Auctioneer charged me more than customary charges. Auctioneer charged me 75% of fees and only charged my ex spouse 25% of the fees. These fees were supposed to be taken off of total profits and I was supposed to get 75% of net profits and ex spose was supposed to get 25%. I called auctioneer but did not get resolution to this. Auctioneer said my attorney told him to do it that way. I contacted my attorney, ***** ***** **** and confirmed that the auctioneer figured it incorrectly.

This was a divorce settlement,,and court ordered. And as her attorney  and the attorney of her ex husband said you are to give a settlement as follows...75% of sale goes to wife and 25% goes to husband,,, ,so our commission comes off her side and husband pays his commission,,,,, I did not charge all the fees I was supposed to charge....she paid commission on her 75% of what was sold,,,,,I did exactly what should have been done in this case....I spoke with her attorney and she said I see how you figured this and I understand. I don't see how you can please both attorneys but can't please everyone else,,,,,if you are getting 75% of the proceeds you have to pay 75% of the expenses.

I am rejecting this response because: the auctioneer did not calculate my portion correctly and had been provided with a picture of divorce paperwork. My attorney agrees this was not figured correctly. I request I be reimbursed and auctioneer get with my ex spouse for the overpayment to him. Its ridiculous to think that I would be responsible for 75% of fees!!

    Sincerely,

If anyone receives 75% of the proceeds you will receive 75% of the expenses incurred,,,,,NOW,,,,,,Iwas never at once told that it was 75% after expenses.....Your attorney never told me anything of the such,as you say,,, I did exactly what I was told and I can't imagine that without being told by either attorney you expect me just to know to charge commission in any way,,,I have done this in many divorce cases the same way each and every time. But first and foremost I was not told any difference,,and you want to turn me into BBB for something I was not told by you or your attorney,,,,only that you get 75%,and he gets 25%.

We auctioned off things out of our Thrift store because we had gone out of business Feb2,2024 the auction was April 2nd. There were thing they were told DO NOT SALE. They sold some 2 by 6s and some sheet metal. Not part of the auction. When I spoke with owner he said his mistake and we reimbursed us for those items. Has have spoke with him at least 8 time promises he had already sent a check( in the mail) still nothing. I have given them plenty of time and opportunity to make this correct. Now they won’t even except my call.

We did have an auction for *** *******,,,I have a signed contract that states nothing of the sort,,,,absolutely nothing to be held back. The contract is very clear and states that everything will sell....I was not told anything about this until about 2 weeks after the sale,,,at that time she wanted people to bring the merchandise back,,,which is absolutely impossible.....Just so you understand this her whole sale total was less than 2000.....I did not even charge her all the fees of th auction, because of her dire situation....This sale lost us approximately 1500,,,,but we did not complain. She was paid for the material in her payment,,,,,the material she is talking about was used and in poor if not terrible condition....no way in anyone's right mind was it worth 1000.,,absolutely nuts....We down there to help this lady because she was way behind on her rent and bills,,,,we even drove her ck to her because she was so behind....I am sorry..I have talked to her since auction,  and I told her I would help her, but in no way was I ever going to give her 1000.
