      5/28/21- signed a purchase order for a 40x40 steel building that was already in production because someone put a deposit down but backed out. Was told the building would be delivered in late July 2021 - August 2021. Put down a $6,750 deposit. 6/30/21- was contacted by Olympia that the building was not ready and they were sending a contract via DocuSign with a revised delivery date of 11/15/21 - 11/29/21. Early November- called Olympia to ask for an exact delivery date so heavy equipment rental could be scheduled for unloading. Spoke to four different people, including someone in shipping who informed me very rudely that there would be a two day window for delivery, with no moments notice. After speaking with my salesman, a rude person in shipping, a person in scheduling, and finally the manager, I was told that I may get the building in late January. It’s been a month since the contract delivery date was broken and there has yet to be any communication on why the building has been held up for so long, or when i can expect to receive the delivery. Communication was strong up until the actual contract was signed and they received their deposit. Since then, no one has had any answers to my questions and my request to receive my deposit back was denied.

      My husband and I sent a deposit of approximately $8,800 in June 2021 for a steel building. We were told this particular building was one that a previous customer canceled on and the building was sitting in a warehouse just waiting to be shipped. We originally were promised our building to be received in July. We have yet to receive our building and the company will not give us a new tentative shipping window. The last tentative window we were told was November 22, 2021-December 6, 2021. Since then, this has been a continuous battle and most often getting rudely spoken to on the phone and no answers given. After requesting a reimbursement of our down deposit, the company is refusing to reimburse us stating that the deposit was used as an engineering fee to draw plans. Again, we were told this building was already available and all of this had already been paid by the previous customer who canceled on this particular building. The drawings are dated 4/22/21 and we did not sign the contract nor send a deposit until 6/03/21.

      - 05/13/21: Placed engineering deposit of $12,408 on a 40'x60' prefabbed building that was already half complete - We were assured that the building would be arrive July 2021 per the contract signed - 06/29/21: Received a notice that the 2-week window for delivery would be 11/8/21 - 11/22/2021. The reason for the delay was due to material shortages. - Every time we asked for any sort of update on the building, the only answer we kept getting was that it is in production and nothing more. - 11/16/21: Received notice that they will not be able to make the 2 week window and they will TRY to ship first two weeks of January 2022. - Again no updates besides "It is in production" was given, and the only path forward is to wait for them to confirm that the building is being shipped - It was hard enough to put installation, HVAC, electrical, and insulation contractors in the schedule, but now we have to delay those contractors with no information besides to wait until Olympia Steel notifies us that they are ready to ship.

      After the complaint was placed, the parties had reached a settlement for delivery in the window of Dec. 6 through Dec. 10, 2021. While this is still delayed from the window of Nov. 8 through Nov. 22, 2021, it is better than the mid-January delivery that was mentioned prior to the complaint being placed. However, the settlement was not for delivery "next week" as they mentioned, but 3 weeks from then.

