On February 1, 2024, I signed a contract in the amount of $3,960.67 for lawn sodding services to be completed by **** ***** and his company, MKRAD. His workers installed new sod at our home on February 19 and 20, 2024. There were some problems with sod not being installed correctly, but we corrected most of those ourselves.Shortly after sod was installed, we noted a preponderance of Poa Annua (bluegrass) taking over a sizable portion of the lawn. Mr. ***** told us not to worry, that this would die out when the weather was warmer and that the ********************** would grow into those areas.Around the middle of June, I called and emailed Mr. ***** several times to let him know that the St. Augustine grass had NOT grown into the bald spots where the Poa Annua had been and that we either needed more grass and/or at least a partial refund. I have not been able to reach him and have not received any reply from him, as of July 1.Business Response

- *** style="margin-left: 0in;">Severe health issue occurred to Mr. ***** on June 2nd and made Mr. ***** unable to address any issues regarding MKRAD. ************ *** style="margin-left: 0in;">Mr. ***** was fully aware of health issues Mr. ***** was experiencing as these issues did cause Mr. ***** to not be able to meet one appointment in April with Mr. ***************** *** style="margin-left: 0in;">No written correspondence was received from Mr. ***** regarding any issue or issues with the service provided.************ *** style="margin-left: 0in;">During Mr. ****** three-month hospitalization, a voicemail was received from Mr. ***** stating that the sod had a few issues due to overwatering.************ *** style="margin-left: 0in;">In the voicemail Mr. ***** stated that **** ******* owner of ****************** advised him to stop watering.************ *** style="margin-left: 0in;">This voicemail was not discovered until three days after receiving the initial BBB complaint email. ************ *** style="margin-left: 0in;">MKRAD voicemail clearly advised customers to utilize the website or text message to communicate with MKRAD. ************ *** style="margin-left: 0in;">Mr. Fuscos complaint is for weeds in the Sod. However, this issue was addressed on March 28, 2024, with Mr. ***** hiring ****************** to address weed issue in his lawn. ************ *** style="margin-left: 0in;">MKRAD is not licensed to spray chemicals on lawns, and this is why MKRAD referred Mr. ***** to ****************** and according to the voicemail left by Mr. ****** a business relationship has been established between the said parties. ************

I am rejecting this response because:I sympathize with *** ***** for his prolonged illness and subsequent hospital stay; my wife and I have also endured a very trying year for our own health issues.
Contrary to *** ****** accusation, I was never aware of ********* hospitalization, until the BBB forwarded his reply to our complaint which was filed more than 4 months ago. (I am both surprised and confused that the BBB allowed this complaint to remain open for this length of time.)
Sadly, it seems that *** ****** health issues have affected his accurate recollection of events which began after we paid nearly $4,000.00 of our life savings to him for proper sod installation in the front, side and back yard areas of our home in February, 2024.
As my initial complaint mentions, at the end of March, 2024,I called *** ***** and then emailed photos of our lawn, showing that the sod was overrun with weeds. *** ***** replied that this situation would resolve itself with warmer weather, but we are now left with many large and ugly bare spots in our very expensive lawn.
*** ***** had also asked us to inform him of any mushroomsgrowing in the lawn, but when we did, he took no action. Further,never once did *** ***** offer to replace any of the bad sections of the sod he had installed for us.
While *** ***** claims that no written correspondence was received from [me] regarding any issue or issues with service provided, I did send several emails to him, including one dated June 19, 2024, which read, Please contact me as soon as possible about the poor condition of our lawn. After doing everything you asked and using the lawn care company you recommended,several sections of the lawn have either completely or partially died and need to be replaced.
*** ***** mentions that I hired ****************** to treat our lawn (incidentally, there is no license required to spray chemicals on the lawn, except for insecticide), but, in fact, it was *** ***** who initially hired Anointed to treat our lawn. That he would be using an outside company to complete his work was not disclosed in his agreement with us.
Prior to our agreeing to *** ****** people doing work at our home, I received an email from him stating that, The sod is warrantied for six months regarding material quality, and installation. Long before that six-month period had elapsed, I had more than once requested that *** ***** correct the problems with our new lawn. He had always replied, not to worry everything will be fine.
Finally, any company should have a backup plan. At the least, *** ***** should have had someone with his company or, possibly, his wife, respond to messages from customers to let them know about his medical situation. As far as we knew at the time, he was simply ignoring my phone calls and emails.

MKRAD is willing to have two pallets, 900 sq feet of St Augustine Sod delivered to the driveway of the residence of *** ***** the first week of March.
This sod will provide *** ***** with replacement Sod for sections of sod he mentioned in his voicemail that were overwatered by *** *****.
*** ***** will then be able to hire a contractor of his choice to lay down the overwatered sod areas.
This is the only resolution MKRAD will offer regarding this matter and will not accept any liability for workmanship issues of contractor *** ***** hires to lay the sod.
If this offer is rejected, MKRAD will consider this matter closed.

I am rejecting this response because:Mr. ***** continues to blame the customer for his negligence and poor customer service, rather than to take any responsibility for his lack of action and proper resolution to fulfill the contract he had us sign and his sod installation for which we paid nearly $4,000.00.
Considering that the sod he installed at our home was full of weeds, we would not wish to accept any additional sod from him.
As for his claim that we "overwatered" our lawn, we watered precisely per his instructions, which were listed in his contract as:
"Seven (7) days per week before 5 a.m. - 20 minutes"
"Six (6) days per week after 9:30 p.m. - 20 minutes"
Because we carefully followed his instructions for watering, we received a water bill the next month for over $500.00.
Mr. ***** *** consider this matter closed, but we do not. In an amicable effort to close this matter, I would accept a refund of 25% of the total we paid to him, which is $990.00. Otherwise, we will be considering legal action, which I would really like to avoid.
Incidentally, I am concerned that the BBB has allowed this matter to remain open for over 6 months. Could you please explain that?
