    Business Response

    Date: 07/26/2024

We have been in contact with the customer on site, via phone/text and also spoke with her husband in regards to the well. The customer confirmed that we had spoke to her and her husband on multiple occasions via a recorded call on 7/18/24. I have included a copy of the contract signed by the customer which states, among other things, that:

2.4 Safety: Water Well Drilling Contractor shall be responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with the performance of the Work and shall comply with all applicable laws, ordinances, rules, regulations, and orders. Water Well Drilling Contractor shall take all reasonable precautions for safety of, and shall provide protection to prevent damage, injury, or loss to a) persons who may be directly injured during the Work, b) the Water Well and materials and equipment to be incorporated therein, and c) any other property and improvements at the site or adjacent thereto.

    5. SCHEDULE OF WORK.
Construction shall begin by TBD [date] and shall be complete by TBD [date] excepting delays beyond Water Well Drilling Contractor's control. "Complete" shall mean that the Water Well is ready for the installation of the permanent pumping system.

Due to mechanical failures of the drilling rig and inclement weather including a hurricane (7/8 thru 7/14 flooding, storm damage and power outage) which caused safety issues and weather delays for the crew operating the rig. We had to order custom made parts to repair the rig which took time to arrive but we continued to work on the rig onsite and communicated with the customer throughout. We can only give estimates of when jobs could be finished. When you are drilling 300’+ underground you can’t possibly know what issues you will run into. While this job has taken longer than we originally anticipated we could not foresee the weather, hurricane or hitting layers of rock while drilling which can take days to get through.

The contract still remains in effect and is complete once the casing is set and the well is ready for the pumping system. We completed the drilling today and will be setting the casing. We have communicated with the customer via recorded call that we anticipate the pump and tank to be set by the end of the weekend weather permitting. The ground is still very wet from all the rain this past week which may delay pouring the slab which was also communicated to the customer.