      Olympia misrepresented building, used strongarm sales tactics, and didn’t provide proper FBC 2020 plans. August - Contacted Olympia. Spoke to Kristen, who had a building cancelled by Florida customer similar size. Olympia said building exceeds FBC sold, “as is” and I had to act fast. She said “as is” meant colors, doors, could not be changed. After sales pitch from Kristen, Olympia shared old customer’s plans. 8/24 Kristen said plans take a week & require signed contract. 8/27 I signed contract awaited plans. 9/7 spoke to Kristen she needed deposit & engineering fee $14,340 + processing $574.80 for plans and to hold unit as, boss wants sold. 9/15 paid $14,944.80 - Olympia scheduled delivery for mid-Oct. Still no plans, called Kristen. Said engineer backed up would be 3-4 weeks. Early Oct., Olympia scheduled delivery - 11/4 with cashier check due. I pushed off delivery until permitting. 10/8, Misty sent PDF plans. Submitted to County portal – 10/26 plans rejected. 10/11 Misty mailed plans. 10/19 Olympia sent plans to previous FL client, who shared experience. Said building never built for him; he too bought a closeout building from another client and was not able to get permit. 10/19 called Olympia about mail error and told was impossible. Hung up and received call from Alex. He said it was mistake & would overnight plans. Told him I was uncomfortable with how similar the situation was to previous purchaser. 10/26 received hardcopy plans. 10/27 took to County - plans rejected - clerk said plans look edited. Tried to reach Misty, Kristen, Alex, company president & engineer. More research on Olympia revealed reviews & information. Spoke to president’s secretary, called Kristen said, I no longer want the building. She said it goes to legal. 11/4 Attorney friend offered guidance and phone calls, made offer to pay only engineering fee with full deposit to be returned. 11/9 Offer rejected by Olympia and they made unacceptable counter.       On September 15, 2021, Buyer and Universal Steel Buildings Corp.t/d/b/a Olympia Steel Buildings (Olympia) executed a Contract for the purchase of a 60'x76'x16' pre-engineered steel building (Steel Building) for the purchase price of $47,900.00 plus sales tax. Buyer delivered to Olympia an Engineering Deposit of $14,370.00. Buyer purchased a Steel Building that had been recently manufactured for a previous customer who then defaulted on his Contract with Olympia.

      Buyer's issue is that his local building office would not issue him a building permit. The Parties Contract is not contingent on a permit approval. At Page 3 of the Contract, Section 12 of its Terms and Conditions specifically states as follows:

      "Buyer is solely responsible for investigating and ascertaining all zoning by-laws, rules, energy codes, regulations, and all building codes and building permit requirements

      applicable in and to the area or territory where the building or structure purchased hereunder is be erected ("Building Laws") in order satisfy himself that the building or

        structure conforms to all applicable Building Laws. Buyer is solely responsible for designing a building or structure that will fit Buyer's particular needs from the

        components offered for sale by Seller and complies with all applicable Building Laws and with providing Seller with specifications therefore."

      At Page 1 of the Contract in the "Special Notes" provision, Buyer agreed to purchase the above Steel Building and permit drawings in a "*** SOLD AS IS ***" condition. These permit drawings required minor revisions which Olympia, without any additional cost to the Buyer, modified these drawings as requested. In fact, in a call on November 1, 2021, Buyer's counsel stated to me that the permit drawings were in order but that the local building office was now requesting the engineer's "raised seal rather than the engineer's electronic seal" be affixed to said drawings. Counsel also advised me that Buyer would not be available on November 4, 2021 to take delivery of the Steel Building due to an out of town business convention that Buyer was attending. Counsel then advised me that Buyer would be back in town November 8, 2021. I then suggested to counsel a November 11, 2021 delivery date, and counsel advised me that he would check with the Buyer. On November 9, 2021, I spoke to counsel and advised him that the local building office would accept an electronic certification from the engineer in lieu of a raised seal. Counsel's response to me was that Buyer "no longer wants it" (the Steel Building) (Customer Service had advised me by email on October 28,2021, that Buyer requested to cancel his Steel Building), and by each of these events, the result was that Buyer was now in breach of contract pursuant to Page 2 of the Contract, Section 5 (A) (ii) of its Terms and Conditions, which states as follows:

        "Buyer agrees to that in the event Buyer attempts to rescind or cancel this Contract, or in the case of a breach, repudiation or default by Buyer hereunder

      (collectively, a "Breach"), Seller's full damages will be difficult to measure and, therefore, is entitled to have and recover the following liquidated damages from Buyer

        100% of the Purchase Price plus all procurement charges (including transportation charges) handling and storage costs, if Buyer's Breach occurs after the ordered goods

      have been manufactured or procured."

      Fortunately, Olympia was able to mitigate its damages by selling and delivering the Steel Building to a new customer limiting its total damages to to $6,017.17. Pursuant to Page 4 of the Contract, Section 21 of its Terms and Conditions, Olympia will forego filing a civil action in the County of Allegheny County, PA, which action would be adjudicated by a Judge under the laws of the Commonwealth of PA, to recover its above damages together with reasonable attorneys' fees and all Court and out of pocket costs, if Buyer agrees to sign a Mutual Release drafted by Olympia, and wherein Olympia retains Buyer's full Engineering Deposit of $14,370.00 pursuant to Page 1 of the Contract which states as follows:

        "Upon acceptance by Seller (referring now to the Contract) the Buyer shall not be entitled to a refund of the whole or any part of any payment made to Seller."

