Dear Better Business Bureau,I am writing to formally dispute an inaccuracy on my credit report related to a fraudulent account listed under ******************** The account, listed as opened on 11/6/2018, was opened without my knowledge or consent. I am a victim of identity theft and did not authorize this account.I have filed a complaint with ***************** and have enclosed a copy of the Identity Theft Report for your reference. Worth Finance Corporation has received Mr. ****** complaint regarding the account opened in his name. We take allegations of fraudulent activity very seriously and are committed to conducting a fair and thorough review of such concerns.
As part of our standard internal investigation process, we have carefully reviewed the documentation associated with the origination of the account. Our records indicate that at the time of account opening:
-A government-issued identification was presented and verified.
-The account agreement was signed, and the loan terms were acknowledged.
-No irregularities were identified in the application process or payment activity.
Based on our initial findings, we have determined that the loan was opened following our standard procedures and appears to have been opened legitimately. However, we fully understand the serious nature of identity theft concerns and remain committed to protecting our customers from fraudulent activity.
Due to the details laid out above, no internal identity theft investigation was ever triggered on this account. ?Additionally, at no point did Mr. ***** contact Worth Finance claiming fraud, which would have triggered an immediate internal investigation of the account.? ?However, given the consumers assertion this account was opened fraudulently, and the affidavit provided along with this complaint, Worth Finance believes the account meets a sufficient standard for a fraud designation. Accordingly, Worth Finance will undergo necessary procedures to label Mr. ****** account as financial fraud and to make adjustments to our credit reporting in line with this designation.

Worth Finance appreciates the opportunity to respond to this complaint. Upon receipt of this complaint, Worth Finance has conducted a thorough investigation of the account in question.
This investigation has confirmed that Worth Finance has had multiple loans with Mr. ******* including the loan mentioned in this complaint.This includes the most recent loan which the customer is disputing in this complaint. All of these loan agreements have had valid signature, along with contact information, (address and phone number) that matches the contact information included with this complaint. Mr. ******* original loan also included a valid SSN that was matched against national databases for fraud prevention purposes. During the tenure of our multiple loans with Mr. *******Worth Finance employees have interacted with him directly several times,verifying his identity at the time of each transaction, and during these multiple interactions never received any claim of fraud, identity theft, or other indication that Mr. ******* loan was not legitimate.
Unfortunately, due to an extended period of non-payment (through which Worth Finance made multiple attempts to contact the customer), ********************** was left with no choice but to charge off this account as bad debt, as reflected on the credit report screenshots provided. This did not,however, negate Mr. ******* debt obligations, and did not constitute a cancellation or forgiveness of this debt (which would be the appropriate case for the issuance of a 1099-C Form). As such, Mr. ******* debt was serviced by an external servicer, ********* Rush, and Associates in an attempt to bring the account into a recovery status.
In order to validate the debt in question, Worth Finance will be sending a copy of all relevant documentation to the customer, and invite Mr. ****** to reach out to our compliance department by phone *************) or through email (**********************************************************************)to further validate our credit reporting, initiate additional investigations if necessary, and hopefully reach an amicable resolution to the outstanding debt. As a courtesy to Mr. ******* Worth Finance will also remove him from the list of serviced customers from ********* Rush, and Associates, and invite him to pursue the resolution of any outstanding debts with Worth Finance directly.

In response to this complaint, Worth Finance has conducted a thorough investigation regarding Worth Finances interactions with Ms. ****** and her account history.
Our records indicate that Ms. ****** has had multiple loans with Worth Finance, starting from 2017. Her first loan with Worth Finance was opened in our ************** upon receiving a prescreened offer of credit. Ms. ****** opened her account in person, and her identity was thoroughly verified at that time, in line with company policy.
Over the next several months Ms. ****** maintained her credit in good standing with Worth Finance, making on-time payments until she refinanced her account in 2018 in our **************. At the time of the refinance transaction Ms. ****** identity was verified once again. Following this new loan signing, Ms. ****** fell out of contact with Worth Finance and entered an extended period of non-payment. During this extended period Worth Finance never received any contact from Ms. ****** alleging fraudulent activity on her account, and never found any indication of such fraud in our servicing of the account.
However, in response to this complaint, we invite Ms. ****** to reach out directly to Worth Finance Corporation to verify the account details, request an additional copy of all loan documents, and, if necessary, launch an additional fraud investigation.

