In March 2024, we filed a claim with our insurance company to have our roof replaced due to storm damage. We contracted with **************** to have this work completed in the summer of 2024, a vendor that was paid in full, according to the insurance company's process and protocol. We subsequently received a certified letter from "Claimant" **********, an ******************, titled "NOTICE OF CLAIM FOR UNPAID LABOR AND MATERIALS" threatening "Owner's property may be subject to a lien if sufficient funds are not withheld from future payments to the original contractor to cover this debt." A local company, Mark Daniel Exteriors LLC, **********************************************, is indicated as the "party with whom claimant contracted." This is most unregular, unethical and unprofessional (maybe illegal), as we never had any contracted relationship with either of these companies. So for an entity to threaten us with a property lien is outrageous.

I'm sorry you feel you need to try damage our reputation over a simple mistake we have a cc on file with L&W and it simply wasn't run. I called once we were informed and  immediately made sure it was handled the same day. Hope you can now find some happiness in your life.

    Customer Answer

    Date: 10/28/2024

I am rejecting this response because: This business sent us a Notice of Claim for Unpaid Labor of Materials. The response given had indicated this was in error, but nevertheless this is a legal document that was sent to us stating a claim against us and our property. We are requesting an affidavit that is a legal document quitting the claim and showing this matter is now legally and officially resolved.

We have successfully obtained an unconditional waiver from the supplier now, which will resolve this issue.
