Ordered a battery on Nov 10th and paid with cash. Got a call from Tennessee Battery Sales saying they could not order that one, and instead were ordering a $171 more expensive battery. Never picked up the battery or paid the additional $171. Called to get a refund because I didnt want that battery, and they denied the refund for the original battery order, which will force me to spend an additional $171 for a battery I do not want.

      Business Response

      Date: 12/14/2022

********************** ordered an AGM Odyssey 8D battery an aged stock item with our vendor. Due to the item being an expensive special order item, we do require a deposit. ********************** actually paid for the item in full rather than just a deposit.

Once we received Mr. ********** order and payment, we contacted the vendor. That item was now out of stock; again, an aged stock item only one in stock that had been in stock for awhile (the meaning of aged stock). Our vendor did state they had another option that was more expensive. We contacted the customer, explained the issue (out of stock) and did tell him the vendor did have another option but it was more expensive. ********************** gave us the approval to order the new battery and the additional amount due would be paid upon pick-up.

The following week (11/18/22), we contacted the customer to let him know the new ********************** had arrived and was ready for pick-up. ********************* stated OK and thank you on the call; he did not state he no longer wanted nor would he be picking up the new battery.

As of 12/12/22, Tennessee Battery had no contact from ********************* since the phone call of 11/18/22. On 12/13/22, ********************** called and stated he wanted a refund of his deposit. We explained to ********************** that, due to the product being a special order item which he understood at that time, we cannot refund the deposit. We do not charge customers up front for any product that is not a special order item.

********************** was informed from the beginning that the battery he needed was an expensive special order item and that a deposit is required. He appeared to understand these terms, not only paying for the original aged stock battery in full, but approved our ordering a different, more expensive but available battery. Tennessee Battery did not tell ********************** that we were instead ordering a $171 more expensive battery. We did inform him the original battery was no longer available and suggested a different although more expensive -battery that was available.

We respectfully disagree with his assertion we were ordering a $171 more expensive battery. ********************** was kept informed of availability, cost and arrival of the second battery. He at no time informed us he did not want the more expensive battery. Had he voiced that, we would have refunded the money and not ordered the more expensive battery, since we never received the original ordered battery.

      Customer Answer

      Better Business Bureau:

I disagree and disapprove of Tennessee Battery Sales response, customer **********************, and return policy. Since I no longer have a use for the battery, I found someone willing to buy it for a small discount. I have been a loyal customer of TN *******************************************, preferring to shop local. Rather than doing the right thing, they chose to lose a customer.

      Sincerely,

      *****************************
