In September 2023, I filed a report with the **** stating that I had no knowledge of an account with ************************. The account was later transferred to Williams and Fudge. Despite disputing the collection with Equifax multiple times, I was informed that the account was verified. I requested proof and documentation from both Williams and Fudge and Equifax, but neither provided it. After numerous phone calls with Equifax this week, a representative told me that the collection for account 1014 with ******************** and Fudge was not showing up. I downloaded a copy of my report from a website listed on Equifaxs site, and account 1014 was not there. However, it still appears when companies pull my report. I reached out to both parties again but received zero assistance. The Fair Credit Reporting Act (FCRA) , 15 U.S.C. 1681 Is a law that was set to ensure that accuracy and fairness was set in place. How is it that the 2 Equifax representatives told me that the accounts were removed, the report reflects what it says but the charge is still damaging my score? How is it fair for both parties to continue to penalize me for a charge they do not have documented correctly and is not mine? The information is supposed to be the same across ALL board or by law it must be deleted. Moreover, this is not my account in the past 3 years I have ONLY attended *****************************. Upon notification of the complaint the account history was reviewed against the allegations. WFI has recorded the consumers claim of Identity Fraud and closed the account internally as of 7/17/2024. WFI shall remove any previously reported information from credit report during the next processing period. WFI shall notify the creditor of the claim. WILLIAMS AND FUDGE continues to try to extort monies from me when no monies are due. They're attempting to collect on an alleged debt. I HAVE NO KNOWLEDGE of the account or any purchases on the account. I have reported this to the appropriate authorities, & the **** as fraudulent and Identity Theft. I have never done business with them and not sure how they even got my personal information. I contacted ************ Williams, CEO, by way of Affidavit sent Certified Mail Return Receipt Requested with an Affidavit of Mailing. They've obtained my information by way of Identity Theft, Official Codes of Georgia Annotated 16-9-121. Pursuant of an alleged debt by furnishing nonpublic information without my consent to unauthorized third parties as a means to ruin my financial reputation, is a violation of 18 USC 894. I've requested verification, in the manner of an Affidavit, whereby one has first hand knowledge of the alleged transactions, signing of signature, obligations and also swears to the truth under penalty of perjury that I indeed owe them money. They've failed to rebut the Affidavit point for point. No such documentation exists from Williams and Fudge. I hired *******************************, Witness, Notary **************** of the State of Georgia, who is not in receipt of any Sworn nor Commercial Affidavit that would substantiate any of their claims. In accordance with law, ONLY sworn affidavits, oaths, and depositions qualify as a verification of the lawful existence of a debt. For their convenience, an Affidavit has been included so that an agent authorized to accept full commercial liability & with the power to bind their organization, i.e. ************ Williams, CEO, may sign and return said Affidavit to the Notary Public mentioned herein to demonstrate an act of good faith. Verification is defined (Blacks Law Dict. 6th **** as Confirmation of correctness, truth, or authenticity, by affidavit, oath, or deposition. Upon notification of the complaint the account history was reviewed against the allegations. Per the consumers request for no further contact, WFI updated all communication channels to no longer be used to attempt to communicate with the consumer. WFI did not receive the information provided in this complaint until 7/10/2024 via postal mail. The account has been returned to the creditor as of 7/11/2024. WFI shall remove the previously reported information on the consumers tradeline report. 6/18/2024 Representatives called my phone, left a voicemail with a reference number. I called said number, they were not looking for me but supposedly one of my relatives. After asking what kind of business or agency this company was, I was told that they could not disclose this kind of information without the permission of the family member because it was personal. I further stated I did not ask or wish to know my possible family members issues, only what kind of business they were seeing as they were asking personal questions and contact information regarding my supposed family member. Further inquiries of type of company they were, met with continued refusal to disclose. I stated with them calling me, having my number, leaving a message with a reference number, then inquiring about family members, I have a right to ask the nature of the company considering the plethora of data breaches and stolen identities that have happened recently. Still I met with pushback and refusal. I do not care about what my "family" member may have done. I asked a simple question regarding their type of business and was met with full refusal. I had to utilize online resources to figure out what the company was.Business response

I am rejecting this response because:Staff did not properly address or provide adequate details/information of appropriate identification of their occupation while seeking personal information regarding a family member. Stating " I work for ******* & Fudge **** And we work with colleges" is not an acceptable answer in response to what is your occupation and nature of your business.
A more appropriate response may be,
" We are a financial institution that aids those with loans or financial obligations with colleges or businesses. Due to privacy laws, I cannot go into more detail but I am seeking X and have had difficulty in getting in contact with them. Would you happen to be able to provide us with some assistance in contacting X?"

Due to company policy, *** employees may only advise on calls made to their office by unauthorized third parties, when asked what our company does, that they work with colleges and universities. Additionally, when speaking to an unauthorized third party, *** employees may only seek to obtain or confirm location information, specifically a good phone number, a good address, or a good place of employment phone number. The individual that has rejected the complaint may contact ***********************, the *** Ombudsman for any further information by calling ************ or via email at ******************. *** has updated the previously dialed phone number to no longer be dialed and shall consider the complaint as closed and responded to with an appropriate and accurate response.Customer response

I am rejecting this response because:I do not consider the matter closed nor do i accept the response sent by W&F adequate.
Review my prior response. I am seeking to alter how communications with 3rd parties are performed. The response I provided was accurate, legitimate, and does violate privacy laws. When attempting to obtain information regarding another individual, it not only is courteous, but also professional to give an adequate explaintive response related to being ask the companies job description. This company has contacted multiple family members stating I owe them a debt after doing some research this is a company for student loans I have NEVER taken out a student loan I have checked my credit report and I have also checked student aide.gov and they show no record of any loan ever being taken outBusiness response

Previously made complaint about this company in 2021 after they reported debt for a service I did not receive. This company has now found my email without consent and continued to try to solicit this debt for services that were not provided. I do not want any further contact by this company nor any further attempts to collect this debt as I have never received billing from the supposed company that they are collecting on behalf of.Business response

I am rejecting this response because:
I have not received any information and do not consent to continued solicitation from this company. I would like this company to cease any and all contact with me as previously agreed in 2021, I have NEVER received billing from the university in question additionally original creditor has never sent verification of debt. I would not feel comfortable taking this verification from 3rd party sources. This agency has used illegal collection practices against me periodically since 2021 including spoofing numbers to look local, multiple calls a day, calling outside of business hours, and soliciting my email without consent most recently. This is illegal practices under collection law and are considered harassment.