      Even though Buyer has acted in bad faith, apparently misrepresented his true intentions to his counsel and thereby breached the Contract, he has the temerity to request the refund of his Engineering Deposit!

      Dear Better Business Bureau:

      I have reviewed the response made by Olympia Steel Building Systems in reference to
      the complaint ID ******** and have determined that it does not resolve my complaint. 
      Olympia continues to engage in deceptive business practices and act in bad faith. The
      company utilizes strongarm sales tactics, misrepresents its products, miscommunicates
      information, and employs aggressive legal threats.
      For your reference, some areas of contention are listed below.
      Agreement was sent and signed on 8/27. Received a confirmation of my signature on
      that date.


      Salesperson stated that building would easily meet permitting. Plans would be prepared
      for submission to county for permitting within one week upon receipt of signed
      agreement, deposit, and engineering fee. Paid on 9/15 and never received any plans
      until October. The plans were rejected by the county.


      Seller states a “recently manufactured building;” to be clear the building in question was
      constructed to Florida Building Code 2017 and there are changes to the plans that date
      back to September 16, 2020. Also, Olympia sent a copy of “my plans” to the previous
      disgruntled customer, who called and shared that he bought that same building from
      someone that supposedly “backed out of it,” so there is a question of who the building
      was “recently” manufactured for in Florida. He was also unable to get suitable plans for
      permitting.


      Plans provided by Olympia have never been accepted by the county. Electronic plans
      failed for no digital signature. Paper failed for no raised seal. No plans were ever
      received that were accepted, nor was Olympia told that plans were acceptable. On the
      contrary, the county clerk said plans appeared to be edited. Tried to reach the engineer
      and there is no contact information.
      Additionally, no legal counsel ever represented the buyer in any negotiations or advised
      Olympia on behalf of buyer. A friend offered guidance with the legal conversation, there
      was no legal counsel representing the buyer, retained by the buyer, or acting on behalf
      of the buyer.


      After months of no progress, I made a good faith offer to terminate the agreement as
      this building was never built for my specifications nor did I order the building, it was sold
      as a “cancelled” building Olympia had on site. Olympia had the temerity to counter with
      a refund of $2000 and they would keep the deposit balance. Their offer was and
      remains unacceptable. As the initial deposit was paid on a credit card, I contacted the
      card to dispute the charge, sought resolution with the BBB, and registered a complaint
      with the Pennsylvania Attorney General.

      I have a clear record of communications and detailed timeline of events. The terms
      offered by Olympia remain unacceptable. I am entitled to a full refund, as the company
      was never able to fulfill their obligation to provide submissible plans in the timeline they
      stated.

      Frankly, Buyer continues to totally ignore his agreed upon contracted covenants and obligations under the Contract executed by the Parties, a copy of said Contract has already been provided to the BBB by the Buyer. Our 11/20/21 response to Buyer's complaint is the same response today. However, I am amendable to discussing this matter directly with the Buyer, or a representative of his choosing. If I may suggest your friend the attorney, with whom I had multiple communications. If not, he has my my contact information and you may call me at your convenience.

      Apologies for the correspondence delay as I was unaware of the BBB response timeline and have been navigating the competing demands of business, family, and the holidays.

      That noted, I have reviewed the response made by Olympia Steel Building Systems and it does not resolve my complaint. On the 11/26/2021, I made an initial good faith offer to terminate the PO uploaded to the BBB, as this building was never built for my specifications nor did I order the building; it was also sold as a “cancelled” building that Olympia had on site, and the Seller was unable from the onset to provide acceptable plans. The Seller has also since sold the building in question. Further, the company was never able to fulfill their obligation regarding the attached document referred to by the Seller 12/7/21, as I never received an “Acceptance Copy” (of said Contract duly signed by an authorized officer of the Seller) nor were Drawings Exhibit 1 ever attached to the agreement. These “Seller” conditions were never in place, so according to their own document I am entitled to a full refund.

