We hired Lotus for a kitchen/living room remodel after we had water damage. They came recommended by a fire chief from ******** so we thought they were a trusted company though he said he never used them but they do presentations for the fire association. At the time we met ******* Co-owner of Lotus, we were having a lot of issues with our insurance in which we shared with *******, she told us that she is an insurance agent and she can help us because she knows how to deal with the insurance. We are first time home buyers so we had no clue on how all this works. Now knowing how this turned out she preys on people with insurance claims, our first conversation she asked me to send my insurance policy because again she's insurance agent and she can tell me what to do. But lets get to the bigger problem, since the beginning I was very picky about the cabinets I explained to ******* that I do not want cheap cabinets made out of MDF they must be solid wood. The cabinets were the most important part of the project for me I wanted good quality cabinets made of solid wood I made ******* aware of this several times. We were paying 90,000 and ******* stated the reason for the quote being so high was because the cabinets were costing over 20,000 alone. When we met with our Designer from ********* on March 15th 2023 we picked out a maple solid wood white shaker cabinet. Fast forward to the day the cabinets were installed, I looked at them and immediately knew they were not the cabinets we had picked out I looked inside the cabinet and it was a completely different brand then what we had picked out originally. I asked *******'s workers what material was this made of out and they said MDF, so you could only imagine how angry I was, there own worker even said these are cheap cabinets that she pays no more then 10,000 for these cabinets. ******* comes over my house and explains that her workers notified her how angry I was that the cabinets are made out of MDF and she tells me that she had no idea that they were made out of MDF. Well not only is it her job to know as the General Contractor she also went behide our backs and didn't order the cabinets we had picked out so therefore all around she lied she tried to rip us off but getting cheaper cabinets and thought we wouldn't notice to pocket the money. The job has been done since 08/07/23 and the cabinets have so much damage to them there is tears, chips, dents and are not soft close as promised. They also damaged my brand new appliances and didn't do my flooring right left a whole piece just unfinished in my closet they also didn't cover my brand new counters when still working and got a permanent red mark on it that I can't get out. I have tried to reach out to them 3 different times to resolve this with no response she just keeps sending me a final bill which is completely insulting.Business Response

Dear Sir/Madam:Please be advised that my office represents LRR Construction, LLC (hereinafter, "LRR") with regard to the above-referenced Complaint. Please note the following facts, which directly counter the allegations made by ******** ************** (hereinafter, "Customer"):
a) This began when Customer had a demolished kitchen and a partially demolished great room. This engagement stemmed from an insurance claim and Customer had secured an offer to settle the claim for $31,021.11.
b) $90,780.00.
c) Customer had a third-party estimate to complete much of the work desired for To do all of the work required by Customer, with upgrades desired, LRR gave an approximate estimate in excess of $90,000.00.
d) Customer continued to request numerous expensive, significant, changes and upgrades, all of which are available upon request.
e) Ultimately, there were three (3) bids submitted to the insurance company.
f) At this time, Customer retained a public adjuster, which was known to LRR and reputable.
g) LRR believes and therefore avers that Customer drafted a Residential Lease with a relative, as made aware of coverage for Extended Living Costs, in the amount of $5,000.00 per month. It is unclear if Customers ever moved, yet monies were collected on a monthly basis. LRR fully intends to thoroughly explore this issue in the event of litigation. If true, this could constitute insurance fraud.
h) Customer was told, at a third-party vendor for all cabinets, that the cabinets would be constructed by plywood boxes, solid wood face frames and MDF slab. This third-party vendor will testify under oath to the foregoing. Customer actually took samples home, constructed as set forth above.
i) Customer did, in fact, consider maple cabinets, for a proposed island, NOT for the balance of the cabinetry.
j) Customer seemed to become more and more desirous of making upgrades, as discussions continued, however, Customer knew they would need to compromise, as they were extremely concerned with budgetary constraints.
k) The parties then decided to go with another third-party cabinet supplier due to repeated delays.
1) Customer then asks for numerous new charges, including, but not limited to, moving a wall, and adding additional cabinetry and improvements.
m) Customer goes to the showroom of the new cabinet supplier and sees, touches, opens and closes the doors and drawers.
n) Despite continuously requesting more new improvements and additional materials, Customer decides that their budget is only $85,000.00 now. The job then needed to be reevaluated to see what the budget would allow.
o) The parties communicate via email as to the new plan, where the cabinets were being purchased and that a new contract had been prepared and needed to be signed, reflecting all of this.
p) The Customer begins speaking to LRR's suppliers directly as to cabinetry, flooring, and other improvements. At the time, this appeared to be unnecessary and offensive. In hindsight, it demonstrates how meticulously involved Customer was with every decision. Customer even disputed that some materials were not what they selected, only to concede after much consternation that they were mistaken.
q) Customer only orders the cabinets after further conversation with the supplier and LRR, ultimately signing a "Multiple Cabinet Brands Awareness, Acknowledgement and Acceptance" Letter. A copy is enclosed herewith for your convenient reference.

