      i have an auto loan with this company and they had my car repoed unlawfully . they did not contact me at all . accepted my payments and not only lied to me when i called to ask if the car was taken by them , after confirming with local police that they in fact did tow my car they proceeded to hang up the phone on me each time i called and refused to assist me further . they gave me the answer to “call back around lunch time” on the last contact and i explained that at 9am around lunch time is not an actual time and the matter is more urgent as all of my infant daughters items and our forms of payment are in that vehicle . they are very unprofessional and prejudice . they did not even attempt to resolve the issue after they realized that they were wrong . i have done all payments since purchasing the car through THEIR APP call carpay i even pulled up the account to make sure it was still open and active which it was my contact information was also updated on their and i have had several conversations with them as well.

      Customer moved out of State of Tennessee Has been in Delaware since November 2023.  Insurance on the car had cancelled for nonpayment and payment on the vehicle with our company was 2 months in arrears.  We did try on several occasions to contact customer at new phone number given to us.  She made no attempt to get in touch with Unaka Auto Sales to make arrangements to bring account current or to get insurance reinstated as required by law.  If customer had keep insurance on vehicle as required by our company and thelaws of this State  and kept her payments current we would not be discussing this now

      I am rejecting this response because:
      While I acknowledge and appreciate Unaka Auto for taking care of the fee, that still does not solve the issue of what i’m to do with these items now, and how I will get myself and my daughter around in a state that I want to stress I do not live in and have not moved to. I still have a TN license. Would it be an unreasonable request as the vehicle is going to be sitting in a lot for the next 2 weeks that instead I be able to bring the payments current on the car, show proof of insurance, and reclaim the vehicle ?

      It is unfortunate this issue is still unresolved however the facts of this matter are the vehicle was repossessed because the account was past due. Customer was aware of due date set in contract at time of sale. Customer was aware of past due balance and this reflected in carpay app where customer logged in. At time of repossession customers 2nd payment had came due. Had been past due for over 30 days of last payment. Once customer is due they have a 5 day grace period. If no contact is made or customer does not make payment arrangement there is no choice but for Unaka Auto to retain collateral. Unaka Auto requires vehicle be paid off in full under circumstances of repossession out of state. Unaka Auto Paid repossession fee required to obtain personal items out of vehicle for customer to repossession company.