      The deposit was paid on a credit card; therefore, I continue to work with the card to dispute the charge. I had sought resolution with this organization and filed a complaint with the Pennsylvania Attorney General. Moving forward,

      Once again *** ********* has misrepresented the facts. In his 12/22/21 BBB response but emailed by the BBB to Olympia Steel Buildings on 1/3/22, *** ********* states that: "the company was never able to fulfill their obligation regarding the attached document referred to by the Seller 12/7/21, as I never received an "Acceptance Copy" (of said Contract duly signed by an authorized officer of the Seller) nor were drawings Exhibit 1 ever attached to the agreement. These "Seller" conditions were never in place, so according to their own document I am entitled to a full refund."

      His statement is false! I have attached written confirmation from the United States Postal Service that on 9/20/21, at 1:51 p.m. that the above attachment consisting of the executed copies of the Contract and Exhibit 1 drawings were delivered to *** *********.

      Dear Better Business Bureau:

      I have reviewed the response made by Olympia Steel Building Systems and it does not resolve the complaint.

      Olympia continues to fabricate information. The 9/16 parcel included drawings from the previous client, as evidenced by the whiteout in the Project Name area of the drawings. On some of the pages, you can still see the client’s name and information, none have my name on them. Olympia also included some promotional material about other products offered and a letter stating that plans would be executed soon. The articles are attached for inclusion.

      There was no paper copy of a contract included, nor should there have been. I signed an electronic document, and according to “Seller’s Electronic Signature Agreement” all correspondence was to be sent electronically to ensure a document stamped timeline and no missed correspondence. This timeline information is included as part of the original Purchase Order I uploaded, and the Seller referenced in earlier posts.

      The issue is resolved for Buyer, as the Attorney General has confirmed/documented the complaint, and the credit card company has closed the issue. Hopefully, the BBB considers the number of buyer complaints and their similarities in their rating of this company.

      The entirety of this situation is solely because Olympia's incompetence on multiple levels, such as something as simple as being able to provide engineered drawings for this "in stock" building after months of excuses, including sending another copy of useless "plans" missing a seal or signature to the previous purchaser of the same building. Their tactics delayed my project by months, cost me two expired zoning permits while waiting on usable sealed and signed plans, as well as wasted time and stress. Moving forward, I am working with a much more reputable manufacturer and am excited to finally have the new building I attempted to do with Olympia.

      On May 1st we signed a contract to purchase a steel building from Olympia Steel. We were told the building would be delivered by the end of June. Towards the middle school of June we hadn’t heard anything so we reached out asking for our delivery date. We then received a document from the booking department with a delivery window of 10/4-10/18. A month later and we still don’t have a delivery date. We have called and emailed over and over and can’t get any answers.

      The Olympia steel Buildings contact me in October states they have a building that is ready to go. One of their customer had put in an order and they were canceling the order. They stated that they already have the building made (Prefabricated Materials), and they already have the drawing ready, just need to add new customer name and it’s good to go. The salesman seemed to be very aggressive and rushed me into deciding of to buy and signing a contract. We have a discussion about the price, it was way too high for me and I couldn’t afford it. ****** ** ******** *** sale representative, few days, he lowering the price and convincing me into purchasing. I was asking him about the tax exempt because I just heard another company. Salesman states if I have a company name and tax ID, I could do a tax exempt. I calculated the total price with tax exempt to $58750, it fitted my budget and I can go ahead to do it. I send a picture of a tax ID to ****** ** ******** *** the salesman for verification. George have verified and said we are good to move forward with the order. George told me I have to make a deposited of $14,690. He sent me a contract in DocuSign. On the contract, it states “Buyer is tax exempt, and providing a tax exempt certificate.” Total amount was $58750. After I have reviewed, I have agreed and signed the contact with deposited of $14690. On 10/13 got paper mail contact total amount 63012.50. change made by pen on original contract. I contact the rep, he said now it's my problem, i can't cancel contract,and go look for money to pay them and there is no way out for me. He screamed over the phone while harassing me. I never had an experience anything like this from any company before. None of this would happen if they call me and tell me that there was a mistake and i need to pay 4260 for tax and if i have to money to move foward or not. this company has no moral, principal. they are a scammer.

