    I am filing a formal complaint against Dr. Jason T**** and Tripp Chiropractic & Nutrition for misleading advertising and deceptive business practices. On April 1, 2024, I signed an agreement for a "Comprehensive Neuropathy Pain and Treatment Plan" based on Dr. T****** assurances that it would relieve my neuropathy pain. I paid $7,000 through a credit card they pressured me to open. However, after further research, I discovered that the products and services recommended could not deliver the promised results. Dr. T****** claims, made in person and through advertising, were misleading and induced my consent under deceptive pretenses. I immediately notified him that I wanted to cancel the agreement. T then returned everything. My lawyer has tried to contact them several times to confirm the cancellation, but they have not responded. Specific instances of false advertising include promotional materials and seminar presentations implying that the treatment plan could reverse or cure neuropathy and diabetes—scientifically dubious claims. As of today, a banner at the top of his site advertises for a seminar entitled or described as “Fix Diabetes.” Dr. T****** practices appear to specifically target elderly and vulnerable patients, exploiting their desperation through false promises. Online reviews from other patients indicate similar experiences, with complaints of being scammed and pressured into expensive treatment plans that did not deliver the promised results. This pattern of behavior reflects a broader issue of exploiting vulnerable individuals. I request BBB's assistance in resolving this matter by seeking a full refund and nullifying any financial obligations arising from the agreement due to the deceptive practices involved. I believe the agreement should be considered void ab initio Additionally, I urge the BBB to review Dr. T****** business practices to prevent other consumers from being similarly misled or exploited. I will email additional information.

    Please allow this correspondence to serve as a written reply to the Complaint filed indicating consumer dissatisfaction with Tripp Chiropractic referenced by the file number above. Please be advised that my office is representing Jason Tripp, D.C. and Tripp Chiropractic and Nutrition in conjunction with this matter. 

    Mr. Mercurio seeks cancellation of the contract between Tripp Chiropractic and Mr. Mercurio which includes a request that all charges be refunded. The narrative that is part of the Complaint contains certain factual inaccuracies which will be addressed more fully below with supporting documentation. 

    1. Mr. Mercurio did attend a Neuropathy seminar at a local restaurant presented by Jason Tripp, D.C. of Tripp Chiropractic and Nutrition. 
    2. As part of the seminar, Dr. Tripp explains in detail the treatment involved, the length of care, and conducts a discussion regarding the fees during the course of the presentation. 
    3. Joseph Mercurio presented to the offices of Tripp Chiropractic for examination of neuropathy symptoms on March 29, 2024. At the time of presentment on that date, Mr. Mercurio was provided with a copy of the Medicare Guidelines, Section 2252.3 wherein Mr. Mercurio was informed that Medicare will not pay 
    100% for his care. Mr. Mercurio reviewed and signed the document. (See copy attached hereto and marked as Exhibit A.) 
    4. An examination was performed on 3/29/24. The patient was informed that Dr. Tripp would analyze the x-ray and the examination findings. At a subsequent appointment, the doctor would review with the patient the program related to the care, how long it would take. As part of the proposed subsequent meeting, Dr. Tripp would review all insurance and financial information before starting care. Mr. Mercurio was instructed to bring anyone who would help him make health and finance decisions. 
    5. Mr. Mercurio returned to the office on April 1, 2024 by himself. His history, exam findings, test results and x-ray findings were reviewed in detail with him. Dr. Tripp went over all recommendations for care which included a variety of therapies. All care recommended was based on examination findings, which included, but were not limited to, the following:

    In-office care: included arthrostim, chiropractic adjustments, vibration therapy, traction, physical medicine, computerized balance testing: 
    At home care: Nerve Spa Neuropathy treatment and red light therapy; 
    Nutrition program: This program is designed to improve whole body health. 
    6. Mr. Mercurio was informed that due to the severity of his neuropathy, treatment could potentially take 12 to 18 months. However, the care plan was made for the first three months. 
    7. Mr. Mercurio elected on that date to get started with the program. The office policies were reviewed in detail verbally and then the patient is allowed to read all documentation outlining the terms, conditions and scope of care plan. The office policies were reviewed and initialed by Mr. Mercurio. (See copy attached hereto and marked as Exhibit B.) 
    8. The Care Plan Agreement and Permission to Adjust form are both read and signed prior to any care. (See copies of these signed forms attached hereto and marked as Exhibit C.)

