Dealership accepts offer and then refuses to complete a sale to out of state buyer unless in person. Originally cited a law in Pennsylvania you have to be there in person to sign but then changed the story when asked for the statute to they “have had issues” for non in person sales. When asked further they failed to respond and blocked my number

***** ****** emailed us under two fake names "***** *****" and "******* ******" and two fake email address's. To protect ourselves because of scams and fraud and him being out of state, we told him that to complete the sale of the vehicle you have to be here in person with proper i.d., insurance information and proper payment and we would gladly sell him the vehicle. He kept demanding we send the title to the vehicle in the mail to him when we told him we cannot because we have gotten scammed before. When we tried contacting ***** ****** via phone call he would never answer the phone but would only text which was a red flag for us because we have dealt with scammers in the past and that's exactly what they do. When we had the conversation over text explaining he had to be here in person, we were the last ones to respond. He never responded back after that and no one from the dealership blocked his number.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I don’t know the 2 individuals referenced but in looking at this dealer’s reviews online i can see they also refused to sell to another individual in Texas.  I am not sure how this dealer would determine what is a “fake” email address or not.   I am in Michigan and it is my first time contacting this dealership and it appears there are others that have the same issue with this dealership.  The vehicle in question has been for sale for over a year so it’s very likely more than one person out of state inquired about it

    Regards,

On April 14 2023 my son and I went to this place to look at some cars we seen on a web site. We purchased a 2006 Nissan Altima for $9,200.00. They said it was a decent car, but it is not. The car started to jerk when my son accelerated. We took it to our mechanic and there was numerous problems. The brakes where bad, The axles are bad, The tire rods are bad, The muffler is bad and the under carriage is rusted out. This car is unsafe. We asked for a refund and I was told that's not how this works. On top of all this we believe the odometer was rolled back. These people are playing a dangerous game. This car should not have left the lot.

I went to North Hills Auto Mall on 5/6/2023. I had totaled my previous car and was looking for another one. I had not gotten the dollar amount that insurance was giving to me. I liked the vehicle and asked if I could give a deposit to hold it until I found out. They required $500 and said that would hold it for a week. Having been in the car business myself, this is common practice. After I found out what insurance was giving me, I quickly knew that the vehicle I put deposit on was way out of my budget. A friend of mine had a vehicle for sale that was much less, and was affordable. I verbally committed to purchase it knowing (or at least I thought i knew) that I could get my deposit back. WRONG. I went and looked at my receipt and it says that deposits are non refundable. I have never heard of a dealer doing that before and it is wrong. I lost $500. I am a single household income and cannot afford to lose $500. I want my money back and I plan on getting it. It's wrong.

This is in response to ID# ********
To Whom it may concern, this is an educational reply for now and future complaints on breach of a contract. When you enter into a legal contract agreement you are bound by the laws of the state. Just because you change your mind does not release you from the contract. We have a zero-tolerance policy for anyone that tries to breach a contract with us.
On 5-6-2023 ****** **** ******** age 59, came to NHAM and requested a pre - inspection on a 2009 Honda CRV which we did for free. After the inspection she placed a $500.00 non-fundable deposit that will hold the CRV for seven days. This means that we cannot sell the vehicle to anyone else and is off the market.
Also Ms. ******** told us that she used to work in the car business. On 5-9-2023 she called and told us three different stories that did not make any sense and then requested her $500.00 deposit back. It is concerning to think that she cannot take responsibility for her own actions and trying to place the blame on us stating that we took her money and now she cannot pay her rent, how irrational is that? Why are you shopping for a $14,598.94 vehicle if you cannot afford to pay your rent.
After all this illogical behavior we still tried to help Ms. ******** and told her that she could transfer her non-refundable $500.00 deposit to a cheaper Honda CRV or a more affordable vehicle. We also told her that we could have sold the 2009 Honda CRV to a gentleman in Ohio but could not because she left a deposit on it. She refused any help from us in this situation.
In conclusion, Ms. ******** tells on herself in the complaint that she was is the car business, and she says this is common practice and that she looked at her receipt that she has a copy of that she signed twice that states in large print deposits are non-refundable will hold vehicle for seven days. She is not entitled to anything and she knew when putting the deposit down that it was non-refundable. She changed her mind, telling us silly stories and is trying to get out of the contract. That is not how a contract works. She has just cost us time and money for her ridiculous actions and we cannot entertain such nonsense at this time.