Worth Finance company is a scam. They sent me a loan check in the mail back in 2022. (I should have known it was too good to be true) with a HIGH interest rate. I have been paying the amount monthly until I lost my job back in 2023. I told them about my situation. They kept calling me about making payments. I got frustrated with the MANY calls I have received. I blocked their number and they called from SEVERAL different numbers. Even harassed my mom to where she had to block them as well. They also came to my home a few times to leave a letter which is pretty much harassment at this point. They were invading our privacy. Theyve also emailed me today, Feb 9th, 2024 and I spoke with a lady over the phone about my situation. She was still wanting me to make a payment and threatening me about taking it to court. She did not allow me to talk and was talking over me when I stated they were harassing me and even came to my home. Then she hung up the phone in my face. She knew they were wrong and didnt want me to say my peace on a RECORDED LINE.Business Response

In response to this complaint Worth Finance has undertaken a thorough investigation of our records pertaining to Ms.******** account and our interactions with her. Worth Finance has policies in place that strictly limit the number of outgoing calls placed to customers. The maximum number of calls placed to any customer phone number is two, with only one message left on the customers primary number. If no contact is made during this primary call, another call may be placed as well with no voice mail left. Our investigation of call records does not indicate any excessive calls made to Ms.******** number. Additionally, Individual Account Representatives have unique extensions which can show up as different numbers on outbound calls. However,call backs to these numbers as well as call backs to the main office number are routed to the same place for customer convenience.
Because attempts to contact ****************** were met with no answer and no call back, we were left with no option but to reach out to her listed references, which included her mother. Worth Finance limits reference calls to once per seven days of non-contact with the customer. Our investigation does not show any breach of this policy in relation to Ms.******** account. Additionally, references can request to be removed from customer accounts at any time. We have no record of such a request from Ms.******** mother.
****************** alleges that Worth Finance sent staff in person to her home to drop letters, however Worth Finance never sends employees to visit a customer in person. ********************** in cases of extended non-contact, will sometimes elect to send letters through the US ************** to try and establish contact with customers. However, these letters are infrequent,and their sole purpose is to request that the customer contact ********************** to make payment arrangements or make a payment through our Online Payment Portal.
Unfortunately, due to an extended period of non-payment, Ms. ******** account was charged off in the first half of 2023.Following this, Worth Finance ceased direct efforts to collect Ms. ******** outstanding debt. However, at the time of this writing, Ms. ******** outstanding debt remains unresolved. As part of its loss mitigation efforts,Worth Finance has entered into a contract with a third-party collections agency, *****************************************************. After confirmation with *****************************************************, we have confirmed that an email was sent to ****************** on February 9th to establish contact and make arrangements to resolve this outstanding debt.
According to *****************************************************,they did receive a call from ****************** on the 9th in response to their email. To substantiate Ms. ******** claims about the content of the conversation Worth Finance requested the recordings of said conversation. At no point in the recording was there any mention by ***************************************************** employees of court or jail time. While it does appear that the employee in question was forced to terminate the call, this was only because ****************** became ****** aggressive and repeatedly interrupted the employees attempts to explain the outstanding balance and options for resolution. According to *****************************************************, they were previously able to establish contact with ****************** on the 7th of February and ****************** hung up on the employee in question when the subject of her outstanding debt was raised.
Worth Finance has repeatedly attempted to find a resolution to this outstanding debt with ******************. While we understand that everyone goes through times of financial hardship, this does not negate the obligations to repay her outstanding debt. ****************** has avoided multiple attempts to contact her and has indicated in her conversation with ***************************************************** that she has no intention of ever paying her outstanding debt.
While Worth Finance disputes several of the claims made in this complaint, given that ****************** has indicated that she has no intention of ever repaying this debt, Worth Finance will ask ***************************************************** to cease collection activity regarding Ms. ******** debt. However, this in no way amounts to the dismissal of such debt or an agreement to remove this debt from Ms. ******** credit report. If ****************** would like to dispute the underlying contract, she may do so in writing to Worth Finance Corp ********************* located at ************************************************************************, by email at ********************************************,or directly to TransUnion. While our current investigation shows this debt to be a valid one, we will be happy to undergo an additional investigation if necessary as part of our obligations under the Fair Credit Reporting Act.Initial Complaint

