My name is ******* ********* I'm a disabled veteran I live on a budget.My wife and I have eight children we've adopted. We needed anew roof in order to get home insurance. We had a donor who gave us funds to get a new roof. My Nieghbor referred us to Rocut roofing. They did the roof but not the carport. So ***** ******** the owner of the company said it was was and additional 900 and then came back the next day and said would be 1500. We told the donor he said okay. They started and when they were almost finished ***** said they would comeback and finish. I paid them 1500 with the intention they were coming back.My Nieghbor witness what he said. A week later his foreman ******* came and said he needed an extra 1300 to finish the job I told him my wife had to be present because she is my caregiver. He told me that what was I complaining about if my house was ugly anyways and left. My wife got home and I called the foreman and told him that my wife was home. He told me he didn't care.The foreman thought he hung up the phone and I was listening he called me a coward and other explicit things in Spanish. Then a week later ***** said he needed 700 now to finish. I told him it was not in the estimate. Since then he don't answer my calls.I went to the address there is no business there. At the time the foreman that came I was on my medication that's why I was slow at responding. Now I haven't took my meds because of anxiety thinking he is coming to hurt my family. I emailed fox 4 news no answer. I walked to your building they said no walk ins. I've called your building no answer. Hopefully this goes through. I just want this resolved. Plus how am I coward if I served country and got a Purple Heart for getting wounded. I think just because I'm disabled they are taking advantage of me. Business Response /* (1000, 22, 2022/10/28) */ I met the complainant while I was doing his neighbor's roof last year on 01/16/2021. I asked him why he didn't get a new roof approved by insurance, he said that the last time he filed a claim, the contractor took the check but never came to do the roof. I gave an estimate and followed up with him for over a year until his roof was approved by a "disabled veteran" grant. We met at his house on 02/16/2022 at 11:30AM to select shingle color, sign contract and pick up deposit. While I was there, I met the complainant's wife who immediately informed me that she had plans to use another contractor once the grant was approved. I explained to her that she is at liberty to choose whomever she wants and that her husband wanted to use my company since I had done his neighbor's roof. We then agreed on the roof & gutter color, signed the contract for $4,700, and I collected a deposit of $2,350, or 50% for install the next day. While we were meeting, the wife also made a last minute change to the work order. She now wanted the carport section of her roof to be metal. I explained that this was not a problem, but that it would have to be done at a later date once the materials were procured. She agreed to this, so I wrote a separate new estimate and sent it to the complainant's email for verification. We installed the roof on 02/17/2022 and had the gutters scheduled for the next day, 02/18/2022. Once the complainant's spouse got home on the evening of 02/17/2022, I asked if the job was done to their satisfaction so that I could pick up a second check of $1,810. Upon meeting them on the evening of 02/18/2022 at around 7:00PM, they informed me that the roof looked great and actually went ahead and paid me the remaining 50%, despite the gutters not being installed, which were scheduled and installed the next day. We came back to install the carport roof on 03/13/2022. I didn't have a signed contract for this job, it was a verbal contract with an emailed estimate and verbal approval from the client, since this was a returning customer. I don't normally extend my trust without a signed contract, but for this, I did. While on the job, I received a text from the complainant stating that we did not need to paint any of the surrounding trim because the wife was going to decide if she wanted us to now paint the entire wall or not. The job was completed at around 3:00PM on 03/13/2022 and as I stood there with the complainant and his referred neighbor, I asked if the job was done to his satisfaction. He asked my guys to straighten a piece of siding, and as they did so he handed me a check for the full amount, $1,500. I specifically told him that he did not need to pay me in full until we heard back from his wife, but he said not to worry about it since they might paint the entire house. Eight days later, on 03/21/2022 I get a call from the complainant's spouse, she informed me that the job was not done due to the lack of paint. I reiterated what her husband had told me on the day of the job. I requested my foreman to come look at the job since I was out of town. He met with the complainant but the wife was still at work, so my foreman left. This is where things got interesting. The complainant called my foreman and according to the complainant, my foreman did not hang up the phone, but called the complainant a slew of disrespectful names, including coward. I then get a text from the complainant with a passively aggressive message that ended with "come tell me in my face I got something for him" (text message on 03/22/2022 at 5:19PM). I took this as a minor threat, but a threat nonetheless. I texted the complainant back detailing what his wife wanted replaced and said that it would be an additional $700 since it was more than originally agreed. I never got a response from the complainant and on 04/05/2022, the complainant texted me back a picture of the estimate and stated that "Texas Veterans Commission came out and took pictures and said everything was included" (text message on 04/05/2022 at 2:03PM). I did not completely understand what this meant, but I registered it as ,TVC signed off on the project as well. The whole incident was odd to me so I wrote it off until the complainant claims to have seen me at a social event on 07/16/2022. When I got back to my work phone on Monday I saw a slew of text messages from him, one of which reads "your a man that lies and keeps playing let me hunt you down" (text message on 07/17/2022 at 12:13AM. I was playing guitar that night and did not see the complainant at all. Upon reading these messages, I took them as a more serious threat and decided that if the complainant was really that concerned about my work, he would reach out to me directly, even though it had been over 4 months at this point. That is when I get this complaint notification and I immediately read it. Yes the complainant is a disabled veteran, yes he needed a new roof after his insurance denied his policy due to the previous fraud occurrence. Yes, we finished the carport, even though the complainant states we didn't. That is why he paid us. But for the complainant to say that my foreman looked at the house and called it ugly and left is pure hearsay. We did 3 successful roofing jobs in the same neighborhood prior to doing the complainant's. If my foreman was an issue, then why were we referred by the neighbor. What exact explicit things did my foreman call the complainant? Who knows. There's no proof What calls did I miss from the complainant? Not sure. I use a phone service that keeps all calls going back to these dates. Here's the record. 03/21/2022 at 12:18PM. Inbound call from complainant answered. 03/22/2022 at 12:29PM. Inbound call from complainant missed. 03/22/2022 at 6:22PM. Inbound call from complainant's spouse missed. 03/23/2022 at 1:01PM. Outbound call to complainant's spouse returned and we spoke for 2 minutes, 34sec. He came to my office address to "hunt me down" but of course I only have a mailbox in a shared office space since I am a service based business. When the complainant and his spouse plot to hunt me down and accuse my foreman of lies, then I simply do not tolerate that kind of behavior. I'm certain that the only reason the complainant decided to take action after over 4 months is because he claims to have seen me at a social event. Also, the complainant is not taking medications for fear of anxiety that I will come hurt his family? Not likely. What I need from the complainant in order to continue work. 1. A detailed explanation of the services that have yet to be completed (with photos) 2. A signed contract once I compare the estimate and the newfound services while making sure there is no significant labor increase Supporting evidence attached.
