    On October 24, 2024, I signed a sale agreement with Art & Speed to purchase a 1996 ******** for $20,000. I submitted a wire to Art & Speed on October 28, 2024 for $20,000. On November 20, 2024, I took delivery of the car. The owner of Art & Speed, ***** *******, told me that he would send the title separately and to allow him 30 days. It has now been over 60 days and I have not received any title from ***** ******* or anyone else at Art & Speed. I have tried to call and text Mr. ******* on several occasions: December 12, 2024, January 10, 2024, January 24, 2024 and January 27, 2024. Neither Mr. ******* nor anyone at his business will answer the phone or return my calls. I would like to please receive the title to the 1996 Corvette that I purchased three months ago.

    The buyers concerns were addressed and the title has been provided to him in early February.  The delay in title delivery was a result of additional repairs and upgrades requested by the buyer before the vehicle was ready to transport.  We require buyer acceptance of the comleted vehicle before title is transferred.  In addition, this car was a consignment sale and required in-person exchange of the signed title, with the consignor who lives approximately 200 miles from our location.

    I purchased a **** Stingray on 01/27/2023. I paid cash full price plus TN state sales tax. At the time of closing I was given a Bill of Sale and told I would have the Title within 30 days. After I bought the car there were a few repairs and improvements that I spent roughly $7000 on that were done by Art and Speed. I did these having been told that I will have a title for the car soon. The story was that the owner has left the country and it will take some time to get it. Over the last 11 months I have driven up to the Art and Speed offices well over a dozen times, every day some weeks, asking for the title to this car. Each time it was the same story until recently I was told that the owners brother now had the title and was going to deliver it to Art and Speed in a matter of days. This story went on for 3 months until 12/07/23 when I was told the brother has been contacted and I was told by ***** the shop owner that it will be in my hand within 2 days. Today was 2 days and I went to pick up the title and now the story has been changed to the brother has told art and speed that he doesn't want to get involved and has not delivered my title. I was told today in person that the title is now at an attorneys office in town. Over the last *************************************************************** the world and pick up the title to my car but was always assured that its coming. I have been way more than patient with them and thats run out. I think that I have been scammed and sold a car that *** have not actually have been for sale by the owner or doesn't have a legitimate title to begin with. I was promised on date of signing that Art and Speed has a copy of the title in their files but I've never seen it. Have I been driving around in a possible stolen car? Did the owner actually want to sell this car and if so has he been paid without providing me with a title. I have an appointment with an attorney on 12/19 to see how to proceed with possibly being scammed.

    ***************** is indeed frustrated with the timing of title delivery on this car.  The car was consigned via written contract, and a copy of the title was provided to our company.  Unfortunately, the consignor moved out of the country prior to the actual sale and changed his contact information.  Multiple attempts finally resulted in contact with the consignor who said that the actual title was in the hands of his brother who would handle the transfer upon sale.  Unfortunately, something happened between the brothers and the original plan of transfer could not be completed.  Art & Speed engaged our attorney to pursue the title transfer from the seller and ultimately got the title in our hands.  The title has now been executed and provided to the buyer.  The timing and background of this situation is confusing and frustrating at best, with not explanation provided by the seller.  Regardless, the title has now been delivered to the buyer and this issue should be closed.

    I have reviewed the response made by the business in reference to complaint ID ********, and I accept their proposed resolution.
    The problem was with a difficult seller and NOT the fault of Art and Speed. I had a face to face chat with the owner of Art and Speed today and he explained to me what happened. None of this was in their control. I now have a title and tags on the **** Stingray that I bought on consignment. This business does fantastic work and I look forward to many years of doing business with Art and Speed. I dropped my Stingray off with them this morning to have some routine maintenance done. Since *** purchased this car they have replaced the entire fuel system, their mechanic rebuilt the carburetor, and they have fixed all minor issues at my request and the car runs like a dream. Having a business like Art and Speed in town allows guys like me to own classic cars.

