I recently reviewed my credit profile and noticed innaccuracies and incomplete information with this company. According to the **** 611 (5) (A) creditors are required to delete inaccurate/unverified information. Austin capital is reporting false late payments on an account that was closed with no balance due.Along with inaccurate information on my credit profile this creditor violated the cares act of 2020 to stop adverse reporting if affected by Covid.This account should be updated to paid and never late.Business Response

Thank you for forwarding this complaint to us for review. After our review, we find we are in receipt of three disputes via the Credit bureaus from October 2023 through January 11, 2024. We have conducted a complete investigation into each dispute and provided the results back within the required time frame. Email notifications are sent when an account is 1,10, 15, 28, 30, 60, 75, and 80 days past due. These notifications were sent to the same email address as on this form. Please note, per the ***** The CARES Act only requires accommodation for Federally backed mortgage loans and automatic suspension of principal and interest payment. Austin Capital Bank did not receive any request for accommodation in regard to the Credit Strong account prior to the delinquencies. We are required by the **** to report accurately and cannot remove any factual information that has occurred.Initial Complaint

Austin Capital Bank keeps a record of all incoming and outgoing mail. As of 01/22/2024, we have not received a direct dispute requesting debt validation from the customer. We are in receipt of a dispute from *********** and responded back with the results of our completed investigation within the required time frame.
Due to privacy laws, Austin Capital Bank does not accept disputes through third party vendors such as the BBB. We encourage the customer to send a dispute directly to our office along with documentation which substantiates the basis of their dispute such as the relevant portion of their consumer report which contains the allegedly inaccurate information or account statements. I am filing this report, as per advice from my legal reprensentation, to formally report this, like many others, fraudulent account as I have not opened, used, nor benefited from this account opened through Austin Capital Bank SSB. i have never even heard of this orginization, let alone opened anything with them. Unfortunately, my personal identifying information such as, (Social Security Card, ID, Wallet, etc.) was stolen from me years back, and i have been dealing with the ramifications ever since. I am filing a complaint against Austin ************ and Credit Strong regarding misleading practices and mishandling of my personal information, resulting in severe financial repercussions.Austin ************, through its subsidiary Credit Strong, misrepresented their product's terms, leading to detrimental consequences. I engaged with Credit Strong under the impression of a credit-building tool, only to discover undisclosed loan application requirements. *************** information was utilized without explicit consent for a loan application, causing financial distress.Moreover, Austin ************ used my personal data as collateral without my informed consent, leading to adverse credit impacts. After our review, we find that that we are in receipt of three disputes in December 2023 via the credit bureaus for the Credit Strong account.A complete investigation commenced, and the results of the investigation were provided back within the required time frame. The loan contract provides the APR, finance charge, terms, amount of payments, and when payments are due on page one of the loan contract. This loan contract was digitally signed by the ****************************************************** Bank provides the consumer privacy notice as required under 6802(a) as implemented by Regulation P. The notice can be found on pages 3-4 of the loan disclosures. An opt-out is not offered as the sharing of nonpublic personal information (i.e., negative information) with nonaffiliated third party is specifically exempted under 6802(e) pursuant to the requirement to report accurately under the Fair Credit Reporting Act. Further, as required under FCRA 623(a)(7), a notice of the furnishing of negative information is provided to consumers as part of the documentation package which must be agreed to prior to the opening of an account or origination of a loan. The disclosure can be found on page 10 of the loan disclosures. We also provide notice via email when an account is 1, 10, 15, 28, and 30 days past due. A Credit Strong account is a secured consumer installment loan, the category cannot be changed.
