    Pattern of Complaint:

    On August 24, 2023, BBB notified Francesca’s Element LLC of concerns in consumer complaints regarding the company’s marketplace practices.

    Specifically, BBB identified a pattern of complaints where consumers alleged that Francesca’s Element LLC:

    • Was paid in advance (and/or in full) for a service that has not been received/completed.
    • Notified the consumer via email that it was ceasing all operations, and no refund would be issued.
    • Did not return the consumer’s dried flowers and/or belongings after the business announced its closing.
    • If the consumer did receive their items (flowers/accessories) back, they were unusable to be preserved by a different company.
    • Consumers have not been refunded by the company and/or their bank.

    BBB requested the company's voluntary cooperation in eliminating the identified pattern in consumer complaints by providing a written response outlining the steps the company will implement to avoid future complaints of the same or similar nature.

    BBB confirmed via the Texas Secretary of State website that Francesca’s Element LLC was voluntarily dissolved on August 31, 2023.

    Francesca’s Element LLC was not responsive to the consumer complaints nor any of BBB’s inquiries regarding the pattern of complaints and the investigation was closed as ‘Failed to Respond’ on 10/17/2023.

      My name is ***************************** and I am filing a complaint against *********'s Element in ****** *****. I first contacted *********'s Element in September of 2021. I came across their business through a ******** ad. I looked into their work, which was preserving flowers, specifically for my wedding. I was VERY impressed with their work and timely responses. I decided to move forward with their business of preserving my wedding flowers. I spoke to a live person from the business and set up payments to have my flowers for my October 2023 wedding preserved. I was given instructions about how to ship the flowers down there, etc. I was making payments every month from September 2021 until June 2023 for my flowers to be preserved after my wedding this year (October 2023). I have paid *********'s Element a total of $819.23 (including sales tax) to this day to have their services provided in advance. On July 31, 2023 the business sends an email that they must close their doors and cannot provide services to people that they have accepted money from due to unforeseen circumstances. *********'s Element tries to explain how you, the customer, can try to obtain your money back through the credit/debit card companies that you paid through. They do not give the customer any knowledge of giving their money back guaranteed. This is very disheartening as the customer because I paid for a service that I have not even received, which as a lot of money to put out, and then not get back due to circumstances that were not my fault. The business has since deleted all forms of contact and there is no way to collect the money that I spent to have the service/item.

      On May 30, 2022 I placed an order with Francescas Element LLC. I ordered at 3D medium tray and a set of two bookends for $1,639. This process was estimated to be a 6 month long process. On May 30, 2022 I paid my first invoice of $887.11. On June 2, 2022 I received a confirmation email that the company received my flowers. On June 20, 2022 paid my second invoice of $443.56. On July 5, 2022 I received notice that my flowers had been taken out of the silica gel and were dry. On July 16, 2022 I revived a notice for an invoice that was past due. The invoice stated the payment was due July 13, 2022 for $443.56. I paid this promptly. My order was expected to be done roughly by mid December 2022 to early January of 2023. On November 3, 2022 I received notice that due to severe weather the shop sustained damage and orders would be delayed by 1.5 months and that the company would be sending a complementary piece with my remaining flowers due to the delay. The *** for my order to be completed was now roughly mid February 2023 to early March 2023 due to the delay. On February 7, 2023 I received an update that the delay time was no longer expected to be 1.5 months but longer and the company had an unknown estimated time. On March 26, 2023 I recached out the support team to see if I could get an update as to when my order would be completed. On March 27, 2023 I received a response that let me know that the team had begun May orders and did not have an estimate as to when my order would be complete. At this point the team has had my flowers and order for over a year and had not provided goods or services. I have paid in full for all products since July 18, 2022. I received communication last week that the company will be shutting down. I requested a full refund my purchase a total of $1,639 within the next ***** business days and company has made no attempts to contact me or process a refund.Can provide more unfortunate upon request.

