      I had gotten a car from them and I only had the vehicle for like 6 or 7 months and 4 months out of that the vehicle was not drivable Ive contacted them to let them know and instead of them trying to help me they came and gotten the car and put it on my credit after I contacted them about the credit report they were saying that the car was repoed but I was still paying my car note for the vehicle before they came and gotten it

      My vehicle was ******* was given a piece of paper that I was told covered liability on this vehicle. I called the phone number and explained the situation & was immediately hung up on. I advised that the policy holder was not driving the vehicle. I called back and spoke with a lady this time, and was told there was nothing that she could do to help me. If this is supposed to be the insurance company for this vehicle, why can't they help?? I want my car fixed!!!

      purchased a 2008 **** Mustang Deluxe 4.0L V6 Coupe (VIN: *****************) from Midpoint Auto Group on November 18, 2024, under the assurance of a clean blue title and the expectation of receiving a safe, roadworthy car.After the purchase, I discovered significant structural damage consistent with a prior accident that was not disclosed. The car has a compromised frame, unsafe alignment, and signs of poor repairs. These issues were evident during inspection, yet the dealership's shop failed to disclose or address them.I reported these concerns to Midpoint Auto Group and was told to take the car to their shop again. Despite my safety concerns, no resolution was provided, and I was offered a trade-in that would forfeit my $2,500 down payment. This is unacceptable given the extent of the undisclosed issues.I have also invested over $700 in upgrades, including a remote start, security system, lights, and tint, before discovering the severity of the vehicles condition. A review of the car's history shows it likely sat idle in ******** with ****** miles, likely due to the accident damage.Desired Resolution:1. Replace the vehicle with a comparable one in safe, roadworthy condition, or 2. This agreement explicitly states that no warranties are provided, and the vehicle is sold without any guarantees regarding its condition, including its structural integrity or prior history. We do not require that the vehicle be serviced at our dealership, and we do not offer refunds for purchases under the terms of the agreement.
      While we regret that you are dissatisfied with the vehicle, we stand by the sale in accordance with the contract's terms.       I am rejecting this response because:    My issue isnt about the as-is saleits about the dealership misrepresenting the car.

      1. The dealership claimed the car had no prior accidents, but it has significant frame damage and signs of a rear-end collision.


      2. It was sold without a horn or brake lights, making it unsafe and illegal to drive.


      3. I was promised all issues would be fixed and that I could trade the vehicle in after 90 days, which has not been honored.



      This is fraud, not buyers remorse. Since no resolution has been offered, Ive already escalated this to the Texas Attorney General and will continue to pursue legal action if necessary.

      On Saturday 11/23/24 my car was repossessed for being 1 week late on my car note (I pay my car note every 2 weeks) the past 2 car notes I had paid my car note a week late with no repossession, prior to repossession I was being harrassed, phone calls multiple times of day, text messages, and even emails to which I did not respond to because according to them since my account was so "new" less than 3 months old that I could not make a promise to pay or payment arrangement so I felt there wasn't anything to talk about, fast forward I call asking how much I would have to pay to get my car back I was quoted $580 and told that I had to be "approved" to get my car back (I've NEVER heard of anything like this it isn't in the contract either just something they made up for their "policy" that they can't show in writing) I made them aware over the phone and in person that if I make my payment that day that I was leaving with my car and I did just that made my payment through cashapp (Should've known the place was janky when they accept cashapp and zelle as forms of payment) after making my payment I went around to the back found my car and drove off of the lot. They reported my car "stolen" I was stopped by the police and let go because everything was in my name and there was nothing they could do about it because it is not a criminal matter it is considered a civil matter . On Thursday 11/28/24 Thanksgiving Day they towed my car again from my job in the middle of the night (I work overnight) in which I wasn't able to speak to them until Friday morning 11/29/24 I called asking why my car was take SKY the collections manager basically told me it was because I didn't have "approval" to take my car (after I had told them if I made my payment I was taking my car the same day) and that it was a "waste" because now I'm not getting my money back or my car . There is alot more but I'm almost at my word limit

