    **************** Classic Logistics bought a truck from Penske in August and started financing with Equify Financial beginning of October. We have been waiting for paperwork to register the new truck for about 3 months now. We have been calling almost daily for the last month with only two call backs from Zak Deckich, but no progress. I have emailed *** last week 2 times with no response. I have left several messages to Zak, *************************** and *********************** with no response. I talked to *** last week on November 30th, and he said that the title had been transferred and we can register the truck. The *** has notified us last week that it has not been transferred and they need a copy of the ******* Title Summary. *** said he cannot give us that paperwork because he mailed it out. Then he told me last week to call Penske to extend our temporary registration tags and Penske has notified us they cannot extend. *** advised me to call him back if I had issues and he can extend temporary tags himself. I have called every day since Monday this week and left messages on Zaks phone, as well as *************************** and ***********************. I have not heard back from anyone. The temporary registration expires in 2 days and the truck cannot work. Equify Financial expects us to pay the monthly loan but cannot give us the paperwork to register the truck. We also have monthly insurance to pay for the truck and our driver wants to go back to work. This not only is affecting our companies finances but our drivers expenses as well.     First, I want to thank you for the opportunity to respond to this matter.  I apologize for the delay, but we've had several people out over the holidays and I wanted to do a thorough investigation of the matter before responding.  Finally, because I am the person most familiar with the file, *************** on behalf of Equify Financial.

    Our company began a relationship with Penske Truck Sales earlier this year wherein customers would buy trucks from them and finance those trucks through us.  Classic Logistics is one of those customers. Typically, the process was that upon closing of the sale, ****** would send the title work to us as the lienholder and we would (through our title vendor) send it in to the state to have the vehicle titled and the title returned to us. 

    This deal funded on September 28, 2023.  We sent the title work in to the ******* Secretary of State on October 3 through our title vendor.  Our title vendor replied on November 21 that the **************** had rejected the title work because they were waiting on the customer to pay the sales tax.  In fact, the customer did not owe sales tax because this was an ***/Apportioned tag, but the customer had not completed the *** paperwork for ******* (this is not something that is part of the deal, it is something that each customer has to do for themselves).  Once that paperwork was completed, we sent the title work back to the **************** on December 4.  I received an email from the customer on December 8 with almost the exact same complaint he sent to you.  I responded that we had send that title work in on December 4.  The title has since been issued.

    I only had a couple of emails/phone calls with the customer and we processed everything as quickly as we could.  To the extent there were delays, they were not within our control.  To my knowledge, neither **************** nor ************ has any email communications with the customer or phone messages.

    We regret any delay that a customer has and work hard to make sure we limit them as much as we can within our control.  We feel we did everything we could in this situation.

    I applied for equipment financing through Premier Financing, the lending body of Penske Leasing and I was approved on the 24th of August, 2023 and requested another unit and was approved on the 21st of September, 2023. Both units required a down payment of $5200 and $4205 respectively. Fast forward to today November 30th, 2023 Equify Financial, LLC is yet to release titles or registration documents. At first, they denied receiving any from the dealership (Penske Leasing) not until an agent from Penske dispute their claims with tracking numbers, proving they received the documents. All attempts to get them to send me the documents prove abortive. The loan payment for both unit starts tomorrow December 1st, 2023 meanwhile both units with insurance since October are sitting on an open lot unregistered. It is unreasonable to make payments on commercial vehicles that has not generated a dime.
