I bought my 2021 *** from Brentwood Auto Brokers and purchased all of the extra warranties including vehicle maintenance warranty that was supposed to be covered for 6 maintenance services for free. Since the business is now closed and I have to go to the dealership to get it serviced-the warranty actually only covers $45 per service. And we paid $999 for the warranty and it will only cover $270 worth of service since they went out of business and that is just one of 10 warranties that were included in the package. Do I have any recourse?

I purchased a *** on 12-27-19. I had foot surgery in august and December of 2022. I was unable to make a claim with the disability insurance because the business closed. I ended up selling the vehicle because I was having hard time making payments. I would like the insurance claim to be verified and reimbursed to me. I dont even know who I was supposed to contact for this. I also would like partial refund of gap coverage I purchased. I cant contact company to inform them of pay of date of 3-22-2023 to obtain this myself.

Deceptive Trade Practices Dealer sold me a vehicle claiming that everything in the vehicle works as if new. The navigation is obsolete and useless. No update available or will be available. The *** (like ******) which offers a paid service which would have given me the features i required in my new vehicle are again obsolete and unavailable. paid service or otherwise. Was told that it had other features that it does not have. I was told that it had not been in an accident. Upon further inspection its obvious that it had been. It was NOT disclosed that the vehicle had been used previously as a rental vehicle. So they misrepresented or omitted facts that would have kept me from purchasing the vehicle. They also charged me dealer fees that i requested be taken off as they are not needed. Im told this is called "loan packing" charging me extra fees for things that i requested not be done. i was told i had to purchase those things. They sold me a extended warranty that was supposed to replace any broken parts with new parts. Come to find out that no new parts are available for the vehicle. Everything must be bought second hand. In the less than 90 days of purchasing the vehicle i have had to replace the brakes. The tires need to be replaced. I have driven like 6k miles. I have a blown engine. No replacement available. I have a blown a/c condenser. nothing new again. The side view mirror is broken. The main control unit is bad. No navigation. No ***. Cyl 5 and 6 misfire as well as random misfire related to blown engine. Faulty fuel pump sending unit.

    Business Response

    Date: 07/05/2022

Business Response /* (1000, 5, 2022/06/28) */ To whom it may concern: Mr. ******** purchased his 2015 *** K900 from Brentwood **** Brokers on 3/12/22 with 96,164 miles on it. The vehicle was inspected and well within all required safety specs. Mr. ******** signed all documentation stating that he understood he had the opportunity to have the vehicle inspected himself by a shop of his choice and that the vehicle was sold as-is. Mr. ******** purchased an aftermarket warranty but asked us to assist him in cancelling it. The coverage was cancelled, per the client's request, on 5/24/22. The refund amount was processed and sent to the lienholder, ******* *** **** Finance, last week once the process had been completed by the warranty company. Mr. ******** put 10,000 miles on this vehicle in 3 months. The wear and tear is normal and at his own expense. Nothing further is owed. All supporting documents attached. Consumer Response /* (3000, 7, 2022/06/28) */ (The consumer indicated he/she DID NOT accept the response from the business.) Nobody is disputing any of that. You failed to mention your misrepresentation of the vehicle telling me it had features it did not have which would've prevented me from purchasing the vehicle. You told me it had everything that I required in my new purchase, all of which it did not have. The navigation unit i learned upon driving 10k mi shows that only 30% of it actually has roads due to being from 2014. The rest of the time it says I'm driving in the woods. The *** system (****** for ***) as well as the corresponding features i needed was told are only available after purchasing a subscription, which can only be done after purchasing the vehicle (and therefore not able to be inspected prior to purchase) is all obsolete. There is no update for either and no paid subscription is available. The service has been terminated as well as all the "features" you claimed I'd have which I don't and cannot get. You also claimed I had adaptive cruise but I did fail to check myself. I own that. Everything else is straight up fraud pursuant to Tennessee state law in which you omitted or misrepresented facts about the vehicle and its specifications as well as previous rental history during or after the transaction which would have kept me from purchasing. Additionally, the law states that up to 6 months after purchase a fault (such as a blown engine) comes to light during that time period it's assumed that the fault was present at the time of purchase unless THE SELLER can prove otherwise. Did you perform a compression test to prove otherwise? No! The seller only has one opportunity to repair the fault after which, if unable, entitles the purchaser a full refund. Also in accordance with state law you added illegal "loan packing" fees when you charged me doc fees and window etching fees even after I requested it be taken off. I was a used car manager. It can and should've been taken off. The law agrees with me. It's called fraud! Additionally you sold me a warranty which I did in fact cancel. Reason being all the previous problems up until I found out my engine was blown not a single one had the available parts to fix! I had a warranty that I couldn't use because there's nothing available to fix it with. On top of that every shop that I use I went to none accepted your warranty. As a matter of fact the only place I found that did was you. Nonetheless. Nothing to replace it with. Failure to disclose the fact voluntarily per state law the fact that the vehicle was used as a rental previously again would've prevented the sale. You used deceptive trade practices in order to sell a vehicle to someone you knew, at the time, had no other options. You told me what I wanted to hear and that the vehicle had all these great options all of which it did NOT have. State law states, "fraud and deciet include, a misrepresentation in any manner, whether intentionally false or due to gross negligence (applicable to this instance in my opinion) or a material fault, a promise or representation not made honestly and in good faith, an intentional failure to disclose a material fact, and act with SECTION 484 of the penal code. These are the facts. Funny how you skipped over all these more serious and punishable by law facts of this crime committed by your business. I am in my legal right to "revoke acceptance" of this vehicle pursuant 2010 Tenn code 47-2-608. Business Response /* (4000, 11, 2022/06/30) */ We will provide tracking of the cancellations that were in fact sent to the lienholder. Unavailability of parts is a global issue that is out of our control. We dispute all other accusations as they are based on alleged hearsay. We rely on factual and documented paperwork signed by and provided to you that we have copies of and have been attached in this case already. Consumer Response /* (3000, 15, 2022/07/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) I have been speaking to *** corporate and it is in fact NOT a supply issue. They don't make the engine or the other parts anymore. Paid services have nothing to do with supply issues either. Just saying my accusations are just heresay and not providing evidence to the contrary, which incidentally the law states the onus is on you the seller to prove and not the consumer, just goes to show the merit of my complaints. I've been inconstant contact with *** and the lender about this issue. And as for the tracking... if you sent it and have tracking why not just post it with your response? Because ******* *** certainly is interested in their money as well and they still show my warranty and gap as active. Seems to me by not providing the information I requested there's something you're trying to hide. I feel like there's nothing left to say on this matter. I think it's plainly obvious that their has been some deception and falsehoods throughout this entire process. Business Response /* (4000, 17, 2022/07/01) */ Regardless of all of the statements, Mr. ******** purchased the vehicle AS IS and had every opportunity to conduct a pre-inspection along with any due dilligence. It is an older vehicle with over 100,000 miles and Mr. ******** never expressed any concerns until he cancelled his warranty and blew his motor. He drove the 8 year old vehicle for 10,000 miles until his motor blew. *** should explain why their product failed at over 100,000 miles if anything.