      I bought a vehicle when we test drove it the seat was broken and it was ticking the lifters were going out I told the sales men he said bring it back and they would fix it Fixed the seat told me Id have to pay for the lifters due to it being an as is lot you dont price a used lemon at ****** lets make that clear My radiator and my thermostat housing unit went out two months after me having the car infuriated I demanded it be fixed again not having it long enough to justify this big of a problem They always take longer to fix my car then necessary the last time I had to have it fixed for the same problem my push start button was stolen out of my car then they shipped me the part and told me to install it myself I get into an accident in early September they dont have an emergency number for their tow services after hours so we had to wait they waited 4 days before the got the car then tell me 500$ and they will start fixing it I pay that completely and then they tell me I have to pay for the impound fee they paid to get my car out of the impound 1200$ I tell them thats insane thats what I have insurance for and I had already been assured it would be removed by insurance. They refuse to work on my vehicle messages the service department and has them stop work on my vehicle until its paid granted my deductible is already paid in full I just havent paid the 1200 for the impound they let my car sit there for weeks until I come up with the 1200 I pay it on October 15th my vehicle was then moved to a 3rd party auto body shop and they will not give me the vehicle back the service department has blocked my number and refuses to give me an answer about where my car is exactly and when I can get it back just basically **** it up and youll get it when you get it. No loaner has been offered I have been without my car two months and paid every payment in full and on time since the accident.

      I bought this car and was never told it was in a wreck. There is bondo on the trunk and spray paint. A wheel is bent and the suspension is also damaged from the previous wreck it was in. We have called and called to try to get it resolved and their response was always we will call back. No call backs were received. We then told them we were returning the car. Then after all that they still pulled money from my husband's account.

      I got car from midpoint auto July 25 ever since then my car been in and out the shop . Then my car have gas leak on my engine

      Purchased vehicle. Has broken down several times and it's under warranty. Paid $600 for them to fix it and it broke down. They refuse to fix it or replace it. Is there a lemon law?

      Wed like to clarify a few key points regarding your recent repair. First, we do not offer warranties on our vehicles, which is explicitly outlined in two separate documents that Mr. ********** signed when purchasing the vehicle. Additionally, we worked with him to ensure the necessary repairs were completed in a timely manner. Despite the issue being caused by an outside factor at his residence, we did not charge him upfront and even financed the repair to ease the burden. The vehicle was repaired within a day, as we strive to assist our customers in every way possible.
      As a returning customer, its unfortunate to receive this complaint. However, we stand by our policy of selling vehicles as-is, as agreed upon at the time of sale.

      Midpoint Service reset check engine lights to get their cars past state inspections for titles-that is against the law, its fraudulent, and a deception of practice by doing so. If vehicles cant pass state inspections, you are not obligated to be bound to any buy as is clauses within their contracts. To have them investigated and audited, these complaints should go to the tax commissioners offices with proof of failed engine tests within the first 30 days of purchases. You can request their audits go back several years and include the profiles of all buyers of cars by reaching out to them as a part of the investigation. ****** is the company they use to finance cars and repairs on lemon cars. **** ******* is the service shop owner. An audit and investigation of his business practices and financial records can be requested as well. Legal actions can then be taken under all 3 accounts, seperately, and then together as class action suits under the state of TX, also requesting that the owners of all parts of the company not be allowed to do business in the state of ** again.

      Allegation of Resetting Check Engine Lights for State Inspections:
      Midpoint Service operates in strict accordance with all local, state, and federal laws, including those concerning state inspections. We categorically deny any practice of resetting check engine lights to pass vehicles for state inspections. This allegation is not supported by any factual evidence, and we maintain that all vehicles sold undergo proper inspection processes by certified professionals.
      Buy As-Is Clauses and State Regulations:
      Our contracts, including the "buy as-is" clause, comply with the laws of the State of Texas. As with all vehicles sold under this clause, the customer is responsible for conducting their own due diligence prior to purchase. There is no legal basis for the claim that failure to pass a state inspection negates the validity of the buy as-is agreement.
      Request for Investigation and Legal Action:
      The suggestions for audits and legal actions are speculative and based on accusations without any proof or documentation. We welcome any lawful investigation or audit into our business practices, confident that they will confirm our compliance with all applicable regulations.
      DalTex Financing and Allegations Against Affiliates:
      The customers reference to ************** and its role in the financing process does not involve any deceptive or fraudulent activity.
      In conclusion, the accusations in the complaint are without merit. We stand by our commitment to providing honest, transparent services to all our customers. As such, we are unable to offer a refund or any further concessions based on these false claims.

      I am rejecting this response because:   
      1. What Midpoint/***************** does not advise customers before collecting down payment, is their Buy Here Pay Here is where they stack interest rates.  In other words, the down payment made is not subtracted from the total price (Sales Price and taxes), but instead they take your down payment, double the amount, add it to the backend of the loan, which in turn increases your overall price instead of lowering it.  How they get the 2 interest rates? You have the interest rate incorporated into the contract price, AND then a DAILY INTEREST rate.  The Daily Interest rate is whatever the percentage is from the doubled down payment they add to the backend of the loan; typically a matching, if not higher than the principal loan payment. 

