dense and hard for me to understand that I was basically initialing and signing in the hopes that I wouldn't be suffering financially and somehow find a different home before the 2nd year ended. I feel stupid. I really do have difficulties understanding legal documents due to how much detail is in there and how it's worded. In fear of being homeless, I signed that lease to extend my stay. I owe 2,144.68 still, and slowly paying it over time, but waiting for FMCSA to permit me to work again

      Thank you for your assistance with this. I have attached supporting documentation from the tenant and our office to support our claim.

      ****** **** was a tenant of Davis Real Estate, Inc. that moved into one of our rental properties on 9/20/2020, she signed a lease renewal to extend for a second year term which ended 8/26/2022, see attached. ****** submitted a request to vacate the apartment on 10/9/2021, see attached. We reached out via text and phone call to discuss the lease term and provided options on how to proceed. We explained our Breach of Contract procedure to ******, the document was sent out, signed and returned to our office, see attached. The BOC form was returned to us on 10/21/21. See in the attached documents the emails back and forth between our office and ****** confirmed to proceed with the BOC with the understanding that rent and utilities were to be paid until the apartment was rented. In December, we reached out to ****** for non payment of rent. ****** refused to send any additional funds stating that it was not required after signing the BOC even though previously confirmed in emails that it was to be paid. 

      Davis Real Estate, Inc. had no knowledge of any medical or physical condition ****** referred to. ****** never notified us there was any confusion with any documentation that was signed. ****** never notified or provided any documentation to state there was any medical condition or any other problem, nor was there any request for assistance in explaining any documentation that was signed. During the BOC process, we explained in writing and confirmed received, that payment would be made prior to and on the actual BOC form that was turned in to our office. Only after we reached out for payment in December did ****** state that payment was not required and would not be coming. 

      As per the lease agreement, the final settlement would be settled at the end of the lease or once a new tenant has been secured. We were unable to finalize the settlement until a new tenant was secured as per the BOC. The charges on the final settlement are for utilities and rent that ****** was required to pay until the unit was rented again. Other charges to the settlement were for cleaning and repairs required per the lease. Our lease also states that there is a 20% administrative fee assessed to all cleaning and repair expenses that are caused by a tenant. This is what the admin fee is for, our office staff to arrange any repairs, cleaning and maintenance that is required following a tenant move out. As the apartment had items left behind, as well as cleaning and repairs required, this administrative fee was assessed to those charges. 

      The security deposit paid at the beginning of the lease was applied to the outstanding charges, however there was still a balance due. No contact has been made to our office to either dispute the settlement or request a payment plan.

      I have rejected this response because the woman I spoke to over the phone was not understanding that I did not have the money to continue being able to afford paying rent. I explained I was not going to pay because I didn't have the money to do so and I felt I shouldn't have been coerced into signing a document that put me into further financial duress. At the time, the Department of Revenue of Indiana wanted approximately 15,000 dollars in overpayment for an unemployment situation I was pushed into when a company told the temp agency I was dismissed. The temp agency didn't have any further work for me. In addition to the situation with Indiana, the IRS claimed I owed back taxes from 2018, which I paid. However, they adjusted my numbers and claimed I owed more and threatened to freeze my bank account. At the time of the breech, I was working for ****** ***********. However, I was not getting the work I needed to cover the rent. Then I got very sick and was out of work for about a month with no one to help me. The only money I was getting was from the annuity checks from the ****** ****** ** *******. Which was 500$ at most, once per month.

      During this time, I was anxiety ridden and unable to get help. My gross income was too high for rental assistance.

      I was in panic mode by the time I was speaking to someone from Davis Real Estate. She didn't have any compassion and she kept pushing me to sign the document or to stay in the apartment. In this state of panic from having to be on my own, losing work due to a dispatcher not making sure I got enough miles, and then in addition, being very sick for a month with what people could assume was COVID-19, I didn't know what to do or who would help me.

      I have been homeless before. Because I wanted to escape an abusive parent. I've been scared so many times because I didn't know what was wrong with me, not realizing that the ADHD had everything to do with the situations I encountered. And for someone in my position, I didn't have a case manager or counselor. I didn't have friends that could help me out.

      I honestly have a hard time understanding contracts and lease agreements because my strategy is to just hope nothing bad would happen.