    **** - Triumph TR3 - Car running a little rough and taken to ART and Speed early 7/22 for carb clean/rebuild, check fuel for debris, check brakes. Told, while mechanic used an impact, he broke wheel stud. 7/15/22 Told car still running rough after carb clean, new spark plugs, air filters replaced (Original air filters still on vehicle). Told the starter was a little sluggish and needs replacing.9/19/22 Paid Invoice of $2,562.83. Told starter had been replaced but they had found additional issues. Tach head stripped, Rear view mirror stripped, steering stiff and steering parts needed to be greased, Suspension bushings need replacing. I gave the ok to fix suspension bushings and to grease steering. Told it would take a few weeks. I called Art and Speed several times over the next several weeks and was told someone would call me back with information. No return calls until end of 10/22. 11/4/22 Told I had to pay the invoice prior to car being shipped (needed to be shipped because I had to move for work and the repairs took far longer than I was told it would). Invoice for $2492.49 was paid. Car was shipped using a carrier they recommended, Was assured if there was any question with the carrier they would not allow them to take it. 11/10/22 Art and Speed had shipped the wrong vehicle. 11/13/22 Car delivered. Car would not start. Carrier did major cosmetic damage. Called Art and Speed no response for 3 weeks.11/19/22 Approx. a quart of oil found under car.11/21/22 Stop payment on last Amex payment of $2492.49.11/23/22 ****************** (Owner) called stating the car ran fine prior to shipment but could not provide proof, also stated he didn't trust carrier driver with my car but let him take it anyway. Offered to have a mechanic trouble shoot. Scheduled facetime for 11/28.11/28 No one called.12/5 Reschedule facetime to 12/10 12/10 Per Mechanic - Starter is no good, unknown why oil is leaking. 12/20/22 have not heard back from Art and Speed, car still not running

    Response:

    The scope of work authorized is correct:  get the car running well, and check the brakes.  The reason the wheel stud was broken was because the front wheel had been rusted and could not be removed via any other means than impact wrench.  The stud was broken because it was frozen via rust, not through lack of care of ************.  Once the compromised stud was removed, it was replaced with new and SAFE components.

    After exploring the cause of the steering stiffness, it was determined that the frame header housing the steering box had multiple cracks and had to be welded together in order to operate safely. This resolved most of the steering difficulty.  

    During this time, the owner was requested to come by and hear the car run to determine if the repairs were made to his satisfaction.  Although the customer was on site multiple times, he did not make time to verify the completion of all repairs prior to his chosen shipment date.  There are NUMEROUS defects in this car, but only the items above were approved for repair, with the remaining items to be addressed at a later date by the customer.

    The carrier was chosen and contracted by the customer and was NOT recommended by Art & Speed.  Our company simply recommended a transportation BROKER with whom he could find and hire a CARRIER OF HIS CHOICE.  My mechanic personally drove the car from our shop to meet the carrier and parked the car directly behind the trailer for loading.  The car ran fine with no problems when it was handed over to our customers chosen third party carrier.  We have no way of knowing how the car was treated once it was handed over to the carrier.  In addition, it is our understanding that the customer made no attempt to hold the carrier liable for the "cosmetic damage", nor for the fact that the car did not run once he received it.  Art & Speed is not responsible beyond the original handover to the carrier.

    However, out of good will, we held a video conference with the customer on 12/10 to see if we could identify anything that would indicate why he cannot get the car started.  We did notice several disconnected wires which had not been in that condition when the car was released.  Clearly, someone other than Art & Speed had been fumbling under the hood.  In addition, working with the customer, we determined the newly installed starter was not working properly (this could have been related to the disconnected and misplaced wiring we noted in the video).  We ordered a new starter (informed customer on 12/20) and had it delivered to him directly so that he could find a shop in **** that would be able to install it for him.  That was several weeks ago and we have heard no feedback from the customer or any service provider.  However, the customer has chosen to stop payment on his credit card for approximately $2500.  At this point (Feb 6, 22), the customer has moved out of state, refused to pay for the services requested and completed, and taken the $2500 from us, along with the new starter.

    The customer's refusal to provide his own oversight to the transportation of his vehicle does NOT ***** him permission to take money from our company, then leave the state with perceived impunity.  We have committed to him to help resolve his concerns, but he appears to be happy to just take the money and run.

    I am rejecting this response because:

    There is some truth to Art and Speeds response, unfortunately the response blurs the lines between truth and reality. I am not going to go back and forth with he said she said. The Triumph is in a shop being looked over at this time and has been in that shop for approximately 6 weeks. Finding a shop to take the car in and go through was painstaking but I found a shop that is working on reviewing why the car would not start or run. I travel 100% for work so it is difficult to get a chance to get into the ************* with the mechanics, but I did get in this week on 2.14.2023.

