On 7/5/2023, I bought a vehicle from Copart auction in Michigan. 2022 AUDI Q5 PREMIUM for $29,634.00. The vehicle was advertised as a clean title and sold to me as a Clean Title with minor front-end damage only. Months later, I discovered that CARFAX reported the vehicle as a total loss salvage title but issued me a clean title. Please note that I have been a buyer with Copart for 24 years and understand the terms and conditions of the vehicle buying agreement with Copart. Nearly every state, including Michigan, has what are known as "title branding laws." These are laws that require vehicle titles to be branded "salvage," "scrap," "rebuilt" and the like, depending on the age of the vehicle and the extent of the damage. The purpose of these laws is to protect the public from unscrupulous dealers who purchase total loss vehicles, fix them up, and then resell them at full market price without disclosing the vehicle's total loss history. It is not uncommon for insurance companies and dealers to find ways to evade these laws, so that they can obtain higher resale prices for total loss vehicles. Generally, under Michigan law, if the vehicle is 5 model years old or newer at the time of the loss, and the estimated cost of repair is at least 75% or more of the vehicle's pre-crash fair market value, then the title must be branded "salvage." A salvage vehicle can be resold at retail if the title is properly branded, and the vehicle has been inspected by the state police. If the repair to value ratio is 91% or more, then the title must be branded "scrap" and the vehicle cannot be resold at retail. Threshold. That said, under Michigan law, if the vehicle comes in from another state where the vehicle's title was similarly branded, or where the vehicle met the other state's threshold for title branding (even if the other state's threshold was lower), or where the vehicle meets Michigan's threshold for title branding, then the dealer or other person acquiring the vehicle must have the Michigan title branded before selling it to anyone else. Generally, if there is an insurance company in the chain of title, and the total loss was due to collision damage (as opposed to being stolen and recovered without significant damage), it is a pretty safe bet that the vehicle should have had a salvage or scrap title. I have sent numerus emails to Copart Michigan Mr. ****** ********* and he is not cooperating with me to resolve this matter. All I ask is for ****** ********* to work with the insurance company who sale the car through Copart to update or delete the inaccurate CARFAX REPORT. I have contact Carfax and they need a confirmation email from Copart or the Auto Insurance Club association stating that the vehicle was sold to me as a clean title so that they can update their report. I have attached a reference CASE# ******** with CARFAX. TO ATTN ******: RESOLUTION MANAGE. SEE ATTACHED I appreciate your cooperation on this matter. Please note, that I will not hesitate to sue and take this matter to the Michigan Attorney General if this case is not resolved promptly. Sincerely, **** ************ ****** ******

In response to the claim asserted by **** **** about a vehicle that was purchased at Copart’s auction.  One of the prerequisites to establishing a member account with Copart is agreement to Copart’s binding Member Terms and Conditions.  **** ****** member notes indicate that Mr. **** has consented to the current Terms and conditions. These Member Terms and Conditions state:
Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles, whether provided in written, verbal, or digital image form (“Vehicle Information”). Vehicle Information provided by Copart and its vehicle sellers is for convenience only. Members shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through Copart. Vehicle Information includes but is not limited to: year, make, model, condition, ACV, damage amount, damage type, drivability, accessories, equipment, mileage, odometer disclosures, vehicle identification number (e.g. “VIN,” “HIN,” and serial number), title, repair cost, repair history, title history, and total loss history… Vehicle parts may be missing. Copart does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Member to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.
Once a vehicle is removed from Copart’s premises it is accepted AS-IS, and under no circumstances will Copart be liable for subsequent claims of damage or loss of any kind or nature whatsoever.

Additionally, NMVTIS is a federal database for reporting salvage and junk vehicles that is entirely separate from state laws regarding which vehicles require a salvage or junk title. Therefore, from time to time, Copart, as required by federal law, reports clean title vehicles as salvage to NMVTIS that qualify under the NMVTIS definition as salvage. These vehicles can be transferred under a clean title, as Mr. ****** has been able to do, even while they are reported salvage in the NMVTIS database.

Copart makes all members aware of this particular risk from the differences between state laws and federal laws. One of the prerequisites to establishing a member account with Copart is agreement to Copart’s binding Member Terms and Conditions.  Mr. ******’s member account indicates he has consented to the current Member Terms and Conditions. These Member Terms and Conditions state:

      I. DISCLAIMERS
      A. Vehicle Condition and History Disclaimer.
Except as otherwise expressly provided by applicable law, ALL VEHICLES ARE SOLD “AS-IS WHERE-IS.”
Except as otherwise expressly provided by applicable law, all vehicles sold through Copart are sold “AS-IS WHERE-IS,” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY.  As used in these Terms and Conditions, “vehicle(s)” means all items posted for sale on Copart’s websites and otherwise offered for sale at Copart facilities, including but not limited to cars, trucks, motorcycles, boats, jet skis, industrial equipment, trailers, RV’s, etc.  “Vehicles” also includes miscellaneous salvage items that are posted for sale on Copart’s websites under the heading “Other Goods.”  However, Members expressly acknowledge and agree that “vehicle(s)” does not mean or include, and Copart does not purport to facilitate the sale of, any cargo or items of personal property which may be contained in a vehicle but are not part of the vehicle.  It is the sole responsibility of the Member purchasing a vehicle to take possession and/or dispose of any such cargo or contents in accordance with applicable law.
“VIN,” “HIN,” and serial number), title, repair cost, repair history, title history, and total loss history. No effort has been made to list open recalls applicable to any vehicles. Any recalls are the sole responsibility of the purchaser and can be found at locations like *************. Copart and its vehicle sellers expressly disclaim any and all representations, warranties, and guarantees regarding vehicles sold through Copart. Copart does not guarantee that keys are available for any vehicle sold through Copart, regardless of whether keys are present in online vehicle images, or were present in the vehicle prior to the time of purchase. Certain jurisdictions permit vehicles to be sold with missing VIN plates; as a result, Copart does not guarantee that vehicles are equipped with any or all VIN plates. Vehicle parts may be missing. Copart does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Member to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.
All Members agree that Copart vehicles are sold AS-IS and are not represented as being in a road worthy condition, mechanically sound, or maintained at any guaranteed level of quality.  The vehicles may not be fit for use as a means of transportation and may require substantial repairs and expense.  Repairing or dismantling vehicles on Copart premises is strictly prohibited.  All Members must arrange to safely and legally remove purchased vehicles from Copart’s facility prior to undertaking any repairs or dismantling.
      B. Registration Laws Disclaimer. Copart does not guarantee that any vehicle sold can be legally registered in any state or country, and the Member accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that may negatively impact the marketability of vehicles purchased at Copart. (For example, a vehicle legally purchased on a clean title by a Member at a Copart facility located in State “A” may be required to be sold on a salvage title if Member transports and resells the vehicle in State “B”.)
      C. DMV/MVD/DOR Paperwork Disclaimers. Copart is not responsible for defects, errors, or omissions (i) related to motor vehicle department or department of revenue paperwork not processed by Copart or (ii) made by any motor vehicle department, department of revenue or other governmental entity.
      D. NMVTIS Reporting Disclaimer. Vehicles listed for sale at Copart may have been reported to the National Motor Vehicle Title Information System (“NMVTIS”), and transaction data related to vehicles purchased at Copart may be reported to NMVTIS, in Copart’s sole discretion.  Each Member accepts all risks associated with purchasing vehicles at Copart resulting from the reporting of the vehicle or the purchase transaction data to NMVTIS by Copart or others. Members may be subject to NMVTIS reporting requirements when purchasing certain vehicles. For more information on reporting requirements, exemptions, and how to obtain a NMVTIS Reporting ID, visit **********************.

By agreeing to these Member Terms and Conditions, Wil ****** acknowledged that he understood the disclaimers yet proceeded with his membership.
The Copart webpage advertisement even provides a list of Inspector Services, who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. All these tools were available for **** **** to utilize, but he failed to use any of them. **** **** had this vehicle picked up and removed from the Copart facility on 7/13/2023 knowing that it would be labeled ‘As-Is’ and not returnable. Accordingly, Copart rejects any and all demands **** **** has regarding a refund.

I total reject the response in its entirety because it was totally off the point.  All I am asking is for Copart to correct the Total Loss history on Carfax report.

My account got suspended twice in 10 days and Copart still charged storage for two cars despite the fact that i called them to let them know that I dont have access to the account and during the suspension i could not pick the cars up. Why would you suspend a member account which prevent it to do anything and still charges that member storage. After a vehicle accident where the drivers side of my car was damaged. My insurance company, Safeco, partnered with Copark to hold the car after the accident. When ready to be delivered, ****** could not locate my vehicle for almost 2 weeks. Once they made a delivery, it was the wrong vehicle. They came back days later, picked up the incorrect vehicle and delivered my vehicle. However, while in ******** care, they caused $2,000 of additional damage to the front end. After 6 weeks of communication where I had to constantly initiate contact, it finally escalated to *************************, Regional Manager at Copark. On 3/27, I ordered a Vehicle Condition Report on a vehicle I was interested in bidding on from their site. I never received the report. I then asked for the yard responsible for delivering it to refund my fee. After informing me he would see to it, the refund never came. I have copies of all correspondence.I then disputed the charge to my credit card with my CC company. Upon doing this, Copart suspended my account, due to THEIR POOR CUSTOMER SERVICE. I then contacted their ** office. A very rude person there informed me Id have to release the dispute, pay for a report I didnt get, then lose my bidding privileges for 6 months to regain use of my account. While attempting to justify this ridiculous demand, the ** individual refused to allow me to speak through all her interruptions, then hung the phone up. I have since disputed another Vehicle Condition Report fee, as well as my membership fee, as neither was delivered due to THEIR prior suspension of my account.Again, this was ALL due to THEIR POOR CUSTOMER SERVICE. Im guessing Im not their only victim.

