Date of the transaction: July 3, 2024 The amount of money you paid the business: 2998 What the business committed to provide you: chapter 7 bankruptcy What the nature of the dispute is: scammed. Told originally I could file chapter 7, then after almost three months of no communication outside of telling me to submit documents over and over, told I could only do a chapter 13. Whether or not the business has tried to resolve the problem: they offered to refund the filling fee since I didnt actually file bankruptcy but refused to refund further. So, refunded a total of 300 some odd dollars out of $3200 total saying that I had a credit if I changed my mind and wanted to do chapter 13, even though I advised I did not and will not do a chapter 13. They told me they would not refund, only leave a credit for a service that I will never want and that I dont have to get a breakdown of why the refund is only 300 some odd dollars out of 3200 when they literally did nothing but tell me to submit documents over and over and over for months. Feel like I was baited and switched.Business Response

We have been reaching out to this client daily through phone, email, and text messages, but have not yet received a response. We encourage the client to contact us directly and ask for *******, who can personally assist with any questions or concerns. Significant changes in income can impact eligibility for Chapter 7 bankruptcy, and we are committed to providing all available legal options to help our clients achieve a fresh start. We remain dedicated to thoroughly explaining these options and working toward a resolution that best serves our clients needs.Customer Answer

I am rejecting this response because: It is not addressing the fact that I was told that I would be eligible to do a chapter 7 and then after paying, told I can only do a 13 because I make too much. I answered those questions before I paid about my income. Nothing changed. They literally got me to pay, stalled for almost 3 months asking me to resend the things that I had already sent to prolong the process, and then once I figured out I was being lied to, told me they had done too much work to issue any substantial refund.Business Response

We understand the frustration Mr. ************* has expressed regarding his bankruptcy options. We genuinely wish to resolve this matter and clarify any misunderstandings or concerns.
To address the primary issues:
Eligibility for Chapter 7 vs. Chapter 13 Bankruptcy: We empathize with Mr. *************** disappointment in being informed that Chapter 13 is his only viable option. Eligibility for Chapter 7 is subject to federal regulations and often influenced by income, household size, and other financial considerations. These assessments must align with legal standards, and adjustments in eligibility may result as further information is gathered.
Efforts to Communicate and Resolve: While we received an email from Mr. ************* requesting a refund, it expressed no interest in having a conversation to discuss the details. We want to ensure that any resolution, including a potential refund, is processed accurately. This requires confirmation of important details that are best addressed through a brief discussion, such as the refund method and available forms of payment. We have made attempts to reach Mr. ************* by phone, email, and text, and remain committed to assisting him directly. We have attached a log of communications.
Refund Consideration: We offered to refund the filing fee and retain the remaining balance as a credit for future services. If Mr. ************* wishes to pursue this further, we are open to discussing potential options, provided we can have a constructive conversation to establish any necessary adjustments.
Our ultimate goal is to achieve a fair and satisfactory resolution, whether that involves a refund or another mutually agreeable outcome. Mr. ************* may contact us at his convenience and ask for *******, who is prepared to assist personally.Initial Complaint

Our office received a cancellation request on October 3rd via a phone call with our receptionist. On the same day, we promptly returned the call but were unable to reach the client. We made a second attempt later that day, but once again, contact was not established. Additionally, we sent an email on October 3rd to inform the client that we had initiated the case closure process. A manager was set to review the file and complete the close-out procedure, which includes evaluating billable hours. If a refund is applicable, it is critical that we speak directly with the client to confirm payment arrangements.
The following business day, we received this complaint through the BBB. Since then, we have successfully communicated with the client and have provided a resolution that we believe meets their satisfaction. We wish the client the best as they continue their legal journey.Initial Complaint

