      We bought a car in February of this year. Within a week of buying(not even finish paying the down payment) the engine light comes on . They tell us their mechanic looked at it and said its just the sensors and they will fix whats is wrong with the car. They had it for a whole week and half. Then says they cant fix it because of part shortages that both major was wrong with it. So they give us a powertrain warranty and when we take it to our mechanic they say its the motor and a lot of other issues that the warranty would not cover it. And within that First week we asked for our money back and they laughed at us saying both we can do to get our money back.

      To begin with we let them get the car on Thursday, February 17,2023 even though the bank had not finalized the funding of the vehicle. On 2/17/23 they gave us $1,500.00 partial down payment. We did a Bailment agreement with them (attached), if we were unable to get them financed, they would return the vehicle.  As, it happened it took all the next week to get them done.  They paid installments on the downpayment as follows: 2/18/23 $800.00, 2/20/23 $800.00 and 2/22/23 $540.00 for a total of $3,700.00 for the downpayment.  The deal got funded on 2/24/23 a hole week from the time they took possession of the vehicle. To get the deal funded we had to cut the price on the vehicle ($1,480.00) because they only qualified for so much financing. All that being said, they signed an AS IS WARRANTY after they had the vehicle 7 days.

      ******************* did something online that caused the vehicle to only go up to, but not over 60 miles per hour.  To fix this, it required a 2nd key. This vehicle came with one key, we had one cut and programed for them at no cost.

      We had made arrangements to have the vehicle looked at.  Around 3/9/23 they dropped the vehicle off to be looked at.  Our mechanic was unable to repair the vehicle because parts are on backorder with an undetermined availability time.  At this time, we offered to trade them out of the vehicle this was on 3/17/23.  Trying to work this trade.  ************* would be too high on the other vehicle, because of misinformation given to the insurance company by ******************* at the time the original vehicle was insured. Because of this problem, they did not want to trade, we put a 12 mouth/12000-mile powertrain warrant (attached) and signed by ****************** on the vehicle at no cost to them. They left with the vehicle. This was the last communication we had with them. At no time was anybody laughing as stated in the complaint.

      I am rejecting this response because: also, we knew nothing about the cutting deals because it wasnt communicated to us . So that should be irrelevant. We paid almost **** down because they almost accepted cash which wasnt brought on our attention until after signing papers.

      In my previous response to this complaint, I attached all the documentation and a complete account of what transpired with this customer.  They were completely aware of what was transpiring through the whole process.  They were told by the bank and us, the reason they were having trouble getting financed. They made the decisions to keep the car instead of trading it out, when they had the chance.  We gave them a warranty, something we did not have to do, because they signed an AS IS AGREEMENT, seven days after having possession of the vehicle. We did try to work with them.  They made the decision.

      As to the forms of payment, we except credit cards, cashier's checks and cash.  The problem was not with our credit card machine, it was with their card. Credit cards have daily limits on them, they even left our business and went to ******* to get the money and were not able too.

      As with any automobile purchase, when you sign an as is agreement at the time of purchasing a used automobile the seller is not required or obligated to perform any repairs or provide a warranty at no additional costs to the buyer. Our business did these deeds out of our own pocket even though it is not a requirement. 

      Regardless of how many times one disputes something it does not change the facts of the situation plainly provided in the documentations that have been previously attached.

      I am rejecting this response because:
      We were not aware of the last communication with thuroughbred and the bank . They took it upon themselves to do that . If we were in the know of the price drop then we wouldnt have continued the process. Plus this has absolutely nothing to do the the complaints. Probably why thurobred is bringing it up. My my lawyer has advised not to say anything else until they serve them. And I am aware that if we win they also have to pay our court fees. Thank you. Clearly and *** found a few others that have been ripped off by them that will help the case. Similar situations as well. They knew the whole motor needed to be replaced because their mechanic looked at it . How is that for transparency. I have my documents and proof.

      You signed the paperwork; you had the car 7 days before you signed the paperwork. You were offered to trade it. You made the decisions, to keep the vehicle. I have nothing else to add.
