      I purchased a home 3/17/2023 from the builder and on 3/22/2023 I got measurements and estimates to have security doors install. The storm door company (employee) stated that he was unable to install my front, due to door swinging out and not into the home, it would be a safety hazard if there was a fire in the home, as well as the door hinges are not made for the outside of the home and anyone couldnt pop them out of the hinge and take the door off the frame. I emailed the builder about the information stated above. The builder replied, Front door is an out swing unit. It is acceptable to have an out swing door. Doors that swing out are harder to kick-in. Also, for your peace of mind, the house comes with an alarm and you should have gotten the contact number to transfer monitoring if you so choose. I replied the door is mostly made of glass and they could just bust the glass open, can't the door frame be switch around so that I am able to install my security doors for security and I have had the alarm set in my name already. Builder didnt reply to my request in regards to the door. So on 2/23/23 I had a contractor come look at the door, agreed that the door was not properly secured and gave me estimate to fix my door frame. On 3/26/23 a contractor repaired the doorframe.

      During due diligence period, before purchasing the home, *************** had a home inspection performed along with multiple walkthroughs with her father and boyfriend. Home inspector, ***************************** did not mention any deficiencies with the front door during his inspection of the home on 2/17/2023. *************** also did NOT mention any desire to install storm doors during the due diligence period. 

      On 3/17/2023 ***** purchased the home and was issued a 1-year home warranty through ********************* Association. I am a member in good standing with this association. 

      On 3/23/2023 ***** contacted me via email stating that she is unable to install a storm door over the existing front wood door because it is swinging out and not in. I responded to her email, and explained to ***** that this is not a warranty defect and the reversing of door swing is not covered under the warranty.

      The front door and the door swing matches the architect's drawings for this home, that this house was built according to.

      The exterior doors were provided by ************, local supplier in *******. The doors, frames and hinges come already assembled from the manufacturer. 

      In her email communications, *************** did not mention any deficiencies regarding door hinges. If in fact the hinges were defective, they can be easily replaced, without necessitating tear out and reversal of the door frame. 

      This is not a home warranty issue, nor a manufacturer's defect. This is a customers preference that was not requested prior to purchase of the home during due diligence period.

      The front door wasnt installed properly per the contractor who replaced the door as well security door company. During the process of walkthroughs with the builder, I didnt think it was pertinent information to inform Mr ****************** of the wanting to install security doors. Thats like we informing him of the decor of my home.
      The builder has other homes in the area where the same manufacturer doors are properly installed and swing into the home. After the hired contractor fixed the front door of my home , Mr ****************** visited the home and spoke with my father, where he suggested replacing the hinges on the door which was not needed at the time.
      Also there is no email between the builder and I about him making this statement of the door replacement.  email, and explained to ***** that this is not a warranty defect and the reversing of door swing is not covered under the warranty. Mr ****************** stated that I should just use the alarm system that was installed. 

      The picture included is of a home by the builder off ****** road near my residence. Its installed to where the door hinges are within the home and swings in.

      1. The floor plan. ******************* residence was designed by the architect with floor plan indicating an out-swing door. The house was also built with an out-swing door according to the plans! ***** is comparing her home to another house built by my company that has a completely different floor layout. ******* home, as well as two others in this neighborhood are unique individual designs by a local architecture firm. ***** should have confirmed the door swings prior to purchasing her home during the due diligence period. Front door swing is a matter of preference.  

      2. Copy of ********************* warranty. In the warranty is clearly states: 

      "Notice of Claim to *********: If the Homeowner believes the Builder has not performed as requested in the complaint submitted to the Builder, then the Homeowner should submit a registered letter, stating the complaint, directly to the *************************** at ************************************************************************** along with copies of the original complaint submitted to the Builder."

       

      *************** clearly did not follow the home warranty procedures she signed & agreed to when purchasing this home. ***** failed to inform the *************************** to find a resolution. Instead, she proceeded to make modifications to her home. By doing so, she has voided her new home warranty. 

      If in-fact, the front door was not functioning properly, I would have gladly repaired the issue. However the swing of the door is not a builder defect, nor is it a warranty item. 

      Furthermore, in her email communications to **, ***** expressed desire to install a security door because "I would like to install a security door, due to the front door being mostly glass"

      However, the "security" door *************** had installed is another full glass door with minimal, to no protection at all. Anyone could potentially kick in the plain glass storm door, just like they break the glass entry door. Picture attached.

      1. On March 23, I emailed Mr ****************** about wanting to installed security doors for my home, which had to be custom made related to height of the doors. It was non-refundable deposit made to ************ Security Doors Llc, for security doors and to measure the door frame, I was then acquired  additionally fees for the company to come back out and re-measure the door in question, to reassure the measurements were not off the after another contractor corrected the door frame that I originally asked to be repaired by Mr ****************** which he stated the its acceptable to out-swinging door, makes it harder to kick in and use the security system that was in place. I proceed to ask Mr ****************** could he just flip the door frame around, which he completely ignored that email and continue to talk about when the iron guy would come out to my home.  If installing doors that swing out is acceptable and make it harder to kick why didn't he install the back door the same way or in the other homes that he has built. Also ****************** does not know what my security doors are made of, he hasn't been to my home since 3/29, when him and my father talked about the door and offered to purchased more hinges for the door. But the door had already been corrected by another contractor, which stated he didn't know who the contractor was and I didn't provide him with information. ********************* never asked for that information, I would have gladly provided it. 

      2. Mr ******************, the seller and I signed a document prior to closing that my kitchen cabinets, beam in living area and railing would be fixed. Since Mr ****************** stated that he canceling my home warranty, he is breach that contract. Also I have reached to West Tn HBA and they will be reaching out you as well.

      3. I have asked Mr ****************** to fix otheritems in my home such the gate does not close  properly, leaking bathroom tub faucet, medium size opening in the drywall in the master closet, kitchen sink it separating the counter. Yes a plumber came out on 4/22, but one was home. I emailed ********************* 4/28 & 4/30 about needing dates and times when someone is going to come and fix the items mention. So myself or a family can be here when they are available to come. I sat around all day 4/30 awaiting for the contractor to come to my house, emailed ********************* asking for times so I wouldn't miss anyone. ********************* stated "My team  and I have no problem coming back to repair issues that can come during the first year home owner ship-if I follow the rules. However I will no scheduled workers regarding normal warranty items until I withdraw my complaint from BBB.
