On January 7, 2023, I pre-paid ****** for a preorder of a Funko Oswald the Lucky Rabbit Soda Can figure from Tall Man Toys and Comics (order * ***** ** I expected to receive the item in 4 months or so. Seven months later, in August, I noticed other consumers received this item, so I reached out to Mike Hermann asking the status of my order. He said the Funko order was split into 2 batches, & mine would be in the second shipment which had arrived & was shipping that week. In September, I received nothing, & followed up. Mr. Hermann noted that literally everyone else's Oswald preorder had been fulfilled EXCEPT mine, & mine would be shipped when they received their next product shipment from Funko. In October, I followed up & he said it was due to be shipped any time. I reached out in November asking when to expect the item & didn't receive an answer. In December, I asked if the item would come before the end of 2023. His website indicated that the item was sold out & the preorder was over. I asked if I could have a refund as it had been 11 months since I ordered. He offered a substitution & asked if I would wait until February as Funko might be releasing another production run of the item. I didn't feel confident as I had waited nearly 1 year. I requested a refund. He emailed me saying he canceled my order & completed my refund. I continually checked my bank account to see if the refund was sent, it was not. I politely reached out 3 times over email asking him to refund me, or to show proof of refund so I could share with my bank. Ever since I asked for the refund, he has not responded at all. I tried to resolve this politely via email over a period of 5 months. It does not seem legal for him to take my money for the prepaid item and not fulfill the order, OR give me a refund. I understand if he is using my money to prepay for an item, but if he made a mistake in not purchasing enough items, then I should get my money refunded if there is no product for me.Business Response

This is an unfortunate situation, created by the customer non policy demands.
1st the product we were going to ship was discovered to be damaged, and we withheld it from the order, the customer advised us it didnt matter the condition of the product as it was going to be given to a child to play with.
2nd the customer received the undamaged merchandise and then the child whom it was a gift for broke it.
3rd - given all the information about the customer damaging it, we still sent a return label. The customer then sent demand emails stating when the refund must be processed by.
As explained to the customer, for tax purposes, we process all returns (we have never had more than 4 in a quarter) on the last day of the quarter so they maybe processed accurately per the state requirements.
Returns are processed for Q1 on march 31st and not before.

In the email you sent, it says we can reply to you for the complaint to be reopened so I can submit a response to the business. In Tall Man Toys' response to the BBB, he had my issue confused with ANOTHER customer. Thus, it did not address MY complaint that Tall Man Toys has not sent me an item I pre-paid for and never received. They have illegally kept my money for over one year.
I must protest if BBB is going to publish in Tall Man Toys' business profile that their response falls into the category, "Answered---the business addressed the issues within the complaint, but the consumer remains dissatisfied,"
The business did not address my issue, but references another customer's situation. How can I be satisfied if this situation does not refer to my specific situation?
I have had a frustrating experience with Tall Man Toys, who has taken my money and has NOT provided me with any item or issued a refund, AND with the BBB who is going to publish an untrue statement about this unfortunate situation. By falsely publishing that the business responded to the issues in my complaint when in actuality it has not, it is as if you are condoning this situation where he took my money without providing me with either the item I ordered and NEVER received, OR the refund I never received.
I understand there is nothing you can legally do to "force" Tall Man Toys to rectify the situation. However, it is in your power to not publish an untruth about my situation on the Internet, giving a false idea that Tall Man Toys appropriately replied to me when it did not.

I placed two online orders with Tall Man Toys and Comics. I placed the orders at the beginning of the year. The sale included the fact they were preorder items and there would be a wait. It is now going on 7+ months. I know, thru emails from the company, that these items were being shipped to buyers starting a while ago. How many months ago I'm not sure. I understand people order at different times and their products should be shipped in the order they were placed. However, I believe my orders were placed high on the list, so to speak, and I feel I'm being ignored and being held to the last possible spot on the list. I have sent Numerous emails within the last several weeks and I am getting no response. I contacted the actual store and was told they could not help me as it is a warehouse issue. I think it is horrible customer service. The orders have been paid in full since placing them. My last email simply asked for either a ship date or full refunds on the orders. As per usual, no response. All I want is what I ordered or my money back. It's been 7+ months, along with no customer contact. Please help with this issue. On ******* I pre-ordered a POP Funko from Tall Man Comics online. The total purchase was $21.85. I am not familiar with POP collecting and had read somewhere that the product would be released early July. On July 12th, I reached out to the company via email asking about my product. The owner, Mike, informed me there are no release dates for FUNKO products. I had started to see other companies receiving the product and even resell online, but wanted to support small local business. On 9/7, I asked for a refund as I was able to purchase elsewhere and had no update on my product. 9/9, I had informed the business I would be disputing this charge with my bank. The owner responded instantly saying that he would not issue a refund and good luck getting my money back. He then back tracked after realizing we had a mutual friend and stated he would give the refund. I received a confirmation email on 9/9 that I would receive the refund. On 12/10 I reached out stating I never received the refund. No response. On 12/27, I reached out again. He stated the money was withdrawn from his account on 9/11. On 12/27, I reached out to my bank to confirm that this refund did not hit any of my accounts. I did end up disputing this charge with my bank, but they will not get involved since it has been over 6 months. I have no other choice, but come to you now. I know it is only $21.85, but have heard similar stories from co-workers and friends. It seems he may be doing this to others and often. I have attached my email communications with the owner and the email stating I would receive a refund.Business Response

Customer broke her special order and was refunded immediately upon realizing i was friends with her boss and her conduct towards us was unbecoming of an employee of Regal whom we have contracts with.

On August 25th of 2021 I ordered a set of Minnie Mouse Funko Pops from Tall Man Comics in Knoxville TN. The purchase amount was $60.25. This was a preorder. I sent several emails asking about when these would ship and until the last 2 months I had gotten an answer. The the last 4 emails sent were not answered till I said I was filing with you guys. I was told they were not released yet but several other retailers have them and its been almost a year I would like a refund but have been refused that,Business Response

Business Response /* (1000, 5, 2022/07/28) */ Customer made a NON-CANCELABLE special order for a minnie mouse product in 2021. The product was delayed by the manufacturer and is still not available, several press releases have been issued by that manufacrurer. We responded to every email this customer has sent us, but the customer refuses to acknowledge them. He requested a refund, a refund was granted upon that request. The issue is closed. (this was an email he chose to acknowledge) He has since then made claims that he no longer has that account. I advised that our system cannot detect that nor can we make changes to the refund that has been already been issued. We have gone above and beyond to attempt to satisfy this customer and this issue is closed. I have several emails that were never replied to and I have replied to every email they sent including when they playing games and sent 4 emails saying please respond. In addition to that the customer has been contacting us directly instead of going through the moderator here which is a violation of the BBB process. We responded promptly to the customer advising him of this, and did so only as a continued example of our customer service commitment. So I contacted them hoping we could get this settled but instead all I got was told I couldnt contact them even though at the time the BBB had closed this. As far as customer service they should have replied in the given time. They are just hoping I go away which I will not till I get my refund.