    9. The Receipt of Equipment and Supply form is also read and signed. (See copy 
    of signed document attached hereto and marked as Exhibit D.) 
    10. The refund policy is reviewed multiple times during the consultation and the signing of the paperwork. Expressly set forth therein is the indication that no refunds are accepted for nutritional supplements, equipment, products or supplies. The patient signed the receipt of equipment form, the disclosure of fees, the comprehensive treatment plan and the agreement for care/permission to adjust forms. All four of these forms spell out that the nutritional supplements and equipment is non-refundable. 
    11. The total cost of the comprehensive neuropathy pain treatment plan was $17,433.00. (See copy of signed plan, disclosure of fees which were signed on April 1, 2024 attached hereto and marked collectively as Exhibit E.) 
    12. Mr. Mercurio signed the patient policies of Blueprint Vitality and agreed to financing through CareCredit on the same date. That financing was a total of $7,000. (See documents collectively attached hereto and marked as Exhibit F.) 
    13. On or about April 2, 2024, the niece of Mr. Mercurio, Linda Anderson, Esquire, contacted the offices of Tripp Chiropractic with a request for a refund. Until clearance with Mr. Mercurio was obtained, no discussions pursuant to HIPAA were undertaken with Ms. Anderson. Once clearance was obtained, she was informed that nutritional supplements and equipment are nonrefundable pursuant to the agreements reviewed, read, and signed by Mr. Mercurio. She was informed that a refund can be given for any care that has yet to be received. 
    14. Mr. Mercurio agreed to the financial agreement and was fully aware of the refund policy regarding nutritional supplements and equipment at the time of execution. He is not being charged for any care that he has not received. He paid a portion of his bill using CareCredit financing company. CreditCare financing company investigated the dispute over the monies paid by Mr. Mercurio and found no fraud. (See copy of correspondence from CreditCare dated May 8, 2024 attached hereto and marked as Exhibit G). The rest was to be paid by an auto debit from his account. The auto debit has been cancelled. However, the total cost for the care he received and the equipment and nutritional supplements that were provided to him amount to $8,173.00. (See copy of documentation for these charges attached hereto and marked as Exhibit H.) Mr. Mercurio has paid $7,000.00 of the total costs; however, Dr. Tripp is amenable to waiving the remaining $1,173.00 balance that is owed.

    However, pursuant to the duly executed terms of the agreements, Mr. Mercurio is not due a refund for the charges already paid. 
    15. The terms of these agreements are clear and unambiguous. 
    Therefore, the cancellation of the agreement in the manner accepted by Tripp Chiropractic is in accordance with the terms of the documentation which has been provided. The retention of the payment for services rendered and materials supplied is appropriate. No refund should be ordered.

    I went to a seminar put on by Dr J T****. It included testomials of people who said they were helped by the clinic. I went two times a week which was 10 visits. Starting on February 20 until march 28. I repeatedly told the chiropractor that I was feeling worse than when I started. I had an MIR preformed and took the results for the Dr. to read. He looked at the MIR and said it looks like a little arthritis. Which is incorrect I have alot of arthritis and will need a Hip replacement. I stopped going when I complained and got no result. when I signed for this treatment I was told I could get a refund if I stoped treatment. I asked for the refund in march I was told I had to wait 30 days. I waiting over 30 days called and was told I have to wait another 30 days. When I was told I would receive a refund after 65 days the amount is $149.00. This is not acceptable. What recourse do I have?