      Everytime I tried getting help, people thought I was making it up. I couldn't get the documentation from **** ********** because I didn't fill out the paperwork correctly. In all honesty, I could sign just about any paper and forget what it was that I signed because I have an impaired short term memory.

      I enjoyed that apartment until the financial situation blew up in my face. Chasing me back home to a mother I didn't want in my life because I had no where else to go. I had two people from apartment 4 to help me clear out apartment 7. I couldn't afford to move anything or like that because I was broke.

      I had no money to give to Davis Real Estate. Even now, I'm biding my time because I'm trying to get work accomodations with ********* ******** ********. Once I am working again, I will pay what I owe in rent. I feel that I shouldn't have to pay for the utilities because Watsontown Borough has placed responsibility back onto the landlord. I was told by the borough that I don't owe any utilities, which was electric and garbage removal.

      I don't think I owe that if the apartment was supposed to be vacant that entire time until the new tenant moved in.

      I feel like Davis Real Estate is underhanded with more than just myself. I have seen other reviews left by former tenants. I should only owe the rent that was outstanding because I was unfairly backed into the corner to sign a paper that tightened the noose around my neck.

      Luckily, there was an investigation into my unemployment and I was found not at fault. I am currently 3 months without pay.

      So once ********* brings me back to work a Salaried drivers position, which is guaranteed pay. I'll pay in full for Rent. Everything else should be waived because of the lack of tact and compassion on the side of Davis Real Estate when I approached them about the problem I encountered. I tried to explain that I couldn't afford the apartment. I asked for direction on where to get financial help to pay rent. I didn't qualify. I tried hard to tell them that I didn't want to feel like they were going to ruin my life. They push those lease renewals too early. And it was a mistake renting from them. Never thought I would have to watch garbage pile up around the apartment and watch the plumbing cause mayhem before they fixed anything.

      Then they're so tight with money that I can't save money by turning the heat down because the insolation is very poor. I was always cold or too hot in that apartment. The only room that stayed worm was a small carpeted room. The only way to cool down was using an air conditioner and it was still stifling.

      At least the fixed the plumbing. Felt bad for the flooding that happened in apartment 1. It was like they didn't care and she had to clean it up herself.

      If this is not acceptable as a response. Davis Real Estate will have to wait for me to get back to work. Otherwise, I'm unable to pay that and afford all the other living expenses I encounter.

      I am firmly against landlords that will hang me to dry. Business is business, but I am only one person, and at best, I function as well as a 12 year old would.

      Native Americans experience the culture shock of having to deal with a cutthroat non-native world. I resent this real estate company for their lack of receptivity and helpfulness.

      on December 22, 2021, upon returning home from visiting family all of my belongings were no longer on my porch. I called the police and the landlord only to find out they used a trash company to come to remove all of me and my children's belongings. I have reached out to Davis reality multiple times and they have not responded and added a whole bunch of fees on my rent including a trash bill for the stuff they weren't supposed to touch and they didn't give us any notices or anything.

      Davis Real Estate Inc is a property manager for this property owned by our clients. We sent numerous notices and had called the tenant to clean up the porch area, as it was full of trash, cardboard etc. It is a violation of the lease agreement, we have photos and all of the emails and calls documented. We informed them if they did not clean it up we were having the trash haulers clean it up on a speciic day, still n o response so the trash haulers picked up the trash.  It appears that under all of the trash were some bikes and other items that she called us and told us they were destroyed. The trash Hauler, Big Mountain of Jersey Shore said they did pick them up and we instructed them to take them back, which they did.Tell us why here...

      I am rejecting this response because: Davis reality inc did not inform us at all and we would like to see proof which I've asked for multiple times and haven't gotten a response.  These people took advantage of us because we are black they still haven't called us back to explain why our things were touched our stuff in the first place as well as adding a whole bunch of fees. These people are unprofessional and do not have customer service training. This is the only thing they have responded to. They planned this whole me and my family wasn't home. Without any notice at all.  They never informed us of anything they robbed us then charged us for it. Until this day 1/3/2022 I still haven't reciprocate any notice in any form . They do not have the right to touch belongings we pay our rent on time and we don't bother nobody. I do not agree with anything this company has done. This is unprofessional and unfair. These people have been harassing us since we moved here because we are black. They cannot bully us and charge us extra for the color of our skin.
