    I purchased what was supposed to be a low mileage *** 3500 in great shape from Shelbyville Auto Sales on March X XXXX. I live in Texas, so I was going on the dealerships word for the condition of the vehicle as I was purchasing it sight unseen. When the vehicle arrived, I immediately noticed that it had issues as the entire dash was lit up with warning lights, service lights, found the bed was not original to the truck. the truck is grey and the bed was red before and just painted over poorly. They did not send the head rests to the seats in the truck (this was a first as I have never received a vehicle without headrests). Upon further inspection I found part of the exhaust had been cut off the truck and one of the frame supports for the truck had also been cut out. The truck in the pictures online showed to have the factory installed fifth wheel by the slots in the bed, but given the bed was not original to the truck, this was untrue. I then found the clutch in the truck slips, so now I have to pay to have that repaired as well. To top it off, I paid Shelbyville Autos 3756.09 for Sales Tax in the State of Texas so they could handle the registration for me as all dealerships do. I spoke to the Sales Manager **** who stated he would take care of this for me and they had a miscommunication on their end and my paperwork had not been sent to include the paper tag needed for me to drive the truck. Shelbyville Auto Sales did not take care of the registration on the vehicle as they said they would, instead they sent me the paperwork causing me to miss more time from work dealing with this vehicle. To top it off i was charged 3756.09 for sales tax, they sent a check for 3419.19 for me to pay the sales tax, so they already stole 336.90, not to mention how much was overpaid for a truck that was in no way what it was represented to be.

    Business Response /* (1000, 5, 2022/05/17) */ We were informed of the lights on the dash as soon as the customer received the truck. These were not on when the truck was picked up by a 3rd party, but in the interest of good will we paid for the repairs. The truck was As-Is and we were not obligated to pay for any repairs. The customer failed to mention this. We sent the title and paperwork for the customer to go in and secure a Texas registration and tag. We are out of state, there is no way for us to secure tag without the customer going in. This is a Texas law, not ours. We are aware of the overpayment and will be refunding that to the customer. We estimate sales tax when they don't live in Tn, thus the slight overage. If you look at our website, we take 30 plus pictures of all of vehicles and we post the ******. We have nothing to hide. If a customer needs a more detail look, we always recommend an inspection by a 3rd party. The customer never asked specific questions about the truck to our salesperson or was anything mis-represented. These trucks are pre-owned and should always be treated as such when purchasing. The dealershio was notified weeks ago of the overpayment, but waited until now to say they will send the refund. Characteristics of a business that is continually allowed to defraud consumers due to legal loopholes. No pictures on their website show the bed of the truck was not original to it, nor did they reflect the frame support had been cut out or that the headrests were removed. The dealershio paid a portion of the repairs for the lights that were on the dash upon arrival. Questions were asked of the salesperson, but she was preoccupied citing that a friend of hers had passed. You state you did not know how much the taxes would be for the vehicle in Texas, how did you know what to put on the check you sent? If in fact, you were unaware of the amount needed the check should have been made out for the amount I was charged for sales tax. Another falsity in a long line misrepresentation by your organization. In looking at other complaints logged against this dealership I will venture to say that I am not the first to be ripped off by them and considering the laws in this country are designed for crooks and cons, I can confidently state that I will not be the last. Business Response /* (4000, 11, 2022/06/07) */ We have no reason to mislead anyone. We have been in business for 12 years for a reason sir. We do our best to address any issues that arise. We have spent thousands on repairs over the years that we were technically not liable for, such as fixing your check engine light. We did not have to pay for anything, but we did. These are as-is trucks and should be treated as such. The specific issues you are referring to were not asked before the purchase. We would have gladly sent detail photos if asked. We had 32 photos online before the purchase. We have issued the overpayment tax refund and consider this case closed.