    The patient came in to this office for examination on Feb 20, 2024. She came back for report of findings and recommendation go over. We reviewed her case and went over necessary paperwork. She agreed to care and paid her fee. She proceeded to come in for several visits in the clinic. She decided not to continue her care / treatment. At that time the amount of care that she had already received was calculated and the difference was refunded back to her. At this time there is NO refund due. See attached paperwork that was previously sent to her showing that there is no further refund.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    I continually told them the treatments were making my hip worse. I even gave the doctor my MRI to review and he said only minor arthritis, to be expected in some one my age. I went to the Medical doctor and he said I needed a hip replacement these treatments were not going to help. When I told the Dr at Tripp's office he said these MD's always say that. You have to be patient the treatments will work you just have to stick with it. I repeated that I was in more pain now and the treatments I was were doing wasn't relieving any pain it made the pain worse.  I went to the office 2 times in Feb, 8 in March, and 1 in April. When I said I wanted to talk to the Dr I was told I had to speak to Betty Jean the bookkeeper.

     I was told by Betty Jean they have 30 days to review on April 1st. I called on May 1st and told again I would have to wait 30 days. I told them this was 60 days already Betty Jean said wait another 30 days. June 6th  Berry Jean told me she would review and refund to card. On July 16 Betty Jean said I would receive an estimated refund of $148

    I looked at the charges on the list they sent and I didn't receive all of the treatments they listed. I did the same 4 things over and over. Because, I did most of the work, attaching the equipment myself the Dr only used a little gun like thing that vibrated and did an actual adjustment of my hip 4 times. 

    When I had the first consultation I was told I could pay individually for each session or pay up front it would be cheaper. I was scheduled for at least 6 more weeks when I stopped going. But, I do not agree with the items listed it s very hard for me to say that they were actually used because I ( had to do most of the items yourself) did the same things every time. 
    1. I sat on a flattened out ball and rotated
    2. I put a weighted harness on my forehead put my head back and stood on a vibrating platform.
    3. 2 times they put a wet sponge on my hip where the connected wires that vibrated.
    4. I lay on a table and the Dr. used a hand held vibrator on my hip (which I repeatedly said was very pain full)
    he did actual hands on adjustments on my hip 4 times and I had to ask for those.

    I should be getting alot more back the list of charges has so many things that were not actually preformed. Again, I did most of the treatments myself.

    I have read the complaint I received from the BBB written by ****** *****. I see that the
    complaint revolves around her feeling like she should not pay this amount for the care since she did
    most of it herself.
    The Adjustment is performed entirely by the doctor. He uses his expertise to determine
    when and where he needs to adjust. He uses by hand adjusting or with the instrument depending
    on the severity of the case and the temperament of the patient. The patient was being adjusted with
    the professional instrument adjustments.
    There is a discount for prepay when someone decided to prepay. That is the fee she was
    charged. Each therapy is billed at normal fee and calculated up to the total that is paid. Any saving
    is at the end of the treatment plan.
    No matter what form of treatment, healing takes time. You can perform a therapy or take a
    medication that numbs the pain or make you feel better short term but that does not produce
    lasting change. Correcting the root cause of the problem is what will produce a more lasting
    change. A simple google search will show that there are three phases that your body goes through
    when it is healing. Each one takes time for the body to heal through that phase. For cases such as
    these it can take many months or even years to reach full healing, based on current research. M* ***** decided not to complete the treatment plan.
    She had questions about the charges for care. The charges are for the care actually
    received. Based on how much care she has actually received in the office the total amount of care
    was calculated. The difference between what she paid and what she actually received was
    refunded to her. There is no further refund due at this time.