I purchased a truck through Copart's online auction from the ******** North location. At the time of purchase I also ordered it to be towed from ******** to ********* through Copart's towing service and paid $150 for this service because I didn't want to drive all the way to ******** and back, which is the same as the price quoted to me before I purchased the truck. I received a call the next day saying that they can't tow to ********* and that they are refunding me $150. On the call they gave me a recommendation of another tow company that I could use if I still wanted to have it towed. They NEVER told me that I must have it towed off the property. The new estimate for the tow was $450. I decided to go up with a friend and pick it up myself. After waiting around an hour for them to bring out my truck, they told me that the truck must be placed directly on a tow truck, and that I can't ************* off the lot. This is the third vehicle I've purchased and I've always just driven off the lot. I told the worker that I was frustrated because my friend and I each wasted 5 hours of our day to pick up the truck and they should have told us in advance, or just not have canceled our tow. Since it was my property, that they should just give it to me. I wasn't able to find a tow truck to take my truck off the property in a timely manor, so I left empty handed and paid for it to be towed the next day. Because I showed frustration to the worker during my 30 second conversation with her, she then revoked my membership (I had just paid $99 for a one year membership). I feel like I am due a refund for both the $450 tow as well as the $99 membership. This was the worst customer service experience I have ever had.

I did not do anything that should have caused my membership to be revoked. Copart really frustrated me, but I stayed calm and attempted to have a friendly conversation to resolve the issue. They were not helpful.

I was in need of a car, when I saw on this company's website, that they were selling cars by auction. The prices of the cars were so different since the information provided about them was super different too, in relation with the characteristics of each one. According to the car that I decided to finally buy, it was listed as a car with primary issues - normal wear, and with secondary issues- minor dent/ scratches. It was also shown pictures of the vehicle were none of the lights were indicating any motor damage, and was even stated that the car was able to run and drive by its own power. After all this data, and trusting on this information since Copart is a big company, I decided to pay for it. My surprise was, when the car was delivered on my address with no power(the battery was dead). Also the car had multiple electrical problems that impaired the car to be opened or locked when you use the car key normally. I try to pass the inspection of this vehicle and did not pass it because many of the problems the car had. I went to a body shop just to check what was the problem and they could not identify it but the engine light was still on the dashboard since the car arrived (but on the pictures you cannot even see this light because it has been removed). I took the car to a second body shop especialized in European cars and they told me, the car could be declared a total loss cause all damage observed. Let me mention that Copart has cars offered as total loss, salvage ******, mechanical problems... but none of these were on the information provided on the car that it was sold to me. I have contacted with the company, and after several emails, they claim that the car is not refundable because it was took already from their parking (it was delivered from ****** and arrived in poor conditions), and that the car has been touched in a body shop, which isn't true since the car has been just INSPECTED with the intention to find a possible solution to this fraud.

      Dear ***************************,

In order to bid on a vehicle, prospective bidders must first create a Copart member account. ********************** does not sell Vehicles to non-members.

Our records reflect that this Vehicle sold to Auto Bid Master ("ABM"),a registered broker (and member)not ***************************. *************************** is not listed as an authorized cardholder with ABM, which means that they are not approved to speak to Copart regarding ABM's account or transactions. Copart's privity of contract extends solely to ABM, and ABM's privity of contract extends to Angel ********* No direct business relationship exists between Copart and ***************************. Any concerns relating to the advertisement and/or sale of this Vehicle should be properly addressed to ABM.
Copart respectfully requests the BBB close *************** complaint, as this sale only involves the broker and does not involve Copart in any way.  We suggest the complainant contacts the broker where they bought the vehicle.

      Thank you,
      Copart

I am rejecting this response because:

First of all, we do have an account with **********************.

Secondly, the reason of this claim is not only that Copart has in their website fraudulent information and edited photos of at least our car; but, Copart allows the purchase of the car, being the main advertiser of these goods, that do not much with their offers on purpose (in our case, if the real status of the car would have been shown, for sure we had not thought for a second on buying it). AutoBid may have responsibilities on the matter, but definitely the main responsible of this is Copart, that is the provider of the vehicle and who displayed the status information about the car .

Every message confirms more and more their intention of fraud on the vehicle they sold to us,  by  avoiding evident responsibilities.

