a few weeks after getting the vehicle , oil got changed , then lifters went out . All Star Auto took the vehicle to get the lifters fixed. Vehicle is currently not running due to lifters once again . Every time oil gets changed lifters go out , making mechanic believe All Star Auto is putting in thicker oil to make the noise go away , then when oil change gets done , the noise is there because the people changing the oil are putting the actual oil it needs instead of thick oil . All Star Auto is refusing to show proof of what was fixed , because “they paid for it” . As well as trying to repo vehicle due to it having no insurance , but no agency will put insurance on it because it’s not driveable and they are also refusing to fix it , and laughing in the middle of conversation .

After reading the complaint, here is our response:

It is true that a few weeks after *** ******** bought the vehicle, one side of his lifters had some issues.  Unfortunately, this is a common problem with Chevy trucks, suburbans and tahoes.  We had him bring us the vehicle and fixed it at no cost. Fast forward 3 months and he is having issues with the truck again.  We told him that we would look at the vehicle again, but he has to be in compliance with the contract he signed.  Full coverage insurance is required.  Please note that all vehicles we sell are sold AS IS.  We do not have to fix anything once the vehicle has been sold.  We have no reason to lie to a customer and tell them we fixed the vehicle and didn't.  We have tried and are still trying to help *** ******** even after him and his partner have been not so pleasant to my employees.  We have been in business for over 20 years and pride ourself on repeat business.  I know used car lots get a bad rap but we generally try and help our customers as long as they make their payments and keep insurance.  It is in our best interest to do so.

I am rejecting this response because:

Not once did ******** or ******* say they would fix the vehicle , they said they would transfer me to another mechanic , not fix it . Also , the vehicle has been insured full coverage , through Dairyland up until the vehicle messed up . If you go back through the phone calls you could see and hear that they only tried to send me elsewhere to get it fixed.

      Sincerely,

Thanks for your reply.  Unfortunately, you signed an AS-IS agreement and a contract stating that full coverage insurance is required at all times during the life of your loan.  We have tried to help you and go out of our way, even though we are not legally required to do so.  As-IS means whatever happens to your vehicle is your responsibility to fix.  Over the last 20 years we have helped countless customers and thrive on repeat business.    You and your spouse have cussed and treated my employees badly. You have also made threats to get your lawyer involved and contact the BBB, which you have.  After all of this, why would we want to help you any further?    I would recommend taking a different approach in the future.

Yes, it is true that **** ******* has had some trouble with the vehicle that she purchased from our dealership.  It is also true that each time a problem has arisen, we have tried to help.  We have been in business for twenty years and we try very hard to solve these problems before they are sold.  Unfortunately used cars have problems from time to time that are not noticed or happen after the cars hit the lots. I really don't understand why **** ******* would send in a complaint to the BBB as we were already in possession of the vehicle trying to find a solution.  We sell all of our vehicles AS-IS and we are under no legal obligation to fix anything on the vehicle once they are sold.  We fix customers cars because we think it is the right thing to do.  We have now fixed the problem with *** ******** vehicle even though she has sent in a nasty letter to the BBB because we think it was the right thing to do.  This was our intention the whole time and was very unnecessary of her to send in a complaint.  We have a very loyal following of customers because we do what right by our customers.  It's hard to be in business in a small town for twenty years if you treat people poorly.

On about March 17, 2022 I paid $2,000 down on a 2009 Chevrolet Suburban at Abilene All-Star Auto on Danville in Abilene, Tx. On about 3-24-22 the vehicle got where it would not go over 10mph. We checked the transmission fluid & it was black so we dropped the transmission pan & there was metal shavings in the pan. I called the car lot but they didn't return my call. On 4-13-22 the car lot texted me about the payment & I told them about the problem & I wasn't going to pay for a vehicle that I can't drive. They called, refused to help get it fixed & said they would come get it 4-14-22. I want my $2,000 back so I can get a car. I have 3 kids to get to school, myself to work & my mom, who lives with me, to doctors appts. She is disabled. You can talk to my mom, ***** ********, about this if I am not available. Thanks for checking on this & helping me out with this situation.

Business Response /* (1000, 5, 2022/04/19) */ April 13 was the first time that we heard about the customer having issues with their transmission. Customer was delinquent on account at this time as well. We offered to pick the car up and get it looked at and fixed since she had only had the car for about a month at that time, as long as she brought the account current. When the wrecker arrived to pick up the car, they had disconnected the tie rod ends and broke the key off in the ignition. This could have been very dangerous to the wrecker driver if he had not noticed. We have been in business for over 18 years and try to go out of our way to help our customers, even though all cars are sold As-Is.

Business Response /* (1000, 5, 2021/12/07) */ All cars purchased at Abilene All Star Auto as sold AS-IS. We try and go out of our way to keep customers happy and driving. As ******* stated, we tried to resolve the problem and when it was too costly to do so, we traded him into another car. We were not contractually bound to do that. As stated, cars are sold As-Is. He states that his current car is horrible and the AC doesnt work. We tried to offer a resolution to this as well. ******* also states that we are very unprofessional. I feel like we are very professional and work very hard to keep customers happy.

On October 14, 2021 All Star Auto ran my credit card for $300. This was not the amount authorized by me. The payment was only supposed to be for $150. The employee admitted it was her wrong doing and that was not the amount that they were supposed to run. I was told the amount would be refunded in full within 2 days. I called back today October 18 because my bank said the merchant did not try to cancel the payment. Spoke with the manager and she stated they did not start the refund bc she did not have my full card number. Said she tried to call me but there was no answer and she does not leave voicemails. I got upset and said this was ******* ******** and she said since I was cussing at her she wasn't going to refund the payment and hung up on me.

Business Response /* (1000, 5, 2021/10/21) */ Yes, on October 14th a payment of $300.00 was ran. She usually pay's a half of a payment every 2 weeks, but her vehicle payment is due once a month. If a customer is in good standing we make payment arrangements with our customers. There was confusion between her and an employee when ******* messaged our employee to pull out the payment. Our employee pulled the full 300.00 unaware that she was only wanting to pay half of her payment. ******* was extremely rude and cursing. I told her I would happily refund the 150.00 but in order for me to do so, I needed her full card number, she said she was at work and didn't have time for this. I tried calling her back but phone went straight to voicemail. No, I did not leave a message. This was her responsibility to contact us for her refund. 5 days had passed ****** she called again wanting the full 300 refund. I advised her that I was not able to do that because her payment would then be past due. She was not satisfied with anything and continued to be rude and curse. I told her since the vehicle payment was already due, that I was not able to refund her money.