Upon receipt of this complaint, Worth Finance Corp. conducted a thorough review of the history of ******************** account to confirm the veracity of the complaint in question.
Our records show that ****************** was the recipient of a preapproved credit offer issued by Worth Finance on March 25th of 2022, which was accepted with customer signature and a valid social security number (verified against national record-bases for fraud prevention purposes) on April 7th of 2022. The phone number provided on the signed documents is consistent with the incomplete phone number provided with this complaint, and while this complaint does not provide a full address, the zip code listed is consistent with the zip code in our records.
Our records show that we made contact with ****************** on May 10th, 2022 when she returned the calls made to the numbers provided on her signed documentation, and made the first payment on her account. At the time of this payment, our staff confirmed the customers identity by requesting date of birth, address, and the last 4 digits of their Social Security Number to verify against our records and prevent undue access to ******************* account. No claim of financial fraud was made at this time.
Unfortunately following this payment, we did not receive further contact from ******************, despite persistent attempts to reach her at the number provided and calls to her references (whose information was provided at the time of payment on May 10, 2022). We continued to attempt to contact ****************** for 6 months without response, and at no point in this 6-month time period do we have any record of ****************** alleging fraud or indicating that she did not have a note with Worth Finance. Without a Fraud claim during this period, and with no payment activity, Worth Finance ceased attempts to contact ****************** at the end of November 2022. Our records do show that ****************** has recently been contacted by **************************************, a collections firm working with Worth Finance to help recover payment on Worth Finances severely delinquent accounts. While we do not have record of a fraud claim made to **********************************, Worth Finance will reach out to them to make sure that there have not been any claims of financial fraud by ****************** that we have not been made aware of. Any such claims will be promptly handled by our compliance department.
While our records do not show any request to Worth Finance for a contract copy from ******************, we will gladly send one to her for her verification. Worth Finance takes financial fraud very seriously and if ****************** believes herself to be the victim of identity theft (and that the payment previously made to her account was by the perpetrator of said theft),it is our sincere desire to help her resolve the issue quickly. Upon receipt of this complaint, Worth Finance conducted a thorough review of the history of ****************** account to confirm the veracity of the complaint in question. Our records show that **************** was the recipient of a preapproved credit offer issued by Worth Finance on July 16th of 2021,which was accepted with customer signature and a valid social security number (verified against national record-bases for fraud prevention purposes) on July 30th of 2021. The phone number provided on the signed documents also matches the phone number provided with this complaint. Our records indicate that over the course of 6 months from the opening account, ********************** attempted to contact **************** multiple times through both Phone and Mail correspondence,with little success. However, our records do show three discussions with **************** on 10/26/2021, 11/05/2021,and 11/15/2021 in which **************** indicated a willingness to pay on the account, although ********************** never received said payments. At no point in this 6-month time period do we have any record of **************** alleging fraud or indicating that he did not have a note with Worth Finance. Without a Fraud claim during the full term of the note, and with no payment activity, Worth Finance ceased attempts to contact **************** in February of 2022.
While our records do not show any request for a contract copy from ****************,we will gladly send one to him for his verification. Worth Finance takes Financial Fraud very seriously and if **************** believes himself to be the victim of identity theft, it is our sincere desire to help him resolve the issue quickly. I have been receiving mails from Worth Finance Corp that i owe them money from past few days. I have been disregarding them thinking they might be Fraud. But when i checked my credit report, i see that it has impacted my credit too. The letters say that i took a loan of 1500$ , which they say that have made a cheque to me. While we did receive a signed acceptance of our initial offer, after getting in contact with **************** it became evident that this signature and the attached information was fraudulent. As a result, Worth Finance has undertaken its fraud mediation procedures and taken the necessary steps to remove any effects from her credit report. Worth Finance will also cease contact with **************** aside from any continuing correspondence regarding our fraud remediation procedures. She also will not receive any further solicitation from Worth Finance in the future to avoid any further issues. I paid off this loan in July 2022, they never sent me a receipt or anything indicating I owed $17. They are now calling after 9 months saying I owe $530 because that $17 accrued interest and since technically I was not due to make a payment they didnt have to inform me until I was due. This is criminal practice and I want the account closed of off my credit report immediately.Business Response

Worth Finance Corp is very sorry to hear that there has been a misunderstanding regarding *********************** account balance. Upon investigation our records show that our staff requested customer contact in July after taking payment from the customers spouse. In the interim, there appear to have been multiple attempts to contact **********************, but none were successful. After sending a notice letter to ********************** in mid-April, we have been able to make contact with him and walk through the scenario concerning his account. We believe that we have made appropriate arrangement with ********************** and he has acknowledged that he would be taking care of his remaining balance on the account in question. ********************** is happy for the opportunity to work with **********************, and we will endeavor in the future to pre-empt such misunderstandings.Customer Answer

This company keeps calling me explaining that I owe them money for a loan I never approved or applied for. I never requested a loan from this company I've explained this to them everyday (because they call everyday) my credit doesn't show any inquiries for a loan. We are very sorry to hear that ****************** appears to be the victim of financial fraud, following our extension of a credit offer to him. We received a signed acceptance of the offer in question along with Mr. ******** *** and a relevant phone number. After verifying the *** against national reporting databases, we confirmed the loan in question. Only after getting directly in touch with ******************, did any evidence of fraud present itself.While we had initiated fraud procedures with ******************, it appears that contact was lost with him while processing his fraud claim, which held up the full purging of his information from our system. Because of this, his account appeared as delinquent in our internal tracking systems, leading to calls by collection staff. However, after additional investigation we have determined that Mr. ******** claim of financial fraud meets our minimum requirements to remove from our system.