I am rejecting this response because:

We do maintain that Copart has responsibility on this matter, being this company the one that promotes the sell of cars under the statement of false or inaccurate information. This results in a situation, where customers try to buy vehicles that are not the ones that they finally receive. This is exactly what is defined as a fraud.

The car we bought it's not able to be driven when the only purpose of buying it was that one. How is possible that they advertise products that are not in the way they are described? Responsibilities are there, and Copart must face it, being the top part of all this fraudulent chain.

My car was illegally searched and impounded. The fees ended up being too much so my lien company had the car taken from the impound yard to Copart for auctioning as we hadnt paid any fees but were working on a payment arrangement. That is not the issue. The issue is when we went to get our things out of the car from Copart, as it was NOT up for auction, most of my property had been stolen. Copart employees assumed that we were not coming to get our property and stole my kids things, my things and my finances items as well. I am not seeking any kind of criminal recourse as we dont know which employee it was (obviously) and we are seeking legal action for the entire ordeal as a whole, but the employees shouldnt be taking items from cars that arent up for auction when theyre not sure if the owner is coming for their things. Our items were all over the floor, so they were sloppy about it. This complaint will be apart of my legal claim.

Unfortunately, ************************* did not provide enough information to identify the vehicle in question. The Copart member number, Copart lot number or VIN would suffice. Once we receive that information, we will be happy to investigate the matter.

1 - I was OK with the 99 dollar membership fees. But the car listing was wrong, and the first time I noticed the car it said "repossessed car from ********!" The car did not start, like they said. They lie about the details of the car! False information. I canceled the win, after getting the winning bid. After checking the car out, I could see misinformation of the details. For the cancelation they charged me 600, but given a 100 dollar reduction, so I had to pay 500 dollars just for them to relist the car, which probably takes less than a minute! I was also told I was the 5th person to cancel the winning bid! 500 x 5, is ***** just to relist it! Their fees are very hidden! They don't inform you of any of the ridiculous fees they charge, until afterwards! I want my 500 dollars back, and my 99 dollars for the membership. That is stealing, to charge such a ridiculous fee for canceling a winning bid, with false information on the car in the first place. I want my 599 dollars back! If I had known this in the first place, I would have never been a member! Once I won the car, I got a call from a guy in ***** I believe, and informed me of the winning bid, and the fees that go along with winning! This is so hush, and they hide the fees, until you win, or cancel a winning bid! That's why he called me, to inform me of the fees! This is done afterwards, not before hand, and to get to the fees, you have to go through a maze of clicks to get there! This is done, because they know they would have less members signing up if they were upfront of the fees! Facts! I want my money back! 599 dollars to be exact!

I am rejecting this response because:  They told $500 dollars from me! It's a scam. They said I'd agree, but they hide all fees! Be upfront,  and honest about the fees! Do not make it so hard to find! They lie, if they are upfront,  then why have someone call you, and tell you the fees once you win a bid! Because they are deceitful about it! They hide the charges, and fees, because they know people would be discouraged of joining their scam! The listing was wrong! Lies in it!

My insurance company chose to use this company for storage of my vehicle until they determined whether it was repairable. Copart took it upon themselves to gain access to my car and personal property (which they admit to) and to bag my belongings after handling my personal belongings. Upon going to the business to retrieve my personal belongings out of my vehicle items were missing. A $40 ********************** tumbler cup and my CARB EO sticker (cost to replace $150) for the Supercharger system, thankfully I took as much as I could after the accident. When I spoke with the yard supervisor they said there is no formal way to document this which means they do not track it and stated to call my insurance company. It was also relayed that this is a common occurrence for this business. I would say that these people should stay out of customers vehicles unless they own the vehicle outright and not handle their personal belongings since they are not trustworthy or capable of tracking when issues arise. The main purpose of this claim is for documentation in hopes other people step forward and it shows a huge problem with this business.

*********************** is not a customer of **********************. **********************'s customer in this matter is ******* Insurance, who assigned *****'s vehicle to Copart as part of an insurance claim. If ***** has any issues regarding their vehicle while it was at Copart, they should address them with ******* Insurance who requested the vehicle be brought to Copart. As this is not related to a marketplace issue, Copart respectfully requests the BBB close this complaint.

My car had to be towed after I had a medical emergency on the highway. It was towed to H313033**333235383230H. After a hospital stay, I went to get my car. I paid $700 to get my car back. I looked in the trunk that had my daughters Christmas gifts. They were all taken. I did a police report while I was there. They were willing to pay a portion of it, but not the whole amount. They admitted to having issues in the past with personal items being taken from cars. They even admitted to an employee taking this. My daughter&#**;s father has the receipts for all the items. It costs totaled over $800. I felt the staff was not very helpful, and they were even rude.
