    I invest in real estate and do many closings. The Ashe Law Firm is unique in that they claim they cannot wire proceeds and instead can only FedEx a check or require actual pickup of a check at their offices with limited office hours. In this particular case I live out of state and had no choice but the Fedex option.

    The closing took place on Friday and was recorded with funds then available. I expected that a check would be cut and then FedExed with delivery on Monday.

    It seemed odd that Ashe Law Firm did not email with a Fedex tracking number on Friday. On Monday I waited for the check till noon and then called and emailed Ashe Law Firm requesting a FedEx tracking number. No response. Finally on Tuesday, I got a FedEx tracking number from a receptionist and not from my formal closing contacts of Reagan **** or Nikki ******

    Soon after I discovered that the FedEx shipment required a signature.
    I then discovered that FedEx had attempted delivery on Tuesday at noon even though I was present. FedEx policy is to make another delivery the next day of Wednesday. I was able to download a FeEx tracker and intercepted the delivery on Wednesday.

    My point in all this is that Ashe Law Firm appears set up to delay access to proceeds from a closing by failing to offer wire transfer, delaying FedEx of an actual check to Monday after a Friday closing, stalls revealing the FedEx tracking number, and places a signing requirement, not revealed to the client, on the FedEx shipment introducing probable further delay.

    I find the above practices very unusual and can lead to frequent delays in trust fund transfers. My one transaction is indicative and if repeated on a regular basis could indicate a serious problem at Ashe Law firm.
