We, acting as legal representatives for the Cargo and Freight company (hereinafter referred to as "the Client"), hereby submit a complaint regarding the actions of a broker (hereinafter referred to as "the Broker") engaged by the Client. The Broker, in turn, engaged subcontractors for transportation services. Regrettably, two containers, identified as follows: ****** (container number: ***********; total value: $160,753.20; police report filed at ********* Police Department under case number ********* lost on or around September 28, 2023) and ****** (container number: ***********; total container value: $111,300.20; incident reported under case number ********; lost on or around October 10, 2023), were reported stolen or missing during transit. The financial losses incurred extend beyond the value of the containers to include additional air and ocean freight costs attributable to these incidents. Regarding the first container, direct communication with the subcontractor has been established as the Broker furnished their contact details. However, concerning the second container, the Broker has asserted that the subcontractor in question is a fraudulent entity. Notwithstanding, per the terms outlined in the agreement between the Client and the Broker, it is the Broker's responsibility to address any losses incurred by the Client. Despite repeated attempts, including formal demand letters, the Broker has failed to respond or provide a satisfactory resolution.