      The Buyer has misrepresented the facts.

      On October 7, 2021, Buyer and Olympia executed a contract for Buyer's purchase of a 50' x 48' x 16' pre-engineered steel building (Steel Building) for the purchase price of $58,750.00. The Complainant represented to the Olympia's sales representative that Buyer, her trucking company, was exempt from the payment of sales tax. Accordingly, at Page 1 of the Contract there was no charge for sales tax but that provision was made subject to the above Special Notes provision which states: "Buyer is tax exempt, and providing a tax exempt certificate". To date, Buyer HAS NEVER provided to Olympia a California sales tax exemption certificate to permit this Contract to be exempt from the collection of sales taxes. What the complainant has provided to Olympia is an IRS form with the Buyer's trucking company's EIN# for reporting federal income taxes. In multiple calls and emails by the with the Complainant, she has insisted that the mentioned IRS document is her sales tax exemption certificate! That statement is impossible and irresponsible considering a Federal Sales Tax does not exist in the United States unlike many individual states, like California, that has a sales tax charged for goods purchased intrastate. Certainly that is why there is a line provided on Page 1 to insert a sales tax amount and that is why on October 13, 2021, Customer Service, for informational basis only, emailed Complainant a marked up page 1 of the Contract now noting the CA sales tax of $4,262.50 has been added to the original COD of $44,060.00 equaling $48,322.50 now due Olympia when the Complainant's Steel building is delivered.

      When Complainant provides Olympia a signed California Sales Tax Exemption Certificate for the Buyer, Olympia will be happy not to charge sales tax due from the Buyer, but until that event takes place, pursuant to Page 3, Section 13 of the Contract states: "Buyer shall pay all  applicable sales tax and all other taxes on the Total Purchase Price".

      I have review the respond. I have provide the document prior to signing a contract to the saleman, He said it's good to go. I send a copy to customer service, they did tell me it's not form that they are looking for.  I didn't aware that was not a correct paperwork. The Olympia steel building should/ could have call me and states that it is a wrong document and they will charge me a sales tax. I do not have anything against sale tax, but just like all consumer, I am asking all question to see what I have to pay and what I dont have to pay. they should give me OPTION  if I like to continued to buy it or if I like to make a withdrawal. They didn't give me that option to do so. Instead they are holding me hostage to this contract that has been alter by Olympia Steel Building. 

      I didn't ask them to remove or forcing the company to remove the tax because I want to buy steel building. I want to get out of this contract because the total price is exceeding my spending limit now after everything is added up. They should/ could have been upfront from the beginning. They are tricking me into a contract. Take my money, and trying to get away from it. 

      I have a chance to take to A***** ****** VP of this company, He did said his salesman is not very knowledge of the tax exempt, and so am I.  

      the word, " buyer is tax exempt ,and providing a tax exempt certificate"  This word doesn't mean I will provided it later. It mean I already provide. If it's a wrong form or if the customer doesn't qualify. Should the customer have a chance to back out? 

      The different in the amount is not $40 where I will be willing to pay the different, It's over $4000 that I am not wiling to pay. 

      This is clearly a form of scam this company is running.

