On August 28 I contacted Brett with Marietti Fencing to discuss hiring him after seeing a connecting neighbors fence. Our primary method of communication was text messages, in which I inquired whether the materials used were weather treated and asked the style match that of my neighbors. Mr Marietti assured me it was treated wood, and referenced his company website for reviews and examples of work. Due to scheduling challenges and my review of website I aggreed to allowing installation occuring while I was at work. Upon arriving home the day of installation, I observed significant presence of mold as well as uneven pickets, I was even able to fit my entire arm under the fence in some spaces. I immediately reached out to Brett who declined calls but continued to text assuring me everything I was 'complaining about' was 'normal'. Since the installation October 10, Mr Marietti has repeatedly refused to replace or repair the section of fence installed unevenly on one side of my house and improperly, with pickets on the inside in some sections and the outside in other sections. The company proclaims satisfaction guaranteed yet I have only been threatened, cursed out and sent an invoice with threat of intrest being added while the mold continues to spread and pickets now begin to buckle less than a month after installation. After a series of storms hit the area, Mr Marietti came preying on people in need and tried to take advantage. He is now harrassing and threatening me with a lien against my home, while continuing to refuse to fix the improperly installed mold covered pickets.

No contract was sent, despite my asking, prior to installation beginning.  Text communication, previously attached, was the only 'contract'/agreement.

As stated in the attached letter from ****’s management, where the pickets were purchased that same morning of installation, mold is a normal occurring thing on dog-eared fence pickets. I offered to come pressure wash the mold off for free, but you have denied me access to your property.

As for the one board that looks like it was missed by the nail gun, again, I would have come and added a couple nails to it, but I’m not allowed on your property.

When you walk into your back yard, your left side that we installed, matches the right side neighbor’s fence, both having the good side facing in. Your two fronts match with the good side out, facing the street.   The neighbor’s rear fence has the good side turned in.

Gaps under the fence are a normal thing.  Also, no gaps under your fence are more than 4”.  Some HOA’s require we leave the fence at least 3” off the ground for drainage.  No yard is perfectly flat, so gaps happen.

Before starting your job, I had to explain to you multiple times that you need a gate, otherwise you would have to roll your lawnmower through your house to get into the back yard. You couldn’t wrap your mind around that. That should’ve been a red flag to me.

It seems to me that you are just looking to take advantage of my company and are looking for a free fence. This is my first BBB report in 26 years of doing fences.

    Complaint: ********

I am rejecting this response because:there is no offered resolution by the business. The business response is just another demand for payment of unconforming goods.  Brett with Marietta fencing, delivered and installed unconforming goods, then demanded payment without addressing issues brought to his attention regarding the installled "fence". I initially requested the moldy, uneven, improperly facing pickets be removed and replaced with new weather treated wood pickets but Marietti fencing repeatedly refused. Instead offering to "pressure wash the mold " while ignoring all other issues. When I inquired whether he was licensed to pressure wash and what guarantee came with that solution regarding the matter of mold and integrity of the new pickets after such time they were pressure washed to which no response was given other than stating that was the only way to get rid of mold. At this point I would like the business to remove the mold covered health hazard from my yard and cease all contact. I was willing to accept removal of all mold impacted, splitting, warped and unevenly installed pickets and replacement with goods commensurate with those advertised and pictured with satisfaction guarantee on  Marietti Fencing's business site, but the company has repeatedly refused this solution. They have falsely represented their work and business practices online,  as the "fence" installed is in no way new nor equal in quality to that of the standard quality of expectations regarding a new fence.

    Sincerely,

As stated in the previous response from a letter directly from ****’s management, pressure washing the mold will take care of the mold. I offered to do that, at no charge, which I’ve never had to do in 26 years of business. The sun it self will dry up the moisture in the boards.

Also, as I’ve explained to you multiple times, when you enter your back yard the fence on the right side of your yard matches the  fence on the left. The back is different because the neighbor in the back put the good side facing in. I put your good side facing in too. You told me to build it the exact way that the neighbors was built. All of this was explained multiple times to you.
when a new home is built and it gets mold in it they don’t take the house down and build a new one they remove the mold.
Unfortunately for me, I have ran into a customer that thinks I’m going to just forget about this and you’ll get a free fence. That’s not the case. I work too hard for my money building fences to let this go. If the court system is the only remedy to getting my money for your fence then unfortunately that will be the case.
