My initial consultation was with a Partner, they seemed knowledgeable & experienced, so I was confident in their ability to represent my case. The attorney that was assigned to my case, however, had been licensed for a year & already dipped their toes into a few different areas of law. As my case began, I took it upon myself to find relevant legal documents to address inaccurate information that was clearly damaging, but my attorney neglected to present any of these documents because, as it turns out, their experience in this particular area of law was limited, at best. After consulting with other attorneys it became clear to me that something was terribly wrong & I began to reach out to the firm asking to speak with senior staff to address my very serious concerns. After multiple attempts & being told that someone would call me back, I never heard back and ultimately my case took a turn for the worst. I then received an email invoice which included several hundreds of dollars for this attorney to travel from their home office to court, despite the fact that the firm has an office in the parking lot of the courthouse. Fed up, I called again & told the receptionist that I wanted them withdrawn from my case & wanted my retainer fees returned. At that point the supervising partner spoke to me & unsurprisingly accepted no accountability for the situation, but said that the situation would be evaluated. The next day he called me again to tell me that the additional invoice was being waived, but made no offer to return my retainer fees. He disclosed that the extent of his investigation involved a conversation with my attorney, but he did not review any documents or any information pertaining to my case. He promised to call me again no later than 2 days later, but never returned my call. I reached out by phone and email but received no response. Following all of this I returned to court ONE more time, got a new attorney, and shortly after my case was dismissed.

Dates of service: March 2021 to September 2022 (date legally withdrawn as my attorney).Amount paid: Around $15,000 Damages caused: Immeasurable damages. The lack of professionalism from his personnel caused me, to lose my son's custody. His employee ********************************* mouth washed my name & my case to the attorneys I tried to hire after her. During all the hearings, she didn't prepare the case or even read the basis for my son's custody. The files I gave her, were organized and presented by a free legal attorney from the Domestic violence center. She just needed to read them & submitted them during the hearings (cases closed reason to believe for physical abuse from father to child, assault family violence from father to me). She sided with the opposite party. When I complained to ***********, she said lies about me. Things that never happened. The same way she said lies about me and vent my case to other attorneys and family court.Complaints like mine are in reviews about this firm.On August 9th, 2021. I was required to present for a hearing about "education". I implored *********** to postpone that hearing until the criminal trial for assault and family violence. He refused. In that hearing, without trial, without witness, without any opportunity for me to defend my ********* The opposite party had ready the custody modification to the removal of my son and they gave me the hardest punishment: supervised visitation by a professional. Manuel **** firmly sided with the opposite party. It was an "ambush" as my new attorney mentioned. My family paid around $59,000 in attorney's fees to get some of my son's custody back to me.Manuel **** law firm did a terrible legal representation that caused my family and me, irreparable damages in addition to monetary losses of around $85,000.I received "threats" from Manuel **** employees after the removal of my son on August 2021. Saying I was going to jail, if I refused to sign accepting the removal of my son and all sanctions.

      Business Response

This complaint is wholly inaccurate. Manuel Diaz Law Firm, PC was hired to represent Ms. ******** in a petition to modify a final child custody order in Tarrant County, *****.  The petition to modify was originally brought by Ms. ******** herself.  After the filing of the petition to modify, Ms. ******** hired two different attorneys who were not employed by and were unaffiliated with Manuel **** Law Firm. Each of those attorneys withdrew from representing Ms. ******** at different points in the case, and the Manuel **** Law Firm agreed to undertake representation of her in this matter after the latter of those two attorneys had withdrawn.  Ms. ******** and the Firm entered into a professional services agreement whereby Ms. ******** would pay for services rendered in the case on an hourly basis.  **********************, of the Manuel **** Law Firm, was the Firm's attorney who was originally assigned to the case.  During this stage of the case, the Attorney Ad *****, who was appointed to represent the interests of the child the subject of this suit, sought to establish the father as the primary custodial parent.  During a hearing to determine that issue, ********************** made objections, cross-examined witnesses presented against Ms. ******** and called Ms. ******** to testify in her own defense.  Despite ************************** arguments, the court granted the Attorney Ad *****'s request and appointed the father as the primary custodial parent.  Ms. ******** then sought additional legal counsel, and Manuel **** Law Firm, pursuant to Ms. ********** instructions, remained on the case as co-counsel.  Manuel **** Law Firm withdrew as co-counsel, pursuant to Ms.********** instructions, on or about November 14, 2022.  Ms ******** continued forward in the case with remaining co-counsel.  Pursuant to the terms of the professional services agreement that Ms. ******** signed, she paid the Manuel **** Law Firm for labor expended on the case by the hour.  The total amount of fees paid to the Manuel **** Law Firm was $9,552.50.  At no point did any employees of the Manuel **** Law Firm threaten Ms. ******** or obtain her signature by duress or coercion.

After reading the response from Manuel **** Law Firm, I'm adding my answer to explain why I don't accept their response (as document attached)

      Files to support my answer:

      1. CPS records to support why I had to initiate the custody modification. Not as difficult women/mother as they try to portray me. (I can provide the letters from cps closed cases against the father reason to believe physical abuse).

