      On March 28th, this company was doing road work in our neighborhood for the City of Fate. The road construction was right outside of my house where they used equipment that pounded the ground to break of the existing concrete. Due to the constant pounding and vibrations this machine caused, we had quite a bit of damage done to our tile flooring. I contacted the city manager of Fate and made him aware of this and also sent pictures of the damaged tile and pictures of the work that was being done on one side of my house. The company sent someone out to check but they never came to my house and only looked at the road work and sidewalk. They said there was no damage and that was it. I called and left a voicemail for the company to return my call so I could get their insurance information to try and file a claim, that was on April 6th after getting the companies information from Scott Monaghan who is the Public Works Director for the City of Fate. They never called me back. I made Mr. Monaghan aware and he sent them an email as well on the same day but they have yet to contact me to make things right. All I want is for our tile to be replaced. I have leftover tile since the house is only 3 years old, but they don't want to try to make it right due. I have pictures I can provide if needed.

      Business Response /* (1000, 5, 2022/04/14) */ First off, the complainant is not a consumer in this case, nor is he our customer. Our company is under contract with the city of Fate to perform street repairs at many locations throughout the city. This work cannot be performed without breaking out the damaged streets and thus causing some vibrations. The city, our customer, acknowledges this and has verbally communicated to us that we have done nothing we were not required to do under our contract. We used this same equipment in front of dozens of other houses in this particular neighborhood that were actually much closer to our work areas than the complainant's house was. His house was twice as far away from our work area as these other houses were and none of them reported any vibration damage. We've used this same equipment in front of thousands of houses with no reported damage in the past. This complainant suggests that his tile was cracked due to our equipment, and that all he wants us to do is pay to have his tiled replaced. But it is our opinion, based on the images the complainant has provided, that his tile cracked due to foundation movement of his house. And if we volunteer to help him repair his tile we will be admitting that we caused the damage, which we do not believe we did, just because he says we did. We suspect that once these tile are removed it will show that his concrete foundation below the tiles is cracked due to soil movement, which is very common in this area, and then he would be expecting us to repair his existing foundation problem. And we are not going to voluntarily put ourselves in that position of liability. This is a fairly new neighborhood. You can view some historical aerial photos of the neighborhood online and note that the complainants house was built over the deepest part of what was a creek that ran through the overall property, that was probably filled in prior to house construction. We suspect that that fill is now settling and causing his foundation problem, and the cracked tile is the only indication he can see from inside his house of what is more than likely a cracked house slab below. And even if this tile is replaced it will again crack once the house slab crack continues to expand due to the soil movement below it. He probably has a problem, a bigger problem than he realizes, but it isn't a problem caused by us just because he says it is. And we have no plans to voluntarily pay to discover and address it. I did get with the City of Fate and they told me to get with you, the company. Just because no one else has reported any issues of damage to their homes, does not mean that it will not happen. We had no tile damage until you started working on our street and with the repeated pounding of your machine, caused major tile damage to the front portion of our house. There are no other signs of cracked tile throughout out house except for the area that is in front section of our house and happened on the same day as your work. If you believe it cracked due to foundation movement, then it was due to your companies work done to our street. Furthermore, you purposely refused to return my phone call where I left you a voicemail and you purposely refused to come to my house and look at the damage and instead looked around the street and sidewalk where that was not where the damage was. If needed, I will seek other action because this is not something we, as a homeowner should be liable for when it was caused by your work on the street. This is exactly why we didn't volunteer to help him repair his tile. If they pull his tile up and find a cracked slab below, he could try to blame that on us as will. When if fact its the other way around. Out of that whole, relatively new, neighborhood why did we only repair the street near his house. Why did just that section of street crack and fail? Streets are supposed to last for 25+ years, but that section of paving near his house has had to replaced twice in just under 3 years. Streets are constructed to much heavier duty specs than house slabs. Both the street and house / tile cracks are probably due to soil movement in that corner of the neighborhood. The same fill thats under the cracked and failed street is under his house. We certainly sympathize with the guy, just not to the extent that we are willing to pay to fix his foundation problems. If he has an issue with anyone it should be the developer that built his house, and the original street, on fill material. If you actually read what I said, no where does it say I am now claiming IF I have foundation issues. You were the one to indicate that I may have foundation issues, I only stated that if in fact YOU believe I do, it would be due to your companies construction on the street. I did not have any issues whatsoever until your company started work on the street and I know for a fact I do not have any foundation issues. The only issue and complaint that we have is that the tile in our house was damaged due to your machines constant pounding to break up the concrete. While I know that is your normal process, this normal process caused damage to our flooring, which mind you, I have stated with the city that I actually have extra tile and grout, all I was asking for was someone to help pay for the repair to the broken tiles. I am not responsible for the street, I only care about my house which I have not had any issues with until just a few weeks ago when the pounding started. Just so you know, I work at home and was here during the time your guys were working. When they started pounding the concrete, after about 30 minutes of the constant vibrations, it sounded like glass was shattering in my office where I work. That is when I noticed the cracked tiles that started from the window of where I work that faces the street and went all the way into the hallway. Then I noticed several more cracks that was not there before. I'm sure you don't feel responsible for any of your work and damage your company causes. I am also aware of my neighbor across the street where he has filed an issue where your company cracked his driveway with your work and machines, but I'm sure you believe that is not your companies fault as well and blame that on soil movement and fill material.
