    Business Response

    Date: 06/13/2022

Business Response /* (1000, 5, 2022/05/10) */ To whom it may concern: LA Construction and Drilling LLC installed conduit in the state right-of-way ***** ******** Foreman for LA Construction, notified all required agencies, including ** ****** *** Department, prior to staring work. The claim states that LA Construction and Drilling's truck ran over and broke a water line, at the water meter. **** ********, the lady who filed the claim against us, obtained LA's contact information from the La ****** Water Department, however, our company was never contacted before any claims were filed. Ms. ******** also hired a private contractor to install a new 3/4 " plex line from the meter to a building structure with a new pressure reducing valve inside, and a main shut-off valve installed at the plastic box, by the building structure. We would like to note that if the allegations against LA Construction were founded, we would have been happy to pay for the repairs, however, we would have only been responsible for damage at either end of the water line, closest to the meter. By not contacting LA directly and hiring a private contractor on her own, Ms. ******** spent much more money and had several excessive repairs done. We are still investigating but at this time LA Construction doesn't feel they are responsible for the new line, pressure valve, shut off valve and box by the building away from the area they executed work. We have requested all documents from ** ****** Co. Public Records and ****** ********* an employee of ** ***** Water Department, informed us we should have this information in the next few weeks. ****** ********* from the Tennessee Public Utility Commission, said we should have a letter within the next 10 days determining that no violations have been committed in this matter. We will provide further information when it is received. Thank you for your time and consideration on this matter. ******* ***** LA Construction and Drilling- Co- Owner Consumer Response /* (3000, 8, 2022/05/18) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am not content with the response and would like to address some claims. I did not contact LA directly as I was under the impression the water dept. was working with them to remedy the situation. Regarding the TN Public Utility report/letter referenced, the only violations it addresses is whether or not a company calls *** before diggingnot damage, so the letter won't apply. Regarding the claim that "several excessive repairs" were done, codes required the pressure reducing/shut off valves. I tried to eliminate those items to save money as this was a huge, unexpected burden on me ($1,200 water bill and $2,500 repairand time off work, etc). I was also advised that patching the line with mismatched materials would cause a rebreak in the future. It only cost a couple hundred more to replace the whole line, restoring it to its original state. I also did a records request to verify that the break occurred during the days LA had their trucks/equipment parked all in my yard and easement area. I will try to attach more pictures showing the trucks/equipment as well as the obvious tire tracks on the meter and yard. I just ask that LA Drilling and Construction do the right and fair thing. Sincerely, **** ******** Business Response /* (4000, 11, 2022/05/25) */ We are currently waiting on the records from ******** Water Department. We ask for a few more days to get the information we have requested. We are willing to negotiate on repairs if we are found at fault. Thank you for your time and consideration on this matter.
