Dear Better Business Bureau,I am writing to formally file a complaint regarding the ongoing issues caused by the Texas Disposal System Landfill in Austin City Limits. The conditions at and around the landfill have been creating serious environmental, health, and safety concerns for the community.Unpleasant Odor Every Thursday night, a strong and overwhelming smell, similar to sewer gas, spreads throughout the area, making it difficult to be outside or even keep windows open.Air Quality Issues The air often appears foggy, particularly on Thursday nights, raising concerns about potential harmful emissions.Trash Spread Throughout Neighborhood Due to high winds, trash from the landfill is frequently scattered into surrounding areas, including residential neighborhoods, creating an unsightly and unsanitary environment.Rodents and Wildlife Mice and other wildlife, likely attracted by the landfill, are now commonly seen in broad daylight, posing potential health and safety risks.Rabid and Dangerous Wildlife There has been an increase in sightings of rabid deer, coyotes, and other potentially dangerous wildlife in the area, likely due to the landfills conditions. This poses a serious risk to both residents and pets.Vehicle Damage from Road Debris Trash and debris from the landfill regularly litter the roads. I personally experienced a flat tire due to debris on the road, which caused an unexpected expense and inconvenience.These issues have been persistent and negatively impact the quality of life and safety in our community. We urge the BBB to investigate and take action to ensure the landfill operators comply with environmental, health, and safety **************: Austin is growing at rapid pace and landfills are at max capacity, Build new ones but this one is full. While Texas Disposal Systems Landfill (TDSL) takes the concerns of our neighbors very seriously, we dispute that **** is the source of the conditions complained of, if such conditions exist. We can confirm that no such conditions exist on the property within the 1.5 mile distance between the complainants neighborhood and the landfill facility.
The TDSL facility does not create conditions detrimental to environmental health and safety. On the contrary, TDSL protects and ensures environmental health and safety by responsibly managing waste and recyclables in a manner that does not have a negative impact on our neighbors property values, their quality of life, or the environment in general. We would be glad to host representatives from the Better Business Bureau to visit our site and see the conditions for themselves.
Our facility has won many awards, including being recognized as the best managed landfill in North America by the *********************** of North America. Our facility is regularly inspected by the Texas Commission on Environmental Quality, and has not received a single violation in over 25 years. We are proud of our operations, of our contributions to keeping Central Texas clean, and of the excellent relationships we maintain with our neighbors. Paid for 3 months service at ****** (12 pick **** and was missed twice. Asking for 1 week refund since first miss was due to missed/late payment, but second miss was paid in advance several days prior to missed pickup and has already been processed through the bank. basically asking for refund of ***** for 1 missed pickup that was paid for in advance. I still paid for the missed pickup due to late payment, but am willing to forgo that payment since it was made late, but I would like a refund for the week that was missed after payment had processed which roughly equates to ***** (******/12).Business Response

We have placed a one time courtesy credit on Mr. ******** account in the amount of ***** since he was unaware of the time an on line payment could take to process but now has been informed for the future. Mr. ******* was advised when he called in on 03/102025 by the representative that he spoke with to call us directly when making late payments on line so that we can prevent the account from remaining locked for non payment. On line payments take longer to post and for the bank to notify us that the account has been made current so that we may resume service.

I received a email from my HOA stating Texas Disposal Systems had a Christmas tree recycling. On the website page for the Christmass tree recycling it states if everything is not removed from the tree they will charge you $55. But when I got there my tree was secured in the bed of my truck with my tailgate up. They proceeded to tell me my tree wasnt secured and that I would have to pay $35. I had a string in the back of my truck but it had broke, but my tree was completely secured in the back of my truck with the tailgate closed.Nowhere on the site page for the tree recycling did it say they will charge $35 if it it not tied down. This is from the site page.Trees and decorations must be free of flocking, lights, ornaments, metal, and other non-living contaminants. A $55 contamination fee will be assessed for trees and decorations that have not been cleaned. When bringing loads for drop-off, please ensure that materials are properly tied and secured to your vehicle, per Texas law.I paid it and went drop the tree and the checked the site again before going back to the check in. I got back and spoke with someone and told him nowhere does it say I would be charged $35 it there is no tie down. I said it is secured and I feel like this is left off the site as a way to secure more revenue and I said this isnt fair and he said oh well, and yet you are still here as in to say I have no options and they dont care that they are just trying to take as much money from people. I am looking into removing my service and disposing of my own trash after this experience.Business Response

