I had full intentions on purchasing the Certified Warranty covered 2018 Black on Black Kia Sportage and had full faith on paying for car on 11/26/21. I made the difference payment in full from loan amount to sale and tax amount. On 11/29/21 (3 days) had major car break down that left me stranded on the road and no way of getting to my major health appointments and left waiting on assistance with transportation. No call from the salesperson or manager. Just a demand to bring the bank check for the loan amount of the sale. I immediately voiced my concerns about safety with this car on day 3 and that I no longer wanted the vehicle. I was told the car would be fixed. I picked up the car on 12/1/21 drove the car and within an hour of having the car, it stopped and would not start again. So apparently they did not fix whatever was going on with the car that even after a new battery it would not start for more than an hour. After getting to the dealership I verbally informed them again that I no longer wanted this car and I wanted my money back. If the car did not work after driving it less than 200 miles than it was not be safe for me to drive. The manager at the dealership told me a deal is a deal and that there was no way to give my money back that the car was mines now. The manager got all in my face without a mask to cover his face all in this climate of Covid 19. I had the cops called on me because I would not leave the dealership without my money. Here it is another week and I do not have a reliable car. They tried to work out another deal but that would have me spending more money that I do not have. And also they have the original care marked at $20K as a trade in and I bought the car at $25,505. So why did they depreciate a car that its their fault but wont credit me the same price I paid. At this point, I am no longer wanting to buy a car from the Kia Charleston dealership. I feel they frauded me twice in this situation. I have never been treated like this in order to spend my money. No one should have to put up with this, especially a senior citizen who was acting in good faith. And now they are threatening to charge me storage fees for a car they refuse to rescind the sale on. So we both can walk away whole.

While the fact that the car encountered an issue so shortly after the vehicle was purchased is unfortunate, it does not constitute refunding a customers money. We told the customer that we would be more than happy to facilitate her in any wa possible to get the car fixed as quickly as possible and back to them. We service every vehicle before it is sold, and certified pre-owned vehicles go through an even more rigorous inspection. Unfortunatley, from time to time we run into issues shortly after a customer purchases a vehicle. We offered the customer a loaner car if needed and they refused. We fast tracked the car into the service department even though they dont have an open appointment for 3 weeks. We fixed whichever issues that needed to be resolved at no cost to the customer. We even went as far as to offer the original purchase price in trade value towards the most comparable vehicles we have in inventory at the moment. Technically, as a dealership, we didn't have to do any of that, but we did because we wanted to take car of our customers. What we WILL NOT tolerate is customers getting in sales managers faces and yelling and cursing in the showroom.

Once a deal is finalized and customers have taken possession of a vehicle, according to South Carolina State law, the deal is finalized and there is no "cooling-off period"

The law in South Carolina is very simple. If you sign the paperwork, you are deemed to have read all of the terms, understood all of the terms, and agreed to all of the terms. Therefore, as a general rule, the courts will hold you to all of the terms, and you will be responsible for paying for the car.

You might have heard you had three days to cancel any contract. Let me clear up the confusion. There is a seventy-two hour "RIGHT TO CANCEL" on second mortgages and home solicitations like door-to-door magazine sales. This right does not exist regarding car sales.
