Coral Sands by ******* has mismanaged and misallocated the money I paid for the exit fee of my timeshare.In February 2023, I received written confirmation from the ******************** that they had offered me an exit from my timeshare, contingent on my payment of approximately $1,400 in exit fees. I promptly paid the required amount via check and have since provided proof of this payment.Despite fulfilling my obligation, Coral Sands by ******* now demands an additional $1,500, claiming that my initial payment was not allocated toward the exit fee. This is an inaccurate example of their attempts to gaslight me into making another payment. I paid what they asked for, and they have no right to ask me for more money after I have paid what they asked for.My wife tragically passed away while we were waiting for this offer. During this harrowing period, the company showed no empathy or concern for my situation, and this lack of consideration continues as they refuse to acknowledge their mistake and rectify it.These actions by Coral Sands by Palmera are unacceptable. They must allocate the initial $1,500 payment towards the intended exit fee and cancel my timeshare immediately. **************** was approved to surrender the Coral Reef timeshare property back to the Association on 2/28/2023 for $1500. It was clarified with **************** in June of 2024 the payment of the $1500 was never received. Due to the lapse in time, he was offered to have his request to be resubmitted.Customer Answer

**************** never paid the $1,500.00 fee that our client Association charges to surrender his property when offer the option in 2023. **************** did in fact pay $1,400.00 to the Association but that was for the regular annual maintenance fee in 2024 and not the $1,500.00 transfer fee. ERG can only do what is instructed by its client, and the association is requiring the payment of the $1,500.00 to complete the transfer of **************** timeshare interest.Initial Complaint

My wife and I, co-owners of the timeshare, had initiated the cancellation process due to her cancer diagnosis. Sadly, she passed away before we could resolve the matter. As the sole owner of the timeshare, I am left grappling with her loss while also trying to navigate the complexities of this timeshare contract alone. Despite numerous attempts to contact Palmera Vacation Club, my pleas have fallen on deaf ears. Their lack of response amplified my frustration and helplessness during an already difficult time. It's as if my concerns are disappearing into a void, which only adds to my emotional strain. The financial burden of maintaining this timeshare alone is overwhelming, and the lack of guidance from Palmera Vacation Club is unacceptable. The complaint filed by **** ******, File No. *******, has nothing to do with Palmera Vacation Club and should be removed. *** ****** is not, and never has been, a Club Member of Palmera. He has had an Ownership with Coral Reef since 2011 and none of the issues, or concerns, mentioned in this filing have anything to do with Palmera Vacation Club.

Elite Resort Group, Inc. responds to the complaint as follows: The decision as to whether to accept the transfer of a timeshare interest is the decision of the Association that is charged with managing a particular resort, in this case Coral Reef Resort. If *** ****** would like the Association to consider the transfer of the timeshare interest he owns at the Resort, he should send a request via email to ********************. To Whom It May Concern: My complaint is towards Coral Resorts. I have been reaching out to the resort and the resort has blatantly ignored us. We once received a call and we were told to pay and become current in order to sell or transfer, as we have stated multiple times that is not an option for us. Furthermore, it was explained they would possibly offer us a settlement, now they are completely avoiding us. We notified them that we can no longer travel due to our health issues and age, only to not receive a single response. We are getting older. My husband has a short-term memory loss and my kidneys are not filtering right. To continue, on a maintenance fee for something we cannot use any more is unrealistic. We feel we paid more than enough money since the mortgage has since been paid in full. Why pay maintenance to keep up with their property when we will never use the timeshare again? We were taken advantage of during the presentation to begin with due to the immense amount of pressure. They continued to inform us this was a one-time offer and brought their supervisors to alter our judgement. The complete disregard to response or assist even when we had expressed our health issues is appalling. We demand a response from Coral Resorts along with our contract being amicably cancelled. “The only option available to the Complainants is to transfer their interest to the Association that is responsible for management of the Resort, however, the Association will only accept transfers of timeshare interests that are current in maintenance fees and the Complainants are currently $3,947.98 delinquent. The decision as to whether to accept a transfer of a timeshare interest is not a decision made by Elite Resort Group, but rather one that it is solely the decision of the Association, and they do not provide any explanation as to how or why they agree to accept or refuse a transfer. We purchased a contract with Coral Sands. Initially, we were completely misinformed on how we could use our timeshare in Hilton Head. We were told we could use the timeshare every year, but unfortunately, we’re only able to use it every three years which we were informed of later. We were also informed afterwards that it would take all of our points to use the timeshare every 3 years. This was told to me after signing the contract. During the actual sales pitch, it was pleasant and exciting because we thought we were getting so much more for the fee, but it has turned out to be the complete opposite. For months we have reached out to Hilton Head regarding our sole desire to cancel. We have expressed our hardships and that has been ignored. We were misled in order to sign a contract with Hilton Head. We are demanding the release of our timeshare and the documentation to be sent in order to mutually terminate our account. This has gone on long enough. Please send us the necessary documentation to end all obligations moving forward.Business Response

I am responding to the above-referenced complaint on request from ******* ******** who typically responds to these but is out of the country for the holiday.
We have reviewed the complaint filed. It is apparent from the fact of the contract signed by the Complainant that the use of the timeshare interest was every three years. Please see attached. The Coral Sands Owners Association, Inc. is the entity that is charged with the management of the project, and the entity that accepts the return of timeshare interests. This request was presented to the Association and they declined to accept the transfer. The Association has no legal obligation to accept any transfer, and so it well within its rights to refuse. It is not uncommon for the lifestyle circumstances of purchasers to change over time, and what was once a very useful vacation interest when purchased sometimes become less so . However, there is no obligation for the Association to accept the transfer under these circumstances.

We’ve had a timeshare with Coral Sands for 7 years now, and it is one of the most regrettable purchases of our lives. In January of 20015 we spoke with their salespeople and she they took advantage of us and our lack of knowledge about timeshares. They did not properly explain the details revolving around this timeshare. They hardly touched the important details, like the rescission period and how much taxes and fees would make this purchase. After reviewing the fine print, we realized not only were we misled, but blatantly lied to. This was supposed to be easy to access and, if we ever did not want to keep it any longer, easy to sell. It is neither of those things. This “great deal” is not a great burden that is incredibly difficult to get rid of. We’ve been contacting Coral Sands, but they claim it was too late and they could not assist us in any way. We know Coral Sands has the means to assist us, but they’re refusing to do so. They would rather beat respectable people out of their hard-earned money through manipulative tactics and its disgusting. ****** *** *, ******, are in our 80s and travel is very hard for us. This is just causing us more stress. We are now contacting higher authorities to assist us with this matter and will go through whatever avenues necessary to ensure Coral Sands rectifies the turmoil they are putting us through.
