    7/13/2023 I purchased a vehicle from Payless Auto Sales putting 1200.00 as a down I was notified to come to the lot 8/5/2023 I got there they asked for money down when they told me to come get 2016 fusion I switch insurance over only for them to make me to turn the car back in without giving my down back. Nothing is stated in the contract they can keep my funds I left with my money or a car I have special needs kids and what they did was a spot delivery and misleading practices of a young girl who is a first time buyer. I want my money back the same way I have it urgently after them trying to make new terms up today and not fulfilling their contractual obligations.

    Miss ***** came into Payless Car Sales on 7/13/2023 and was approved on a 2020 Kia Forte.  This approval was based on stipulations required by the bank and were provided by Miss *****.  Miss ***** did put down $1200.00, however when all documents were sent in to the bank and reviewed the paystub provided by ********* was questioned by the bank.  We contacted Miss ***** and requested additional paystubs because the bank was questioning.  Finally after Bank still questioned the pay stubs they made a decision to decline the application due to questionable pay check stubs.  Miss ***** signed documents that disclosed that if the deal was not funded by the bank and was returned back to dealership, that downpayment would not be returned.  The miles on 7/13/2023 was 113,940.  The miles when Miss ***** brought the car back to the dealership on 8/5/2023 is 115,264.  Miss ***** put 1324 miles on our car.  So based on the miles incurred on the 2020 Kia Forte
    while in her possession and the fact that the bank would not fund the contract because of questionable paystubs provided by Miss ***** that is the reason for Payless Car Sales not refunding the $1200.00 downpayment.  Also, Miss ***** had our vehicle for 23 days.

    I am rejecting this response because: 

    nowhere in the contract is there information that specifies the penalties for exceeding a certain amount of miles. In addition to this on the conditional delivery form it states that "seller will promptly return any vehicle, payments, fees, deposits, or other things of value received from buyer". There are several South Carolina laws that support this statement such as 37-2-504 that entitles me to restoration of a down payment and 37-2-502 stating goods provided by a seller can not be returned in the same condition buyer received them, meaning that mileage placed on the car was going to occur as the purpose of a vehicle is to drive it. That being stated due to my down payment not being returned laws are being violated and I would like this to be remedied by either a full down payment refund or a negotiated price but withholding the total amount of $1200 is illegal and unethical business practice.

    Purchased a new vehicle in December of 2022. Dealer switched tags to vehicle and never registered the vehicle also did not provide me with paperwork or copies of all forms signed and submitted and as a result of this on 5/10/23 the car was impounded and I suffered a job loss because of this. Went to DMV on 5/11/23 and they had no knowledge I even had the vehicle so i could get proof of ownership to get the vehicle released. Attempted contacts but never received any feedbacks from dealership or finance service Consumer Portfolio Services.

    On 12/16 2022 Mr. ****** ***** purchased a vehicle from us Payless Car Sales. Mr. ***** insisted on having his tag from another vehicle transferred to his new vehicle. We advised him several times over the course of several months that his tag cannot be transferred until his past due taxes were paid to the state of South Carolina. 
    Mr. ***** still  insisted and stated that he would satisfy his taxes but due to unforeseen reasons the taxes were never paid which leads to us not being able to transfer the tag. 
    So after many failed attempts to Mr. ***** requesting him to satisfy what's owed on his taxes we were forced to perfect the lien. So instead of us continuing to reach out to Mr. ***** requesting him to take care of the taxes we Payless Car Sales did what many dealers would not do; we paid the taxes not only to satisfy the lienholder but to try to make a customer happy.