In reviewing Mr. ******* complaint and our website for Christmas Tree Recycling with Texas Disposal Systems, ************************************************************************************** it has an FAQ. Below is one of the questions and answers, at the end it states "When bringing loads to drop off, it is important to ensure the material is properly tied and secured to your vehicle, per Texas law.As you enter the premises to the landfill we have three (3) signs posted titled "Regulations" in capital letters at the end of the first sign it has "ALL LOADS NOT COVERED OR SECURED ARE SUBJECT TO $35.00 SURGCHARGE." The third sign is at our gatehouse where payments are taken and the sign is labeled "Please make checks Payable to TDSL" and the last bullet states "Regulations Require us to apply surcharges on all loads not covered or secured properly, the surcharges are as follows and it list the cost."
All customers are aware of these charges by our gatehouse attendants and have an option to choose whether or not they want to pay the charges. In this situation, Mr. ****** was advised of the charges.

Texas Disposal has notified us of ending service in our residential neighborhood by email. I reached out to them to ask when and how we would receive our security deposit back. ******* and ******* now say it is a start up fee and won't be refunded. I explained that this was not the explanation given to us when we originally requested service. That we could not use our own can and therefore were required to apply the deposit as well as pay in advance for services rendered.Texas disposal has added fuel surcharges over the years for increased fuel expenses but have never removed such surcharges when the prices of fuel have dropped. We will obviously be acquiring a new service provider but would like to at least have this matter settled before moving on.Business Response

At the time of the start of this account (08/11/2010) the statement paid at start up was $95.38. This included an invoice that was for the $76.70 for the prorated month of August, September and November. A second invoice for a residential one time set up fee of $18.68. We do not charge deposits for our trash carts nor was there a charge applied. A cart was delivered on 8/12/2010 with no fee attached.
The next payment made to this account was on 11/16/2010 for November, December and January ******** We continued to bill quarterly for the next fourteen plus years.
I see that we did have a conversation with the account ****** **** in February of 2015 and she inquired then about having the fuel charge removed and it was explained to her that it will fluctuate but is part of the fees attached to ********
We can not issue a refund of $75.00 for a deposit as one was never collected or issued.

We are in the process of emailing the Charge Detail in question of Mrs. ****** start date. It clearly shows that on 8/11/2010 we started services with a proration from 08/18/2010 through 10/31/2010. The cost for services for that period of time was ***** plus fuel and tax and a residential set up fee of ***** plus tax for a total of $95.38. We have provided all of the information that we can and are confident that no deposit was charged for the trash cart as we have never charged a deposit for residential services.

I was driving on **************** (****, **) around 9:55am 9/23/2024. I saw a TDS garbage truck had no trunk cover for the trash, and the trash was falling from the trunk all along the way. I almost hit a card box that fell from the truck. While driving alongside the truck, I saw plastic bags, trash bags full of trash and aluminum cans fell on the road which is very dangerous to other drivers.I hope the driver should be punished for the reckless trash transportation and TDS needs to add cover to all the trash trucks and trains their driver to close the cover when driving.Business Response

I have weekly trash pickup from TDS. 4 times on the last 4 months they have not picked up my trash. I had it on the curb early like they ask and have told them about it 3 times now. I believe since I am not receiving the service I am paying for, I should be refunded a portion of that. TDS has been notified numerous times by phone (04/19 & 05/28) and, twice in writing (06/04 & 06/24) to cancel the service and refund my payment. We did research any documentation that we have associated with this account and have no receipt of any mail requests of closure. We also researched both phone numbers that we have on file for this account for any incoming or outgoing calls. We have not had phone requests for cancellation from the phone number on this complaint or the phone numbers on the account. We did go ahead and cancel this account and issue the refund via the payment method of check. We left a message for the account holder to please reach us back and confirm mailing address for refund. We also left a message for TDS carts to be placed out curbside so that we can pick up our TDS carts and finalize termination. We have since heard back and the mailing address for refund has been confirmed.

