    This is a property management office who I have sent out back in November a email that I will be moving when my lease ends. They did not say anything more and in January I got a docusign where I filled it out and let them know I will vacate 01/31/2023 which I have. And now they said they still don't have enough written notices and want to charge me for the rent in February only because of the snow storm between 01/30 and 02/01 I have simply asked if I can finish with the cleaning but it was just to try to not leave it dirty I already vacated and am living somewhere else. I told them in that case I will not be going back.

    I moved into a duplex owned by Ameritex Property Management on 03/21/2021. I never really had any major issues with Ameritex Property management until about June 2022. I was laid off in 2021 due to Covid this was devastating as I am a single mother so I was able to speak with Ameritex and explain what was going on. On March 6, 2022 I applied for Rental assistance through the city of Dallas which I qualified for due to my complications with Covid related layoffs. Now I'm order to apply you have to show proof that you were affected which I did. I also shared this with Ameritex Property management and always kept communication open which I will Be attaching all communication I've had with them. They were very much aware that I was waiting on assistance and an employee Rachel agreed to wait on the assistance. Now at some point the management changed and I was locked out of my payment portal. I reached out and made them aware of what was going on. It was never unlocked. Now I'm the midst of this I was being harassed via email by an employee Amanda *******. An eviction was filed which was understandable. We attended court in August the judge ruled that my case be abated while the city has time to fund my assistance request. Both parties including myself signed this agreement which I will attach below. During the abatement Amanda ******* continued to harass me and intimidate me to move out. When it got close to the abatement hearing the harassment continued to the point where I was literally forced to move out. Which Ameritex had no business harassing me if there was already an agreement. This whole time I was only communicating with Ms. ******** My abatement was extended however Amanda ******* intimidated me and forced me and my children out even though they were being paid assistance. I asked Ms ******* why did they apply for an extension only to force me out she never replied. Also, they breached the abatement agreement as seen through the emails. I have since moved.

Ms. ******** references Rachel *****, an employee who has not worked for us since April 30th 2022 in her complaint. Rachel filed the Eviction due to nonpayment 4/15/2022. During this time, APM attempted to work through the assistance relief program with Ms. ******* but have was unsuccessful. Amanda ******, Assistant Property Manager, began her career with us this Summer and made multiple attempts to work with Ms. ******** and as of October 4 via email ******* indicated she did not want to continue living in the home. Email detail below: Hello, good afternoon. I live at ************************************* XXXXX. >>>> I got approved for rental assistance but the amount they sent me is not the amount that is in my ledger I think you guys include late fees and the smart home fee but they only sent me 1365 for each month.     on May 30th of this year, 2022, a document entitled "APM Renewal Letter" was uploaded to what Ameritex refers to as a "Resident Portal." This document clearly stated that Ameritex appreciated having me as a tenant and that they wanted to offer me options for renewing my lease agreement. The lease amounts provided corresponded with the length of the lease, with 6-months at $1195/mo being the shortest and 18-months at $1025/mo being the longest term. The document specified that the rates would change beginning June 1st, 2022. I was initially pleased with this as I had been paying at a rate of $1525 a month, so I happily filled out and submitted the document via email and offered to take the 18-month option. I had initially expressed interest in renewing my lease on May 14th and was provided with the document on the 30th which has since been removed from my resident portal (which is peculiar considering when I spoke with the Landlord from Ameritex on the phone, I was advised that they "couldn't see" the document I was referring to, and now it's the only document missing from my portal) Some context on the "Landlord", This person was just hired around three weeks ago. I had previously been in contact with another Landlord by the name of "Rachel". This new Landlord "Tonya" decided not to respond to my lease renewal form entirely and instead charged the full $1525 to my account on June 1st. I reached out to express my concern regarding this and was advised by Tonya that my agreement they sent me is invalid and that "the rent would only go up" and that they needed to send me a new document. As one would imagine, I was deeply upset with this and I advised her that I received this document before she was hired and they needed to honor it. She continued to argue with me and threatened to evict me if I didn't pay the full balance. I want to see a refund of the difference between what they charged and what I agreed to in the renewal form. July should be adjusted as well.