I signed a contract with Allmand law on September 20th 2024 and attempted to cancel the contract on September 23rd 2024 as per the 3-day clause in the contract. Allmand law is refusing to honor that right to cancel the contract and issue a refund of my $300 deposit. Their system deliberately is built to prevent you being able to cancel the contract. Not only did I call and speak with a front desk receptionist on multiple occasions, I sent text messages, left voicemails for a ticket, and was required to have two phone conferences about canceling my contract. They drew the process out until October 1 2024 in an effort to avoid returning my deposit. A company that is doing business legitimately has no need to keep money that did not earn. Despite my every effort to comply with a three-day cancellation clause I could not do so because of their own system preventing it. I hereby request and immediate refund back to the original card for the $300 I paid.Business Response

We have been unable to contact our client since the receipt of this BBB complaint, but the client's updates on other platforms indicates they are aware of the resolution provided.Initial Complaint

I have paid $1500 for them to handle my chapter 13 BR. I only went ahead past the consultation, because I was told multiple things regarding my bankruptcy. Now that Ive sat down with an attorney who told me they could care less and the amount doesnt matter to them the whole thing just gives me bad feelings. Its misleading to tell someone one thing in consultation make them pay the full amount before they talk to an actual attorney just for the attorney to Sidestep and change the information that was told to you within the same company. When asked for a new lawyer - I was blown off. When asked for a refund - no response.I am filing a complaint with the BBB as well as reporting to the state bar for illegitimate legal advice.Business Response

I recently filed a Chapter 13 bankruptcy with Allmand Law Firm. We had a consultation via telephone and upon paying the deposit that was required, that is when the process was scheduled to begin. This was in April 2024. I was assured on multiple occasions by their legal team that they could protect my vehicle and home. Due to being laid off for several months, I obtained a title loan that I ultimately could not pay back. The legal team assured me that they could protect my vehicle from getting taken and that they could work with the lender to come to a payment agreement. They even encouraged me to pay the deposit quickly to get protection on my vehicle. I am a single mother of four children, who had been laid off and actively trying to find another job, with no luck thanks to the current job market. I scraped together the deposit and paid the law firm to get the bankruptcy started. It took them months to even get the documentation filed, despite me completing everything and submitting required documents in a timely manner. I would speak with their staff every month just to ensure that my vehicle was protected because I was getting telephone calls from the lender daily. They assured me that they were actively working with the office and that I was fine. Well, that was all lies. My vehicle was taking on the SECOND day of my new job that I started August 2024. Mind you, payments were already being sent to the trustee at this point, so why were my assets not being protected as promised? Once I informed Allmand Law about what happened, I will admit, I was upset and requested a partial refund. They stated that they would not issue me a *****. They stated that they would get me vehicle back. Fast forward to the end of September, I still have not gotten my vehicle back and after speaking with the lender multiple times, Allmand has not even contacted them, NOT ONCE! If you are considering filing bankruptcy, please find a better solution, because Allmand Law is no help.Business Response

While we are unable to address specific case details in a public forum, we strongly dispute the claims made in this complaint. Timely and effective communication between clients and our office is crucial to ensuring successful outcomes, especially in complex matters like Chapter 13 bankruptcy.
In this case, despite our continued efforts both before and after this complaint, we have been unable to establish contact with the client to resolve the issues at hand. The time-sensitive nature of their bankruptcy case requires prompt communication, and the client’s lack of response jeopardizes not only the handling of this complaint but also the overall health of their Chapter 13 case.
We will persist in our efforts to reach the client before their case faces potential dismissal, offering legally compliant solutions that align with their original goals. It is important to stress that the options we can provide are strictly governed by the bankruptcy code, and we remain committed to offering guidance based on these legal parameters.Initial Complaint

I wanted to file bankruptcy but then they kept asking for documents and their website never showed how much money you in there except one time which it showed I paid 2600 and bow it just states waiting o. Payment. Then when I sent email to customer service requesting they cancel the bankruptcy filing. I received a email stating it could not until I spoke with someone from management. I received that call today from ****** with the law firm which is 09/19/24. He stated he just wanted to talk to me and let know some I information. So he ask why I wanted to cancel and I told him why were they still asking for documents and why come I could not see how much I paid to them on the website. He stated they were not suppose to ask for docume to until it was close to the day of filing the bankruptcy and he will talk to his people about that. Then he stated I could receive my refund until the ladies in billing look over it and then I received an email from them stating I will not receive a refund of any ***** money. Like told them, I ******* money back. You have not done anything, and you never said you charge a ****** look over the documents which your firm requested.Customer Answer