r) Customer requests more work and upgrades as the installation of the kitchen
s) Customer provided its own electrical work, which needed to be corrected on multiple occasions, causing delays in inspections and approvals.
t) LRR discovers that a dryer vent and vent fan did not lead to the outside. The construction found was one massive mistake after another. Significant work was done to achieve ventilation and fire safety.
u) LRR ended up doing much of the necessitated work at NO CHARGE.
v) When the cabinets arrive, Customer is not happy with the partial MDF construction, despite all of the foregoing. The supplier and LRR explain why certain portions are MDF (best surface for painted cabinets). Customer was not happy at first, but came to understand and TOLD LRR TO PROCEED WITH THE INSTALLATION. There is a third-party witness to this, who is prepared to testify under oath.
w) Customer actually "tips" LRR subcontractors, for a job "well done".
X) Final inspection of the project is successfully completed.
y) Complaints began again when final payment came due.
z) LRR requested a "punch list" and offered to schedule a time to address any outstanding items. This has not happened to date.
aa) Approximately two (2) months passed from the approval of the cabinets by the Customer, numerous questions concerning the cabinets were raised, never about the MDF material and, in reliance thereon, thousands of dollars of additional labor and materials were expended in completion of the kitchen.
bb) Suddenly, when LRR wanted final payment, they went from the wonderful contractors who were being "tipped" several hundred dollars above and beyond the contract amount, to something much less and worthy of report to this respected agency.
In summary, this is a farce, a disgrace, an indignity, and a scam. LRR has an extensive history in the industry, with no, zero, complaints on file. This is a lot of money and paying for services and materials provided.
The final payment of $21,250.50 is due and owing on the subject project. Despite repeated demand, Customer has refused to make payment and, suddenly, there is a list of items allegedly "coming". It is worth noting that the list does not include items that have not been separately, formally, charged, which will be charged in the event of litigation.
LRR has retained my firm to collect the monies owed, which we fully intend to do. Given the instant complaint, complete with multiple material misrepresentations, my client has now asked that my firm explore the validity of claims for defamation, including both libel and slander.
My client remains ready, willing, and able to supply any and all written materials you may require to aid in your conclusions. Moreover, we fully intend to have relevant, sworn testimony available as litigation proceeds.

I am rejecting this response because the amount of lies that where told in that letter would take me several days to get through. LRR has not responded to any of my emails, I have sent several photos of damage that where caused by them including there punch list that they mention. They have not tried to set up any appointment to go over any of the punch list items they went radio silent and have not responded to anything. I have proof of everything I took pictures, screenshots, text messages and emails. I stand by my first response.

I have email and text message proof of me notifying LRR of all these issues and they have only responded with the invoice for final payment. There letter from there lawyer is a complete lie, they never tried to set up an appointment with me to go over all the issues till this date they still have not said a single word or have tried to set up any appointment to rectify this. We are now forced to get a quote from another contractor to fix all of there mistakes.Customer Answer

The undersigned hereby demands that you replace the unauthorized brand cabinets made of MDF with the brand I picked out, made out of maple solid wood and reimbursement for damage done to appliances and countertop also finish flooring in closet that was left unfinished as well as the trim.
For your reference I have separately attached photos of all the damage
Please note that if I have to commence legal proceedings in order to require your performance of the action, this letter will be tendered in court as evidence of your failure to attempt to resolve this matter. Further, you may be liable for any court costs, attorney fees and damages, including punitive damages.

I understand that you had opportunity to speak to my client. I would respectfully request that all communications be effectuated through me. This is simply to ensure complete communication.
If you would rather not handle this way, please advise and we can address it however is best for you.
I understand you had inquired about completing the "Punch List". My client completes all such items upon final payment. This is standard practice in the construction industry, as you know.
Moreover, please note that certain items appearing on the Punch List from the Dixons were NOT included in the original contract. Specifically, the "trim work" and "flooring in the closet" were additional items, which are NOT part of the contract. We intend to fully litigate all of these issues if a resolution is not forthcoming.Should you have any questions or concerns, please do not hesitate to contact my office.

I would like written proof, some sort of documentation that LRR had tried to reach out to me to resolve all the damage like they claim.
