Contracted with Black River Landscaping on some work on my property; work was scheduled to begin on April 8th, 2024. The work included some drainage and some fill sand for a wet back yard. He rarely showed up, rarely answered any calls or text messages. He came and dug some holes in the yard to pump some water out. He then brought a skid steer and dumped dirt along the fence line. The skid steer destroyed what yard was there as well as the side yard to get into the back yard. They got the skid steer stuck and had to wench it out; which they used my tree as a base. The tree is now all mangled. From that point, he came a few times and walked around and installed a pump. The pump stopped within a day, so I was forced to go out and buy my own and do the work myself. After that day he ignored all my texts and calls and never came back. I was able to get ahold of him on April 22nd and he promised he would be over to get the drains in place; he never showed or called. From that point he never came back. I requested we end the contract and he issue me a refund from the deposit I placed. I paid $2,475 for 3 - 22 tons of fill sand, Material Installation and drainage ditch construction. Only one 22-ton load was delivered and installed and there was no drainage ditch constructed. Based on this, we agreed via text that he would refund me $1,280. I paid through an app called square, he sent me a screen shot of the refund that was to go back to the card I payed with; the screenshot showed the amount, but the last 4 digits of the card it was being refunded to was not what I paid with, nor do I own. I asked him and he said that Square masks the number. I said ok, and he said if I dont have the refund in 7-9 business days that he will cancel and get me cash. On 4/10/24, he canceled the refund with square and said he is getting cash. We agreed he would provide me the cash on 5/14/24; he is now once again ignoring calls and texts and has not shown up.