      2. When you make your bi weekly payments, like any car loan, you have a principal and interest payment, which makes up the overall payment.  What DalTex Finance and Midpoint does (and I say they together because DalTex is still Midpoint Auto) is, they collect the principal payment (which is the contracted payment that makes up the sales price and interest) AND THEN, the interest payment they collect is their DAIlY INTEREST.  Keep in mind, these are bi weekly payments, so they do this twice/month and what this does is give them a system leverage of charging you double the payment you should be paying, but hide how they charge the daily interest rate, for legal/deceptive practice proving purposes. What this in turn does is, extends the loan 2x what it should be; a tactic used to incorporate their daily interest gains into the contract.

      3.  This daily rate is an option they choose, unless sales are down, then they use a method of not changing the price as a sales tactic. 

      4. The Shopping/Sales tactic: The Sales *** gives you a price verbally. This is not to determine your down payment, but more so of which car they COULD convince you purchase, usually different from what you have interest in.  Then they use the strategy of getting more out of you for down payment instead of hinting their whole $1000 down guaranteed slogan.  If this occurs, theyd typically charge your $2500-3500 for cash down payment.  Keep in mind, their ultimate goal is to get you contracted to where regardless of what car your purchase, they sell it at $15000 starting off, and this is before they take your down payment, multiply it by 2, then add it on top of the verbal sales price and taxes (to get their daily interest charges incorporated in the contracts)so they add this deceptive amount instead of subtracting it, and then place it at the end of the loan. 

      5. Buy AS IS.  They give you a 30 day warranty. With any used car, it takes for it to be driven past 1500k-2000k miles to detect the true malfunctions of the car after the check engine notifications has been reset. Instead of fixing these cars before Midpoint sales them, they sell them as is/how they buy them from auctions.  Most of their cars come from ******* or **, flood zone areas where cars are sold for less than $2k in auctions after catastrophies. These are Lemon Cars; cars paid off by insurances and sold for profit at auctions.  Midpoint is what bigger banks would label as a red dealer; where theyd flag their business information to prevent them from contract buyers for loans from more established banks.  This is why they sale on But here, Pay here. What their service team does is, purchase parts from **** or a junk yard, IF they actually do any discovered needed repairs.  Their service shop makes their money by keeping the mechanical issue ongoing   In other words, they stall and/patch up their work in an effort to have the same issues in need of repairing past the 30 days.  When setting up an appointment, their system is setup to advice you that they will need to keep your car, and it then prompts you to agree to leaving the car with them (usually for days) before you can actually set the appointment   This is how they stall the repairing needed, getting you closer to the 30 day warranty end date. When repairs are done and if youre not smart enough to record all conversations, get invoices for parts they claim takes a week to order and receive, then what happens next is the charge you for the repairs and allows you to finance the billing (another way to collect more interest off the billing price).  What they then do is tag your billing to your car payments, where you are then charged more interest that goes towards their daily interest charges; this tactics is used to manipulate the numbers so that it wont appear illegal or deceptive. They DONOT allow you time to take their vehicles to dealerships to have the diagnostic readings done appropriately because they set a time limit as to how long you can text drive a car. 

      6.  When buying the car, Sales quote one price and tell you they are submitting everything into the system to get your contract done.  What they then do is collect your down payment before giving you the contract to avoid losing you as a customer once you discover the numbers dont add up.  Being a buyer in desperate need of a car, they deceive you into thinking they are doing right by you, take your hard earned money, to then keep you binded to doing business with them.  Why?  Because at that point, all of your hard earned money is in your possession, you have no ability to walk away and shop elsewhere, because they have your money.  If you asked for an immediate refund, instead of reversing the payment immediately, they make you wait ***** days if not longer; a tactic used to force you to take the car and the contract.  They do not have DalTEx go over the **** section of the contracts prior to your signing, which i discovered is illegal and also deceptive.  

      I will only post 1 piece of my evidence because I cant post others as I plan to use it for other actions. Im sharing this information in hope that others would come forward and to educate others on the buying experience had before they buy from this business   At least buyers would know what they are up against. 

      The picture proof Im sharing is 1 of many where a sales representative explains the will sell you a car without changing the price.  It will only post if BBBs site excepts the size of the picture.  But I dont mind sharing it under review of the dealership.  Changing the price is what they do in contracting phase: ex, Sales tells you one price, but that price increases on paper.