    Here is what I currently have hear from the new shop:

    1. The starter that is in the car NOW works perfectly. The car starts strong without any problems. The reason it did not start previously was that the wires connecting into the starter were not done correctly and fell off the starter (probably during transport), This was not seen during the video call Art and Speed had with me and thats why a new starter was shipped.

    2. The car will not drive. The mechanic believes there is something wrong with the carburetors (which is something Art and Speed said they took care of) ** of 2.14.2023 the mechanic here in **** stated he will go through the carburetors in an attempt to find the problem.

    3. The Triumph is leaking quite a bit of oil. ** of the last time I spoke with Art and Speed they had told me they had topped off all the fluids prior to shipment. If this was done incorrectly there is a very large chance that they over filled the oil and caused damage when they said they started it. The mechanic I am currently working with is attempting to diagnose.

    I apologize that I had not reached back out to Art and Speed as soon as I heard something on 02.14.2023 but I am just trying to get all the information together. I am just as frustrated with this situation as they are, they had the car for several months and as they told me while they had it "it takes time to work on these cars". I apologize that the time frame cannot fit into what they want, but I have no control over how long it will take to diagnose and fix.

    ** I had told Art and Speed when we spoke last on the phone, once I get all the information from the current mechanic working on the vehicle, I will forward all the invoices to them to review and then we can talk and determine what is a fair price for the work they had completed.

    I should have taken the new starter they had shipped to me while I was at the current shop and shipped it back to them on 2.14.2023 but I just forgot to ask for it.

    I understand that Art and Speed is now saying that there are many things wrong with the car that need to be fixed, in no way am I trying to hold them responsible for any additional repairs. 

    The two main issues that they worked on (the starter and the carburetors) appears to have been done improperly. The leaking oil may be something completely unrelated to how the car had its fluids topped off, unfortunately as I have stated to them several times, I am not a mechanic and even with a video call I am not going to be able to diagnose or fix any problems. 

    I will be reaching out to Art and Speed once a diagnosis is reached to work with them on a fair payment, they just need to be patient just as they told me when they had the car. I am not trying to pull a fast one or leave Art and Speed holding the bag on repairs that they did, but I will also not pay for work that was either not completed or completed incorrectly.

    It really is a shame that their work and communication cannot be as understood, or beautiful and well put together like their showroom.

    Hired Art & Speed to do an inspection of a **** Mustang. The owner ************************* was my initial ******** *** was impressed with his seemingly knowledge of classic cars. We agreed to have the car brought to his shop to be inspected for specific items I was concerned with. After the car was brought to Art & Speed, & was already gone, ***** called & told me he could not tell if the car had been repainted, if it had any rust repair done, & if the motor was original to the car, which were some of my questions. He stated he did not look under the car, In fact it was never removed from the trailer, so he didnt even drive the car. He stated that he felt the car was so good though, that if I didnt buy the car, he was going to. Based on this, I bought the car, feeling that if this expert couldnt tell if the car was repainted or had any bodywork done to fix rust, that the car must be pretty good. I then hired ***** to do some work on the ******** agreed to pricing. After a couple of weeks, I called to see what progress had been made and got his wife *******, they had not done anything yet., but they got the items done because I arranged to have the car picked up by my shipper. I asked repeatedly to have the wheels they removed and a brand new convertible top that came with the car placed in the car prior to shipment. This was not done even though I had both **************** cell phone numbers, & repeatedly sent texts requesting that to be done prior to the car being picked up. I have made repeated calls and texts with them, and have received numerous promises of by ******* that the parts are being shipped by Art & Speed and yet a month after I received my car I still do not have my 4 wheels & convertible top, & it took my wife, NO expert, about 30 seconds to spot that the car was repainted. It took me, by opening the trunk & looking, 60 seconds to spot the rust repairs. I paid $325 for an expert that couldnt spot a repaint or repair? Please send parts and refund $325.

As you know I was having trouble getting though to them at Art & Speed, and I now realize they were having phone and internet issues that were causing the lack of communication from them. ***************************** reached out to me almost immediately, and provided the tracking information for the items they needed to have shipped to me. Then ************************* reached out to me, and we had a very nice discussion, (as we had several times before). ****** understood my concerns and he quickly resolved them to my complete satisfaction. 

    In closing I would highly recommend the Caffmans, and Art & Speed Classic Car gallery.
