Contract date: 11/25/23 Escrow still open: as of today 12/4/23. Estimated closing: 12/6/23 pending HOA statement and clear title. On November 25, 2023 my buying agent helped me entered a real-estate contract for a house listing at 2,737 sqft of interior/living space on MLS listing by **** ***** **** ******** ************, Compass RE Texas, LLC- Houston ******** ***********************  I had the house measurement appraised by a Texas licensed and certified that the house is only 2,612 sqft (see attached certification) Since escrow has not been closed and the investigation was still within the close of escrow period, I tried to renegotiate with the seller for the smaller size property. They refused to renegotiate even though the contract has been breached, hence should be voided. I have spent over a thousand dollars for inspections (house inspection, termite, inspection, and the measurement appraisal, 2 trips - 1) to look at the property, 2) to try close escrow for the property on or before the estimated escrow date). However, with the certified square footage of the house not being the correct size, I told them that I was willing to absorbed those costs as part of house search expenses and only want to get my earnest money back. They wanted to hold my earnest money for something they did not do when they invest into this home and tried to flip it. As retired 63 years old female buyer, trying to purchase my retirement home with my savings, I did my due diligence duty by getting inspections and measurement appraisal for the home before the close of escrow. I would think that as a sophisticated investment firm, they would have done their due diligence duty and get everything done for themselves before they purchase this property. However, either due to their negligence or knowingly, they are now trying to force this property on to me for the price of a bigger house than it is certified. I need this matter resolved as the escrow close date is still open.