      2. Assault Family violence guilty conviction for the father.

      3. Signature of the attorney that represented me during the "removal of my son" August 9,2021. *********************** signature. ******************** was not present as Manuel ************* wrote in the answer.

      4. Status Quo Meeting to talk about education for August 9,2021. So there was not cross examination witnesses presented or hearing or trail, not objections either. It is FALSE the Manuel **** firm asnwer to say:

"********************* made objections, cross-examined witnesses presented against Ms.******** and called Ms. ******** to testify in her own defense".

She was not even present that day. It was the attorney *********************** and his signature is in the document. Ms. ******* was not longer represented me in real life since end of April 2021 (She represented me only March & April 2021). I don't know why, Manuel **** keep her as my legal attorney when she was not.

At the end of my answer on the document, I propose the way that Manuel **** Firm can resolve this terrible service that caused  irreparable damages to me & my son: Reimbursement of the amount they said I paid $9,552.50 (I know I paid more but okay I accept that amount).

      Customer Answer

      Date: 06/11/2023

I am rejecting this response because:

My answer is submitted as attachment document. To support my claim & answer I submit files:

      1. CPS action plan where I was obligated to request custody modification to stop visitation time to the father as result for physical abuse to my child.  I don't agree as the answer of Manuel **** Firm tries to portray me as vengeful angry mother.  (I can also provide the legal documents findings as reason to believe physical abuse from the father to child).

      2. Assault - Family violence guilty conviction from the father.

      3. Document from 8/9/2021 with signature *********************** attorney represented me. No present ****************** as Manuel **** firm wrote in the answer to this claim. So there was not way she could do: ********************* made objections, cross-examined witnesses presented against Ms.******** and called Ms. ******** to testify in her own defense.

      4. Document for "Hearing ********************** about education. Again there was not way the response from Manuel **** Firm is accurate with: "********************* made objections, cross-examined witnesses presented against Ms.******** and called Ms. ******** to testify in her own defense.".

      5. At the end of the document with my answer is the way I propose to resolve this terrible lack of legal representation that caused me irreparable damages to my family & I:  Reimbursement of the amount $9552.50  (I know it was more because of the retainer). But okay I accept that amount.

There was a status hearing during which the court decided to hear a request by the Attorney Ad Litem to establish the father as the primary custodial parent.  Attorney ********* was the attorney present during this hearing, and she represented Ms. ******** to the best of her ability.  During a hearing to determine that issue, ********************** made objections, cross-examined witnesses presented against Ms. ******** and called Ms. ******** to testify in her own defense.  Despite ************************** arguments, the court granted the Attorney ********** request and appointed the father as the primary custodial parent.  *********** Ms. At no point did any employees of the Manuel **** Law Firm threaten Ms. ******** or obtain her signature by duress or coercion.  Pursuant to the terms of the professional services agreement that Ms.******** ******* she paid the Manuel **** Law Firm for labor expended on the case by the hour.  The total amount of fees paid to the Manuel **** Law Firm was $9,552.50.  The Manuel **** Law Firm earned the fees which have been paid in connection with services rendered.  Ms. ******** has no funds remaining in trust with the firm.  If this matter is still pending, Manuel **** Law Firm is no longer attorney of record for Ms. *************** We wish her the best of luck, and we consider this matter closed.

I dont accept this answer, the same as the last one from Manuel **** Firm. It is full of inconsistencies already demonstrated in the files I submitted: The same line of Manuel **** Firm aligned with Attorney ad litemthat later was removed due to illegal actions against me & my son. The contract I signed in March 2021 was to have legal representation as any other legal firm must represent the client instead of alignment with the opposite party. This is something about Manuel Diazs Firm has so many complaints in their Family cases.
Thanks to my extraordinary legal representation since Manuel Diazs Firm disaster, my son is in custody. As he was always since he was born to a single mother. ********************* gave the guilty conviction for assault and family violence to the father.
My complaint is about the lack of REAL legal services from the Manuel **** Firm on my son's custody case. Aligned with the Attorney ad litem that was removed due to illegal actions (removal of my son without legal basis and not a legal trial for it).  Manuel **** Firms answer is saying they "represented me" in a cross-examination ... it was nothing like that. That was proved later & the judge removed that "legal fair trial"as Manuel **** Firm tries to defend, just because it was not legal where I didnt have witnesses or any opportunity to defend myself, not even the right MOTION.As a Note: Manuel **** Firms answer again says attorney ********* represented me in the "trial" which was not true and I already provided the file which is signed by *********************** (he quit Manuel **** Firm), not *********. I asked specifically to be removed from my case since the first hearing where I saw her lack of interest in my case, not even reading it, and not informing me about that hearing (zoom).
YES, I was threatened by Manuel **** Firm employee paralegal in their ****** office in August 2021. My cousin was there, and she can testify to it.
Same as any business: If the firm doesnt provide good service, the client has the right to ask for money back. That is what I want: $9,552.50 back to me.
That money doesnt compensate for the damage that Manuel **** Firm did to my family. Only on legal fees for a real legal representation I paid around 7 times that.
Manuel **** Firm deserves a hard sanction for the damage they caused to me & my family.

However, instead of me going to the Texas Bar, I'm asking only for my money back and asked help from the Business Bureau.