      In the Complainant's last response she reiterates the language in the Special Notes provision on Page 1 of the Contract "buyer is tax exempt, and providing a tax exempt certificate" and then states as follows: " this word doesn't mean I will provide it later. It means I already provide. If its a wrong form or if the customer doesn't qualify. Should the customer have a chance to back out?" The answer is No without breaching the Contract.  The Complainant stated in her own words that the Buyer is tax exempt and will provide a tax exempt certificate. That language is a statement of fact, not a contingency, which the Complainant, as an authorized signatory on behalf of the Buyer, signed the Contract. It was the Buyer's legal obligation to produce the tax exemption certificate, but if that is not possible, then pursuant to Page 3, Section 13 of the Contract, Buyer, upon delivery of its Steel Building, must pay "all applicable  sales tax and all other taxes on the Purchase Price. That is why, in Universal's original response to Complainant's BBB Complaint, specifically stated that upon Buyer's failure to produce the tax exemption certificate, for informational basis only, the Contract was marked up to reflect that Buyer would now have to pay the CA sales tax due of $4,262.50. The marked up copy of the Contract was solely for informational basis and never signed by the Parties and has no legal applicability. The executed Contract signed by the Parties on October 7,2021, is the sole legal document binding the Parties.

      The Buyer has 2 options: Produce an executed CA sales tax exemption and no sales tax will be charged on the delivery of Buyer's Steel Building. Or alternatively, pay the sales tax of  $4,262.50 when the Steel Building is delivered.

      I have send a copy of what I have to the sale representative prior to sign the contract. the sale rep said it good to go. it's a seller responsibility to notify the customer of there are mistake on the contract and not to force this on to the customer. 

      change on the contract will need to have mutal agreement. 

       

      there are no contract between the buyer and the seller if we are not consent to the change, I had call in and cancel the contract right away after we know about this change. 

      you have to educate your sale representative and not to give a fault information to the customer. 

      this is a bad business to trick a customer into a contract and force them to stay in the contract. 

       

      I have call in and cancel numerous time with customer service, sale rep, manager, and I had take to Arthur Smith that I am cancel the contract. 

      there will be no delivery  on this order... I will not deal with company who is bully customer, not honest and unethical

      March 30, 2021, I purchased a Olympia Steel Building by signing contract and paying a $6,000 deposit, an executed hard copy contract was mailed to my house. On June 21, 2021, I received email from Shala C****, stating Olympia is scheduling delivery of the building October 4 – October 18, 2021, call to confirm. I responded to the email-Still waiting on Permit, still expect delivery in October. Not having heard anything further from Olympia, I have called Charles Sales Rep on: July 15, Aug 27, Sept 17, Oct 1, & Oct 6, 2021 – each time Charles tell me the office will get back to. No one has ever called me, nor left a message. Oct 6, Alex N**** called & said he would get back w/ delivery date. Oct 8, I called Alex, Alex rudely stated “if I still want the building there is an $18,000 price increase payable now and I still have to pay $15,523 at delivery, if you do not like it, you lose your $6000 deposit”. I wish I saw the 19 similar previous BBB complaints before now.

      Put a deposit down on a large barn, after I was assured that it was exactly what I wanted. I few weeks later, I called to make it bigger, and again was assured that it was what I wanted. The vice president told me that they specialized in riding arenas, so he knew what I meant. A few weeks later, I was emailed the engineered drawings, which said that this barn was not going to be anything like I was told. Because of the size of the I-beams I was losing a lot of much needed space. Not only that, but my foundation company said that they were unable to make this barn, on the stem walls. Quality knew about these walls. I was lead to sign a contract that was for something that isn't going to work for me. After contacting quality several times, they are offering to give me 15k, of my deposit but want to keep 10k as a deposit for another barn. But I need a barn now, not one that I don't want later. It has been so frustrating. I was talked down too, bullied, and intimated. I feel like I am be

      Ordered a steel building to be picked up Sept/Oct time frame, was told by our sales person about that time frame, as we needed the building in before winter. That was the deciding factor on ordering our building. Put down a $5,000 deposit. Signed purchase order. A few weeks later, received a call from their delivery dept, wanting me to sign delivery order to book our time slot for late Dec 2021/January 2022. Claimed they do not have to honor the salesmans agreement, and they should not have told us that and that we are lucky to get it then. That other companies are quoting mid 2022. Refusing to refund our $5000, and we are now seeking legal counsel.
