    Consumer called Consolidated Recovery Group LLC (CRG) regarding the outstanding debt with ****** ******* *********.  Consumer was aware of transaction that constituted the outstanding balance.  CRG explained and provided the Personal Guarantor clause of her contract with ******.
    Documents have  been attached to this complaint and another copy of Agreement and Charges emailed to Consumer at the address provided via this complaint.  
    CRG welcomes the opportunity to resolve this matter with Consumer and improve her personal credit.  She may contact our office at ************ or email ******************************

    After reviewing the information you sent me, I must inform you that you have failed to validate this debt. Your office hasn’t sent any portion of what appears to be acceptable documentation so you have not yet provided sufficient evidence, as required by law, that this alleged debt is accurate and mine.

    Mr. ****** was sent multiple notices in the mail notifying him of the debt and informing him that he may reach out to request documentation which verifies the debt. The notices also informed him that the debt would be reported to the credit bureaus if no action was taken to contact us to resolve the debt. We did not receive any notification of returned mail and the address we have on file is the same address he provided in this complaint. We also have no record of Mr. ****** contacting our office at any time, including after receiving multiple notices from us. Instead, we received a dispute with the credit bureaus, which we responded to and confirmed the validity of the debt, and this BBB complaint. Mr. ****** is welcome to contact us to resolve this matter at any time. 
    Despite not receiving a direct request from Mr. ****** to order documentation which validates the debt, we have taken action today to request these documents and will provide them to Mr. ****** proactively.

    I am rejecting this response because I wanted your company to send me the proper documents to validate this alleged debt. So let it be known that I am requesting full validation of this debt. If you are unable to provide all the proper documents, please remove this account from my credit report.
    Kindly provide all this sufficient evidence, per the FDCPA requirements, that this alleged debt is accurate and mine. Please send me a copy of all the following:
    1. Complete payment history, including but not limited to, verification by line item (with an explanation of each item) for the entire amount, dates of execution, as well as last date of activity.
    2. Proof of my identity
    3. Proof that Consolidated Recovery Group, LLC owns this debt or the Contract giving you power to collect
    4. Proof that this debt has not been written off as a tax liability

    5. A complete Audit Trail calculation of this balance, including the complete payment history on this account

    6. Documentation that shows I agreed to pay this debt with my signature; documentation that shows I gave you permission to have my information; and paperwork showing I gave you authorization to report this to my credit report. No consent was given to you having my information, and unauthorized use of my social security number is identity theft, and you will be reported for such.
    7.  A copy of your state license, including license number that give you rights to collect in my state.

    Today, Consolidated Recovery Group, LLC just received the documents from the Original Creditor.  These were obtained after the BBB complaint and CRG was not given the opportunity to forward to the Consumer prior to his request for Cease and Desist.   Upon review, the documents contractually validate the outstanding debt between the Consumer and Original Creditor.  Despite these facts, CRG has made the determination to close out the account, transfer the outstanding balance back to the Original Creditor, and delete our tradeline from Consumer's credit profile with the national credit reporting agencies. Moving forward, Consumer should directly contact the original Creditor Creditor to resolve the outstanding balance.

    Consolidated has expediently and professionally acted, and will continue to do so, with all Consumers who respond to our attempts to contact them.

    I have spoken with this company numerous times and have been told they will be removing their line from my credit report and they say they have done it and I need to call ***** *****. Which is not the case. I have reached out to ***** ***** and they informed me they have no control over what they report. I have also put a dispute through numerous times where consolidated recovery has told me that they have responded to the dispute confirming my dispute and it will be deleted. But it always comes back as confirmed from their end and remains on my report. It has months of contacting them and them acting like there is nothing else they can do. This business can not provide any documentation to me regarding the debt so I can file a police report because it is a fraudulent account.

    Consumer has expressed to us various times that ** has not deleted this from his credit profile.  Consumer is trying to buy a house and Consolidated Recovery Group has removed the dispute from the national credit reporting agencies twice.  To help the situation, I re-sent a letter to consumer today to confirm we have removed from his credit report.  Unfortunately, there is nothing further we can do from our side of the reporting that has not already been done.  We asked the consumer to contact the bureau and have them call us.  This has been done before by the credit agencies and if consumer would insist, they will call.  Again, we have been doing all we can from our side of the transaction to accommodate the consumer.