Throughout all of my visits the only time I did not operate the equipment was when the staff took a little vibrating wand and pressed it to my hip. 
    I did not join a health club where I worked out by myself. I was expecting to receive treatment from professionals. I did use the different equipment there (which included a flat type ball which I sat and rotated on) but again I did not have a staff member perform any treatments except when staff applied the vibrating wand, which I told them repeatedly that it hurt more each time. 
    I also took the *** that I had a copy of to the staff for review. I was told just a little arthritis nothing too bad can be cured. I am now waiting for insurance to schedule me for a replacement of my hip. I do agree I incurred some costs for using their equipment but the list I reviewed does not explain the amount of charges they applied or why. 
    Mr ********************** stated I received a discount for prepay. Each therapy is billed at a normal fee and calculated up to the total that is paid and any savings at the end of the treatment. The problem with this explanation is I was in more pain and had to stop. He is suggesting I have to pay him even though I do not want to continue to let them cause me more pain. 
    I do expect to receive more money back and I will continue to pursue this matter till I get a satisfactory result.

    I have read the response to the complaint. I will attempt to answer the question more fully.

    The first section of the complaint is about how you did not value the therapy that you received.

    Throughout all of my visits the only time I did not operate the equipment was when the
    staff took a little vibrating wand and pressed it to my hip. I did not join a health club
    where I worked out by myself. I was expecting to receive treatment from professionals. I
    did use the different equipment there (which included a flat type ball which I sat and
    rotated on)

    The vibrating wand is an adjusting tool. Only a licensed trained chiropractor can use that tool
    effectively to make specific scientific adjustments to the spine.

    The second statement is true. You did not join a healthclub. This is a doctors office. The therapy
    recommended are directed by the doctor. The therapy and exercises are directed at correcting
    and or rehabilitating your body. Many of them are performed by, you the patient, with
    instruction and supervision, as a way to help you know what to do at home. This method
    teaches you how to take care of yourself so that you do not need to have continued care. When
    you are able to learn what to do to prevent future recurrences, you have more confidence in
    your health and feel empowered to keep yourself healthier. I am sorry if you did not
    understand that. However, the therapy prescribed and the method taught were exactly what
    you need to help reverse your spinal condition based on your physical exam and x-rays.

    I will list the explanation of the therapy that you were recommended

    When you are in a healing process time is always involved. Each therapy has specific
    mechanisms and benefits.

    The three phases of care, which you can see on ********** are the: 1. acute phase (pain and
    inflammation phase) is about rehabbing the red tissue and takes about 2-6 weeks. 2. The
    rehabilitation phase. This phase is about helping get the pain decreased while rehabbing the
    white tissue and take about 4-12 weeks. 3. The stabilization phase is about creating strength
    and more lasting results and takes approximately 6 -12 months.

    As we explained when you were in the office, this is how the body works. We cannot make this
    happen faster. The body heals in a certain pattern. You must allow sufficient time for your body
    to heal. Based on how long you were under care you did not give enough time to finish even
    the first phase of care much less the last two phases.

    Your Next statement:
    I do agree I incurred some costs for using their equipment but the list I reviewed does not
    explain the amount of charges they applied or why.

    Mr. Tripp stated I received a discount for prepay. Each therapy is billed at a normal fee
    and calculated up to the total that is paid and any savings at the end of the treatment.
    The problem with this explanation is I was in more pain and had to stop. He is suggesting
    I have to pay him even though I do not want to continue to let them cause me more
    pain.

    I am sorry that you are hurting. The reason you are hurting showed up on the xray. That is why
    you came to this office. There was nothing that was done in this office that caused more 
    problems. No doctor can guarantee results. As you see in your agreement for care, we cannot
    and do not guarantee results. You do not pay for results. You only pay for the therapy. You only
    have to pay for care actually received. But you do have to pay for care, supplements and
    equipment that was in fact received.

    Sometimes when you are healing there are phases that are more or less tender as you go
    through treatment. This is especially true if you are bad enough that your medical doctor wants
    to schedule a surgery for your hip. You may need surgery on your hip. See your Medical doctor
    for that. But you also need structural alignments. You test results and x-rays etc demonstrated
    that you definitely have a need for care. Having a need for surgery does not mean that you do
    not have a need for chiropractic care or physical medicine. Many people need both. It takes
    time to heal. You did not give enough time to the process of healing. Hopefully you will give it
    the appropriate time for healing with your current healthcare choice.