    I am rejecting this response because: THAT IS A FALSE STATEMENT AND I DISAGREE WITH THAT. THEY KNOW THAT. NOBODY TRIED TO DO ANYTHING AND NO ATTEMPTS WERE MADE TO CONTACT ME. I DID NOT INSIST THAT. THEY WERE SO BUSY TRYING TO MAKE THE SALE INSTEAD OF DOING THINGS CORRECTLY! THEY EVEN HAD ME AT THE DEALERSHIP TWO HOURS PASS CLOSING TIME AND FOLLOWED ME TO MY HOUSE JUST FOR ME AND MY GRANDMOTHER TO DO PAPERWORK. THEY PUT THE TAG ON THE VEHICLE. I HAVE A WITNESS. I JUST WANT TO RETURN THE VEHICLE AND GET MY REFUND! THEY DIDNT GIVE ME PAPWRWORK OR COPIES OF PAPERWORK AND WHEN I ASKED AND CALLED THEY KEPT SAYING IT WOULD BE MAILED OUT.     I purchased a 2015 Jeep Compass with 80k miles a month ago from this company. Shortly after I drove off the lot the car started jerking and the acceleration decreased until it cut off on the highway just a few miles from the dealership. After diagnostic tests, I was told the transmission would need to be replaced and that the warranty would cover it. In the meantime they would provide a rental. After having the rental for two weeks, the car rental company contacted me to return the car. They said they were not being paid by the dealership. Shortly after this I was told my transmission was replaced but diagnostic was now reading a misfire. I contacted the repair company and they have no ETA on repairs or no specific diagnosis. I think I've been sold a "LEMON" and they are not doing anything to resolve the issue. I refuse to make a car par payment on a car I've never possessed or driven for any significant amount of time and let me also mention I purchased this car for $30k. I was in desperate need of a car to get back and forth to work. The bank is asking me to make payments on a car that doesn't work. I'm reaching out because the dealership haven't given me any options just keeping telling me I signed the contract "AS IS" This was a horrible mistake on my part but I'm young and not familiar with laws and just trusted these people to do right by me.

    Business Response /* (1000, 10, 2022/07/20) */ Good morning, The customer stated that because she was young and did not know the buying procedure the dealership took advantage of her That is so far from the truth the day she came to buy the jeep she had an older gentleman with her that stated he was well aware of the purchasing procedure This gentleman was actually the one that bought the jeep Not the young lady After we were made aware of the problem with jeep we gave them an option when she first made the dealership aware of the problem with the jeep. At that time, we offered to take the jeep back and put them in another vehicle from our inventory. But the customers refused and stated she wanted the jeep because she liked it So we agreed to help her with the repair procedure and recommend A repair facility and told the customers about their warranty and introduce them to the repair shop employees. And about the rental car procedures the rental car is handle by the customer and the repair facility which we made the customers about the warranty company rental car procedure. Also gave the customer all her warranty paperwork. Because we like to help our customer. we the dealership without having to provide we decided to pay for a rental car for the first couple week because we were concern about the customer At no point after a purchase is the dealership obligated to provide a customer a loaner car or a rental car but trying to do what we felt was right to do we at time explain to the customers that they needed get with shop and they can get a rental car from the warranty company we thought everything was taken care with the rental car by the warranty until the customer called me and said the rental company took the rental I ask the customer at that point did her and the guy that bought the car get with the repair shop and have him get them a rental car through their warranty. She answered no at that point I advise her that the dealership can't provide them with a rental anymore she stated that the repair shop told her they had the part they needed the customer told me that since the repair only had less than a week to be finish. she could get mother to provide her with transportation. and she left the dealership I heard no more from them until one Saturday her and the gentleman that bought the car storm into the dealership when we had a dealership full of customers, they were swearing at me and he was yelling at me and calling me names I chose not to get into an argument with him and being professional ask them to leave the dealership because we had customer and some were women and children. We were never given the option of another car because I was told that was the only car on the lot that was within my budget and they weren't sure when they would be getting anymore cars. The dealership new when they sold the car to me that the car had major issues and now they made it seem minor just for me to purchase the car and use the warranty for the repairs. A Win Win for them. Now I'm stuck with a car payment and an unreliable vehicle that has constantly been in the shop. I'm just asking for the company to do right by me and put me in another vehicle, void the contract or take ownership in getting car repaired. Customer contract is with the bank they finance the car with so to get out of that contract customer needs to talk to her bank that has the lien on the jeep customer also states she is still having the same problem or another problem with the car customer has a warranty on the jeep so if the customer is still having problems with the car the car needs to be taken back to the transmission repair shop and get the repair shop to make the car right and fix it or the customer can contact the warranty company and ask them for a shop they refer customer do not have to continue to drive the car if it is not right when there is a warranty still on the car. As far as payless car sales we will trade the car back providing we have a vehicle in stock that will fit the customer wants and needs of the customer subject to banks approval. But we at payless car sales cannot just cancel their present contract and start over we do not have a contract with the customer