Horrible Law Firm. I paid 2800 out of 3000 and not once spoke to a actual attorney, I had 3 questions on 3 different occasions. All 3 left unanswered. I am fed up and fired them. I demanded a refund as they have done literally nothing on their end. You do all the work and they mess it all up. They lose documents, don't meet appointment times. You can't even check your balance without calling them. That is how far behind the times they are. I'm sure I will not see my money ever again as they are the worst type of human. Was contacted by ******* H on 16 SEP 24 and informed I wouldn't be receiving a refund. So to sum it up I paid $2,800 and not once was allowed to speak with a attorney even after numerous requests to do so. Then I fire them and $2,550 charges just magically appear and then another $250 for case closeout just for good measure. (screenshot attached) This is total fraud and a sham.Customer Answer

I was contacted on 18 SEP at 1600 telling me to change my review from a previous BBB complaint before they would send out my refund check. This business practice just proves my point even further. On Monday 16 Sep I speak with ******* and thought the issue was resolved. He tells me a check will be mailed out. Two days later they say they won't send my money until I change the review. No, I will not change the review as that would defeat the whole purpose of this. Who is going to hold this business Accountable for this shady business practices?Business Response

We regret any instance where a client feels like they have not received the customer service experience we work to provide. It is understandable that a client feels like "We have done nothing" when they cancel before their ultimate goal, which is the filing of their Bankruptcy Petition and the discharge of their debts, but this simply isn't the case. The client had a consultation with an experienced Bankruptcy attorney 18 months ago when they retained the firm. As outlined in our retainer agreement, once a client retains our firm, the firm re-reviews all intake documents, client's information, and perform other administrative tasks associated with opening a client's file. We spoke to the client 9/16th, and believe we have achieved a resolution that is satisfactory to all parties.Customer Answer

We have provided our client with guidance regarding their options under the bankruptcy code. Currently, Allmand Law Firm is in the process of finalizing the accounting closeout for this client, following their decision not to proceed with their Chapter 7 filing. In accordance with our retainer agreement, we will prepare an Accounting of Services to reflect the work completed on their behalf.
As outlined in the retainer agreement: "The Client acknowledges and understands that in a chapter 7 case a chapter 7 trustee will be appointed by the court. The Client understands that the chapter 7 trustee has a duty to investigate the financial affairs of the debtor;"
Debtor took certain action to liquidate exempt assets, without consulting with Counsel. Counsel advised client of the resulting effect of such action on potential Ch 7, at this time. After consultation, client agreed not to proceed with filing Ch 7.
We remain committed to supporting our client throughout the closeout process and addressing any additional needs they may have.Initial Complaint

I am writing to formally express a resolution in my bankruptcy case. I started making payments on July 19th, 2023. I paid $150 until the end of December 2023 totaling around $4000. I paid to ****** Law with the understanding that you would handle my bankruptcy filing efficiently and professionally. However, despite fulfilling my financial obligations, I have encountered persistent delays and a lack of progress. Each time I have provided the requested personal documents, I have been met with additional demands for further paperwork, often repetitive or irrelevant. This cycle has continued without any clear communication about when the bankruptcy process would actually begin. After providing all the requested documentation and indicating that I had no further information to supply, I was dismayed to be met with further requests rather than a confirmation that my case would be filed. This experience has left me feeling frustrated and concerned about the handling of my case.To add to my frustration, despite your firm's refusal to proceed with my bankruptcy filing, you have also declined to issue a refund of the $4,000 I have paid. This is unacceptable, especially given that no substantive legal work has been completed on my behalf.I am requesting an immediate refund of my case as a prompt resolution.I will have no choice but to pursue further action, including but not limited to filing a complaint with the state bar association and seeking legal recourse for the return of my funds if they are not refunded. I trust that this matter can be resolved promptly and amicably.Sincerely,*******************************Business Response