I Demand this to be deleted immediately from my consumer report on all 3 Credit Bureaus, and be notified immediately through writing.     Business Response /* (1000, 5, 2022/10/13) */ Mr. ***** applied for and received a credit card processing account through ****** ******* ********* for his business, ******* ******** *******. Mr. ***** is the personal guarantor of the contract between ****** and ******* ********. In early 2019, the company processed nearly $7,000 in credit card transactions that were subsequently disputed by the cardholder(s) (chargebacks). ******* ******** lost those chargeback disputes and ****** was debited for the transaction amounts by the card issuing bank(s). *******'s customer(s) were fully credited back by the bank(s) using the funds they debited from ******. Contractually, the company, and Mr. ***** individually, are liable to repay ****** for the amounts they were debited, plus fees, and in accordance with Section 7 of their contract, finance charges. The account balance was transferred to ******'s Collection Dept. and when they failed to collect the amounts owed, the contract was assigned to this firm for collection. We finally made contact with Mr. ***** in February 2020 when he told us that he was not dealing with us on customers who got their money back on services performed. When our rep attempted to explain to him why he owed the money, he hung up on her. We have been unsuccessful in reaching Mr. ***** again. Further, we have never received a request for documents from Mr. *****. We have ordered copies from the client today and will forward them by email when received. Again, the line on Mr. ***** personal credit profile appears there because of his guarantee. We are, and have been, willing to work with Mr. ***** to have our line changed or removed as soon as he addresses the balance due on his contract.

    Consolidated Recovery Grp is attempting to collect a debt I am not liable for. This account originated from ******* I do not have a contract with Consolidated Recovery Grp. They did to provide me with a SIGNEd contract as requested.

    Business Response /* (1000, 5, 2022/09/15) */ I read Ms. *********s complaint with interest as she knows exactly why she is being billed and why this firm is handling her account. On January ** 2022 an electronically signed application was submitted to ****** ******* ********* to process merchant credit/debit card and check transactions for Ms. *********s business, *********************** LLC. ******'s Merchant Agreement was incorporated into the application and all the terms and conditions were agreed to at end of the document. Failure to agree would have caused the transmission of the application to fail. In early February, the company processed three electronic check transactions that totaled over $48,000. Those checks were returned to ****** unpaid, one for *********** *******) and two for ******************* Since ****** paid the company initially for the transactions, they have now sustained a substantial loss. Contractually the company is liable to repay ****** on any check that is returned unpaid. Ms. ******** is also liable individually as there is a specific personal guarantee as part of the merchant contract (Section 3). Also, per Section 7 of the contract, Ms. ******** agreed to pay a finance charge on any amount that is not paid when due. The debt was transferred to ******'s internal Collection Department and when they were unsuccessful in resolving the balance, the contract was assigned to this firm. Ms. ******** has been provided with a copy of her application and contract, and has been supplied with all of the detail on the return items that her company processed. Her response to this is that the transactions were fraudulent, which may or may not be true. That, however, does not change the situation concerning the company's, or her individual, liability with regard to losses sustained by ****** for transactions processed by the company. In accordance with the FCRA, our reporting of Ms. *********s personal information to her credit report is marked as * (Guarantor) and coded as ** (Disputed). We are more than happy to work with Ms. ******** to resolve the balance and credit reporting issues with her and she should contact us to further that discussion. Consumer Response /* (3000, 7, 2022/09/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) Consolidated Recovery group has refused to accept any documents showing I am not liable for the debt. I do not have a contract with Consolidated Recovery Group, ****** was sent the accurate documentation and it is not my position to ensure Consolidated has received this documentation. As I have stated I do not have a contract with Consolidated Recovery Group, they provided a signed contract from ****** which I am not liable for. I have responded to various emails from Consolidated Recovery Group and my attorney is now handling this fraudulent attempt to collect debt. I expect Consolidated Recovery to cease and desist all attempts this debt will be handled with the original creditor. Ms. ******** has provided us with no documentation except a faxed demand for validation of the debt which we had already supplied to her two weeks prior. We have not heard from her attorney, nor do we have knowledge of whom that might be, but would welcome the opportunity to work this out with him/her.