      The owner's of this company have stolen from over 400 people. They have defaulted on signed contracts. I placed on order and paid in full on 1/25/2022 for the service of flower preservation. My wedding was 9/15/22 and paid to have my flowers overnighted. The turn around from this service was supposed to be 4-6 months. Apparently this business suffered from a flood on 8/22 and was still accepting orders knowing that they did not have money. Every inquiry I made about my order I was given excuses and they kept pushing back my expected date. On 3/8/23 I was informed about a flood and they need to push my order a few more months, not knowing that the flood occurred before I sent my flowers in. On 7/31/23 I received an email stating that they are shutting down their business, that we would all have our flowers sent back to us with no date or what condition they will be in. They also stated that we would not receive a refund. They have done this to over 400 people and mismanaged all of their funds. They have stolen from their customers and broken contracts.

      I had contracted *********'s Element to provide bridal bouquet preservation with resin art. The initial charge for thr package I chose was $615.94 on 9/8/22 with an additional $205.68 on 12/5/22 using my bank card both times. Therefore the total charges were $821.62. On 3/15/23, I received an email indicating that the original 6 month turn around time needed to be extended an additional 3-4 months due to unforseen circumstances. On 7/31/23, I received an email indicating that they were closing, ceasing all further operations and leading towards bankruptcy. They indicated they would be return the dried floral components, without a specific time-frame and indicated they would not be returning the previously paid funds. I'm looking to have my bouquet components returned to me in usable condition in a timely fashion and my funds returned to me so that I may work with a different vendor to complete my bridal bouquet preservation. By not returning the funds that were paid for an unfulfilled commission limits my ability to get the same work through another vendor given other financial limitations and obligations I have at this time. I can submit copies of emails and my bank statements if needed.

      In December of 2021 I paid $703 to Francescas Element to preserve my wedding day flowers. I was married late June 2022. I then decided to add on a $135 flower arrangement in July 2022. My total now adding up to $838 with the company. I sent in my flowers and they were delivered July 7, 2022. I was promised my preserved flowers back within 3-6 months of delivery (so no later than January 2023). A month before I was expected to receive my flowers I got an email that they needed a few more months. So I patiently waited. On Monday, July 31st I received an email from them stating they are going out of business and are leaning towards bankruptcy. They stated they will not be processing any refunds and may return the flowers that I had on my wedding day. Unfortunately, my payments are too far back for my bank to refund me and I can only hope at this point that they decide to ship back my precious flowers.

      I entered into contract/agreement with this establishment 7/2022 and made 4 payments of ****** in exchange for service of wedding bouquet flower preservation which would take a total of 6- 9 months to complete after Nov.. 3 days ago I received an email saying they've filed for bankruptcy because they got sued due to a non-compete. ******** said they will not send me a finished product and will not send me my money back. I want my money back of ******!! Thiefs!!!

      I placed an order with the company to have my wedding bouquet preserved in resin pieces in February of 2022. My wedding was 11-1-22 and I paid approximately $200 to ship the flowers overnight to the company per their very specific instructions. The contract stated a 5-6 month turn around time. Exactly 5 months to the day I was sent an email stating the company was dealing with a flood and that my bouquet would be delayed. On May 18 I received another email saying my pieces were on the table and ready to be poured. From there I heard nothing until July 31 when I was sent an email that was forwarded to all the clients stating the business was closing, refunds wouldnt be given, and they do not know when flowers will be delivered. Their email, ******************* and website are all gone. Nobody can be contacted. My order was over $500, not including shipping. The company was apparently in a law suit and was still taking orders, knowing they would not be processed or returns. One of the owners has also published books on Amazon about how successful their business is, yet in the email the company is claiming they are bankrupt and there is nothing they can do to help anyone. I just want my bouquet back and to be reimbursed for whatever work was not done. It also appears that every bride who sent flowers received an email about a flood five months from when they sent in their flowers. Regardless of when they sent them in.
