Upon notification of the complaint the account history was reviewed against the allegations.  Previously the consumer filed a CFPB Complaint on 4/9/2025. *** had contacted the creditor, and they provided validation documentation for the balance placed at WFI.  This is attached to the response and was sent to the consumer on 3/28/2025. WFI confirmed the balance information placed by the creditor at the time,as well as specific information provided by the creditor to ensure the accuracy of any data furnished to the credit reporting agency is accurate as reported.  WFI effectively closed the account to the creditor on 4/10 as the consumer had requested no further contact.  *** submitted an electronic request to remove the previously reported in formation during its 4/15/2025 processing schedule.  WFI is no longer acting in the capacity as a data furnisher. Should the individual have additional questions, they are encouraged to reach out to Mr. ***** ******, who is Williams & Fudge, Inc.Ombudsman. Summary: Williams & Fudge is misreporting an old student loan as newly opened in 2025 Williams & Fudge is collecting on a ******************* that originated in 2010, but its being reported to credit bureaus as newly opened in January 2025, with no delinquency or payment history. This is false and has severely damaged my credit score.Their own servicing portal confirms the loan was last serviced in *********************************** 2020, with no payments since. The tradeline appeared just as I was moving into a new apartment and rebuilding my credit suggesting the timing was not accidental.I spoke with Equifax, and their representative stated she could not access the loans open date or history, which she said was highly unusual. This confirms the account is being reported with incomplete and unverifiable data, likely violating the Fair Credit Reporting Act (FCRA).On **********, the tradeline falsely shows Last Activity: 12/2023, even though there has been no payment activity or servicing on this loan since at least 2017. This appears to reflect a reporting update or reactivation, not consumer activity and further misleads credit scoring systems into treating this as recent debt.I emailed Williams & Fudge with documentation and requested correction or deletion. Theyve failed to ****** requesting immediate correction or removal of the tradeline and written confirmation of the loans actual disbursement, delinquency, and collection history. If not resolved promptly, Ill escalate to the ***** FTC, and my state attorney general. This feels like a deliberate attempt to pressure payment by reporting outdated debt in a way that maximizes score damage. Consumers deserve better. Reporting data this waywithout context, history, or accuracyis reckless and predatory. I expect action, not silence.

Upon notification of the complaint the account history was reviewed against the allegations.    The creditor recalled the account from *** and the account was closed on 9/11/2021. WFI did not act in the capacity as a data furnisher for the creditor and did not report any tradeline information to the consumers credit report.  The consumer should reach out to the original creditor regarding their balance, and any other federal loans owed by the consumer, as *** is no longer an agency of record. Should the individual have any additional questions, they are encouraged to reach out to *** ***** ******,who is Williams & Fudge, **** Ombudsman. He is available and may be reached by email *******************

    Customer Answer

    Date: 04/11/2025

I am rejecting this response because:
New Evidence of Manipulation (with Screenshots)
On my April 5, 2025, MyFICO 3B report, the Equifax tradeline for ************************** included a visible 2-year payment history grid, clearly showing NR (Not Reported) across all months.
By April 9, 2025, this payment history grid disappeared entirely from my Equifax report, despite no formal resolution or explanation from the creditor or Equifax.
I am attaching screenshots below to demonstrate:
[April 5 Screenshots Visible Payment History]
[April 9 Screenshots Payment History Missing]
This unexplained change suggests post-complaint data manipulation, which further contradicts Williams & Fudges claim that they never furnished data to Equifax. If they didnt, who did and why was the data altered?
This raises serious concerns about the accuracy and integrity of my Equifax file and supports my request for a full investigation and removal of this tradeline.

    Business Response

    Date: 04/11/2025

The transactions listed in the correspondence provided by the consumer are remarks made by the **************************, not WFI.  WFI contends that there were no actiosn taken that woudl have made any remarks towards the consumer's tradeline on any credit report, as *** did not act in the capacity as a data furnisher on behalf of the university/creditor.  THe consumer should redirect their concerns about credit reporting to the entity that is actually evidenced as making updates and/or tradeline reporting to the consumer's credit report.  WFI is not that entity.  It is clearly the **************************, not ***.

    Customer Answer

    Date: 04/11/2025

Williams & Fudge continues to deny responsibility for the tradeline that damaged my credit, stating it was the ************************** and not them. I want to be very clear:
I paid off all federal loans in full in March 2025, with a final payment of $10,575.40, confirmed by Aidvantage, the official federal loan servicer. (See attached payment confirmations.)
I received two separate confirmation emails from Aidvantage on April 6, 2025, congratulating me for paying off all of my Aidvantage loans.
After this, I had no open balances or delinquent student loan debt. I also called Aidvantage directly, and they confirmed that they did not report any new collection tradeline to ******* and had no outstanding balance or reason to do so.
I also called Aidvantage directly, and they confirmed that they did not furnish any new collection tradeline to Equifax.
When I submitted a complaint to the **** and BBB, the ************ visibly changed within 48 hours, and the payment history disappeared from view. This timing is not a coincidence.
Williams & Fudge had previously handled this same debt on behalf of ************************. They are now distancing themselves from any connection, but I find this troubling especially given the exact timing of when this tradeline appeared, changed, and ultimately damaged my credit profile.
If W&F believes the Department of Education is responsible, I ask them to clearly identify which servicer or department is furnishing this data, rather than deflecting. As someone who has already satisfied their loan obligations, I should not have to play detective just to have my credit accurately reflect the truth. Additionally, I checked my account on ******************** & Fudges website, and my login still works. It still displays a balance associated with the debt they claim they no longer service. If they are not the agency of record, this inconsistency further confuses the matter and calls their response into question.

    Business Response

*** did nto repaort any information to the consumer's tradelien during the time it was handlign the account on behalf of the credfitor, *************************  The account was recalled by the crefitor on 9/11/2021.  WFI ceased working the account that day. If any actions were taken by the creditor to place the ******* at another agency, such as the ********************, that action was not influenced by WFI.  WFI does not have an active account for the consumer.  WFI would reccomend the consumer contacting the ******************** regarding the tradeline reporting, as it is clear that the entity reporting to the consumer's report is the US **** of Education and not WFI.  This is evidenced in the consumer's documentation that was supplied in this copmplaint, and 2 other **** complaints that were filed and responded to in a very similar response.  *** considers this complaint closed, and would consider continued rejectiosn to their responses by the consumer as harrassment.

I am rejecting this response because:
I am disputing and rejecting your claim on the following grounds: The alleged balance does not constitute a loan or any form of credit extended to me, and I have not entered into a contractual or verbal agreement with Williams & Fudge **** or the original creditor that would establish such an obligation. Absent evidence of a legally enforceable debt tied to a credit transaction, I do not recognize this claim as valid. Furthermore, if this alleged debt has been reported to any credit bureau without prior notification to me or proper verification of its accuracy, such action may constitute a violation of the Fair Credit Reporting Act. I demand immediate proof of any such reporting and its basis, and I reserve the right to challenge its inclusion on my credit file.