It was not addressed to the complainant or reflective of the property in question. The complainant took the document, filled it out, signed it and sent it the Ameritex Property Management team. This document in question and a new lease agreement, which would have been sent via docusign, was never executed, signed, or agreed upon by the management company, and is INVALID. We apologized for the confusion, and it was explained to the complainant both via email and over the phone that he would not be receiving a reduction in rent of $500 a month, and there was no new lease agreement executed on behalf of the management company. Additionally, his current lease does not end until late July. We will not be refunding the difference between his legally binding lease and the non-executed intent to renew document that he filled out with a date of 6/1/22, and we will not be reducing the amount owed in July. We adamantly deny any wrongdoing, and we will continue to honor the initial and only legally binding contract that has been executed between the complainant and Ameritex Property Management. It's no different from a blank application being uploaded to my account. It provided rates for what I rightly assumed to be the property In which I personally reside, because it was uploaded to my personal resident portal. How is it fair that this company can pick and choose which documents are sent via docusign and which are not, and then in the same stroke be able to invalidate their own documents by the method through which they choose to provide it? They should have a RECORDED call on file where I verbally received confirmation from their team that it WAS valid, because I was initially surprised about it myself and I wanted to make sure, and I told them it did not have my name on it but it reflected new rates. The person who confirmed the documents validity was the same person who my agent and I have been in communication with from the beginning. They are going back and forth on their word and need to meet me in the middle for this situation to be satisfied. They need to own up to their mistake and accept responsibility for their actions. In their response they admitted that they uploaded the document to my portal when they deliberately lied to me over the phone and through email claiming that they "couldn't even see" the document in question. The document has since been deleted as they were trying to cover up any evidence of their mistake. Also I want it to go on record that I haven't had any issues with the company at all or with my previous landlord. This newly hired landlord named "Tonya" has been dishonest , disrespectful and sharp with me from the beginning and I place partial blame on her for escalating the situation to this point. It could have easily been resolved if they would have been honest and upfront with me, but she decided to handle it in a deceiving, dishonest and downright disrespectful manner and I refuse to tolerate this behavior.     The house we are renting from Ameritex seems to be very unsafe. The foundations the house is built on do not have any footings and I can actually get my hand underneath the house is also going to be susceptible to flooding due to the surrounding houses been raised in pads and our rental not, the stud load bearing walls are on 24 inch centers and are built with 2x4. How this home passed inspection is beyond me. We have tried to report issues to maintenance but received a terrible email back.

This is not one of our business practices, and in most instances would void the new home warranty because this is a new construction home built 2021-22. We responded appropriately by sending out vendors and maintenance technicians several times that either reported that repairs were not necessary or addressed the issue. Many times it was difficult for the technician or vendor because the resident denied access. With this being a new construction home, it had to pass all appropriate and required inspections, including that of both the framing and structural components. We adamantly refute the claim that renting from Ameritex is unsafe, that the home is unsafe or that we did not address any concerns that were founded and reasonable. We will continue to address any legitimate issues, but we stand by the fact that we acted appropriately and in a timely fashion to address the concerns of the resident. I denied access for when nobody is home and to come when I am home as I have a woman and 2 small children In the home. Also the fence still has not been lowered and this is meant to be a pet friendly home. I was told by maintenance to lower it my self. I also have pictures of the ceiling joints showing. Th4 cracks around the shower cubicle, windows not secured in there keeper latches and the back door which does not prevent a break in . Which I also have pictures of along with the air gaps on the door which show day light and the water heater that is slanted sideways which is not secured in a verticals up right position in accordance to manufacturers guidelines. Also the protected sockets in the garage are flashing red which shows a maintenance issue along with the smoke detectors o. The inside of the bedrooms which is no use at all if a fire actually starts.they should be on the outside. But I can call the fire inspector to confirm this. We reiterate that this home passed *** necessary inspections prior, during and post construction and received final approval with a certificate of occupancy from the local municipality. We categorically deny instructing the resident to make any type of repair himself, which would include altering the fence height. Additionally, the fence in question is within the guidelines of the local neighborhood requirements. We manage many homes that do not have fences, but allow pets. It is not a requirement for a home with pets to have a fence. 
We continue to adamantly refute the claim that renting from Ameritex is unsafe, that the home is unsafe or that we did not address any concerns that were founded and reasonable. We have and will continue to provide appropriate action when necessary and warranted.
