    The pool is supposed to have a 5 year warranty. After 2 years there is a pump that had to be replaced. Of course the people that service the pool call and explain the situation. No call or return call. I paid for a new pool and they installed parts close to a year old. I know that they have several compliants but I should have this resolved!

    We do not have a customer by the name of **** *****.  Given the address, I'm assuming this customer is actually **** ********.  **. ******** failed to make the final payment on his contract, and the contract plainly states as follows:  Contractor warrants his work to be free from defects in material and workmanship for a period of 3 years from date pool is filled.  If last payment is not made by homeowner, all warranties are void and contractor is not responsible if the homeowner hasn't complied in full of the terms and payments and other conditions of this contract.  This contract was signed by **. ********, so he was aware that he had forfeited his warranties on the pool and equipment when he made the decision not to make the final payment.  **. ********' pool equipment comes with a 3-year manufacturer's warranty.  Had he made the effort to contact *******, they would have repaired or replaced it under their warranty.  As for Aqua Pool Care, per our contract, we will not warranty or service anything on his pool until final payment is made.  It is our understanding that his house has been sold, and his warranty is non-transferable.  In summary, **. ******** is trying to collect on equipment that no longer belongs to him.