Texas Disposal Systems, **** (TDS)received a complaint regarding a trash miss at *********************************************,Texas. The customer is considered a contracted type between the resident, **************** and TDS. ****************** began service with us on May 11,2022.
Our records indicate we received a complaint notification on March 7, 2022, advising that TDS did not service the trash on Wednesday, March 6, 2024. ***************** was advised that her cart was overloaded, based off of the picture taken on date of service the lid of the cart was open quite a bit.
Due do safety reasons, the drivers of our automated trucks are not able to service carts with bags of trash that is not contained within the cart. These carts are lifted approximately 13 feet into the air to be emptied into the ******. To avoid potential safety issues, we cannot service overloaded carts.
Our representative explained our guidelines and advised that we would do a courtesy of swapping out of her trash cart and replace with an empty. We also advised her to remove the additional bags. Work order was entered to do the swap, WO #******. According to the pictures on the work order we completed this request on Friday, March 8th at 8:00 AM. Our rep reached out to ***************** and it was confirmed that the cart swap was complete.

On Monday, January 8, Texas Disposal Systems arrived at my home to attempt to pick up recycling on our scheduled day and while it appeared they had done so, there was actually more waste left in the can than placed inside it originally. When I contacted them to return to re-service the address, the customer service associate attempted to contact the truck in the area and take care of the problem. I was later in informed that the truck refused to do so as what we are saying occurred was not possible. I then talked to a supervisor, who was of absolutely no assistance and continued to refuse to help with the problem at hand. I am now stuck with waste that is not mine until our next scheduled recycling day, which is in two weeks.Business Response

Texas Disposal Systems regularly comes at all hours of the night (eg 3am or 5am) and wakes me up. They are picking up right next to a residental (MF) zone, and all the buildings in earshot are residential buildings. I have called them several times and they refuse to even attempt to request a later pickup time. While it seems it isn't illegal for them to pick up at those times because the property they're picking up from is in a commercial zone, its incredibly disrespectful and selfish of them to frequently and repeatedly wake people up in the middle of the night. They clearly don't care about people at all. They're a disgusting and shameful company.Business Response

Service times for both trash and recycling begin at approximately Midnight and run until the drivers are finished with their route or run out of allotted drive time. We have many requests for specific service times that conflict with each other such as this instance where we are not to be at multiple other stops after 6AM. The trash is currently on a route that runs from 6am to 3pm however that is subject to change based on route configuration. The recycle route is subject to be serviced at any time.
While TDS takes all complaints very seriously and tries to be as accommodating as legally, reasonably and commercially possible, to the extent the Austin Noise Ordinance may be exceeded by the decibel levels in question in the complaint at hand, the City code does provide affirmative defenses to the Noise Ordinance for waste haulers --including under 9-2-3(B)(1) -- to equipment and devices being loaded, unloaded or serviced in compliance with other applicable City codes, such as those regulations permitting trash collection in the City by commercial-container haulers.

I am rejecting this response because: they provide absolutely no compromise or remedy, but again simply brush this off saying they're legally allowed to disturb people's sleep and don't want to put any effort into improving the situation. This is not the answer of a company that cares about the community. This is the answer of a greedy faceless company that is perfectly happy to wake up tens of thousands of people every week because it saves them a few dollars.They said "we are not to be at multiple other stops after 6AM" - what relevant "multiple other stops" do you mean? Why is Texas Disposal not able to serve these stops after 6am? Are you implying that some customers have requested that you come *before* 6am? Why? Without more info, this doesn't make any sense. If the trash pickup is already done between 6am and 3pm, why can't recycling come in that time frame as well?
To me, this response only solidifies my belief that Texas Disposal doesn't care about people. This non-reponse with no attempt to offer any kind of remedy or compromise is shameful and disgusting.

I am rejecting this response because: This is in content not at all different from their first response. They tell me A. they have no legal responsibility to be a good citizen in this respect B. they receive lots of these requests and repeatedly deny all or most of them, and C. they're unwilling to pay whatever costs would be required to not wake people up in the middle of the night.Its all standard brush off corporate BS. The bottom line is they don't care about me, they don't care about the community, and they don't want to incur any costs at all, but are willing to place costs, in the form of audible disturbances during sleeping hours, onto the community. This is very clearly immoral behavior and economically inefficient behavior.
Texas Disposal Systems continues to show that their moral character is of a similar quality to the material they collect profesionally.
