I didn't file this complain earlier afraid they wouldn't refund me. They haven't refunded me anyways. We signed a contract on May7 of 2022 to build two room in my house in August5. They started on August the 24 doing some digging. Overall, from May to Nov of 2022 all they did was to lay some concrete foundation. They never call us to explain the delay. We have to call them. They always got mad at us when we called or texted ABS, very rude. This got so complicated that we had to file a complaint with the police, they did nothing, and now we are looking to get some justice with a lawyer's advice. We gave them (ABS) a total of $21,000 and Dereck (their representative, owner, I don’t know at this point what he is), just said that's nothing. That they do contracts of $200,000+. To which I reply if it’s nothing, you could easily give us back our money. They never did. They put our contract with the city to ask for permits, under other contractor company's name. We never signed up or knew the other company. Dereck said to me and my husband he was the owner. After all this matter, he suddenly is not the owner. I just hope this company finds a stopper. They didn’t care even for the safety of my 3 kids. They left that whole open, for 5 months, I have to cover it myself to prevent accidents. And they just said that it is not on them that my kids play in their own house in a construction site. 5 months is not unreasonable to them.

We signed a contract to complete work for these individuals. We started the work and immediately found a septic tank buried in the yard which required us to contact DHEC to find out how to dispose of it. Work could not resume as we waited on DHEC. While waiting on DHEC, there was some interior work that needed to be done in order to continue with the addition. This was a separate contract. We completed the inside work. When DHEC told us how to dispose of the tank (not on our original contract), we took the necessary steps to take care of the tank. We did not charge the customer to do this.  We also poured the foundation. At this point, the individuals fired us and told us they didn't want us to work anymore. They demanded all their money back which they are not entitled to based on the fact that we have completed work. We immediately contacted our business attorney, who reached out to the individuals and met with them on at least 2 occasions, with them calling a bunch more times, billing us in the meantime. Our attorney made a settlement agreement with the individuals to which they refused. They said they wanted to get their own attorney. We pulled the necessary permits and are in compliance with local laws. Derrick was a salesperson who worked for Action Building Services and is not an owner nor does he even work for Action Building Services any longer. He sold the job. Nothing more. As we are represented by an attorney, the individuals are more than welcome to reach out to the attorney to make another settlement agreement. We do not owe them the full amount of money and again, we have agreed to a settlement amount to which they refused.

On Dec. 6th, I called ***** Dumpster Rentals in Spartanburg SC to inquire about booking a dumpster for a week beginning Dec. 27th 2022. (Apparently, ***** Dumpster and Action Building Services are the same business as their outgoing voicemail message denotes both & when I was invoiced for the $395, the letterhead reads: Action Building Service- see attached documentation) The man I spoke with said I could get a dumpster for a week beginning on Dec. 27th. He then emailed me an invoice and followed up with a text asking for my name and the address where the dumpster should be taken. (See attached documentation) The payment was processed on Dec 7th through my credit card (see screenshot/documentation). Yesterday, there was no dumpster delivered and no answer to my 3 voicemails and two texts. I also emailed them last night to request a full refund, and have heard nothing in response. This was a massive inconvenience as I had multiple people scheduled to help with the clean-out and they had to be compensated for their time even though we had no place to put all the debris and trash. I would like a full refund of the $395 immediately as well as $300 for compensation & gas money I spent driving back and forth to the landfill over 6 hours - which would have been unnecessary if the dumpster had been delivered.

    Service or Repair Issues

On October 28, 2022 Action Building Services sent a repairman to my grandmother's house to repair some holes in the moisture barrier of her home, which I reside in. They charged $1400 for what I later found out was a $300 job, and the repair completely failed. On November 16, an HVAC specialist needed access to the crawlspace, and when I opened it and let him in, we saw that the repair had failed, and he took the attached pictures for me. I called a plumber the next day to come by to make sure it didn't fail because of a leak or anything that may have been overlooked. The plumber assured me after seeing under the house that there was no leak or anything, that it just wasn't done properly, then told me how much a repair like the one ABS did actually costs. On November 23, I called Derrick and told him the repair failed and he needed to come fix it. He said he would come on November 28, but couldn't tell me a time. That day came and went, and on Monday November 30 I called him again. He said it had slipped his mind and he could come on December 5, and that's where the texting starts. (See attached screenshots) He insists that I call him after 5 the next day. I had my boyfriend call him because I was so angry and frustrated that I thought I might say things I would regret, and all we really wanted at that point was my grandmother's money back. So my boyfriend, Tyler, gets Derrick to agree to giving us $1100 as long as I sign a waver saying I won't report him to the BBB or sue him. He says he will come by, but he never does. Tyler calls him every day, and when he finally answered, he pushed the meeting date again. Now he just ignores our call. I can't even contact ABS through their business number. I also believe Derrick is running an unlicensed business called Elite Demo and Dumpster service, because it's not in the SC registry. Honestly we just want the money back, though. We have to be able to pay someone else to do the job, it's still not fixed. I'd rather not sue.

First and foremost, no one can dictate what we charge. We looked at a job, we estimated the cost, we told the homeowner, and she agreed.
We came out and completed the work. It was done correctly. She was satisfied.
Weeks later, she claimed this had failed. We looked at the pictures and could obviously tell someone pulled it down. We told her that. Now listening to her entire complaint, it's obvious that she was given information by someone that the job "should " have cost less and she wanted her money back, so she had someone pull the insulation down to look as though we did bad work. We have tried to reasonably work with this women including telling her we would come back and fix it and all she wants is her money back which is unreasonable to not even allow us to fix what was obviously pulled down.
Also, even though it has no bearing on this or Action Building Services, Elite dumpsters and demo is a DBA
