      In Aug 2022, Zach ****** the owner of Founder Roofing LLC, knocked on our door and told me that our roof needed to be replaced. ****** proceeded to collect the information. ****** never provided a start date to begin the roof repairs. On Dec. 14, ****** that I needed to pay him a deductible and $2,000 to complete the repairs. ****** continued to present me with an overload of information stating that this is how the insurance companies work. I paid ****** $7,559.00. to get started. He told me he would get started as soon as I paid the depreciation cost which was around $1,930. After a few days of not hearing from ******, I contacted ******** Insurance myself. The insurance claim adjuster stated that he had made a clerical error on the square footage of the home. The insurance adjuster stated that the public adjuster was seeking additional coverage for other areas to increase the claim amount. After learning this information from the insurance company, I decided not to move forward with Founder Roofing LLC. On Jan. 23, 2023, I sent ****** an email notification to cancel the contract of service and requested a refund for the deductible amount. At first ****** stated he had no problem returning the funds. When we met to make the exchange, ****** wanted me to sign another agreement to which I did not. ****** refused to give me the insurance deductible stating that I must agree not to tell anyone about this incident. I did not agree with his terms and refused to sign his agreement. ******, laughed at me and walked away and did not give me the refund. After a couple day's I reached out to ****** again, presenting him with a fair agreement to end ties amicably, but ****** refused again. This time ****** said he would be contacting his attorney. It is my desire to resolve this matter with the return of my insurance deductible amount of $7,559. A police report for fraud was file for this situation. ****** Police Incident No. ********

      ******, We knocked on your door because we noticed you had an original roof and informed you that you may have damage because we have replaced a few roofs on your street from the same storm. I also mentioned we build patios and built one down the street that you could see from your alley. Your wife mentioned the roof was okay but you were interested in a patio, I came back about an hour later to get a few details for the patio and I noticed a bunch of hail damage on your roof. I then asked you if you had filed a claim or had any interest in filing a claim because from what I could see from the ground you were in need of a roof replacement. After a few hours you showed me the paperwork you were provided from your insurance company and I informed you they had only covered roughly 10 squares and I asked if I could inspect it and see if more than 10 squares had damage because we have already replaced roofs on your street. Upon inspecting your roof I noticed you had quite a few missing shingles (Wind Damage) on a few slopes and hail damage on every slope. I told you that I didn't feel like your insurance company paid you what they should have and it would be worth getting a public adjuster involved. You (******) said that if you get could the roof covered that you would move forward because you mentioned possibly wanting to sell your home. A few days later, the public adjuster arrived and introduced himself to you and inspected your roof and exterior of your home and sent you over documentation for you to sign stating that they will be working with you and the insurance company to get the remainder of your roof covered. The public adjuster was working directly with you and your insurance company and Founders Roofing & Construction LLC had no involvement with any back and fourth with your insurance provider. After a couple months, your insurance provider agreed to pay for your entire roof and sent you the updated scope of work. After you emailed us the updated scope, we broke everything down and then scheduled a date to sit down with you, show you the products we install and see if you were still interested in moving forward. We sat down on 12/14/22, you signed the contract and we collected your deductible so we could move forward with permits and HOA approval. We sent you filled out HOA forms and a copy of the permit and told you that we were ready to go upon receiving HOA approval and once you have your insurance funds in hand. The additional funds sent to you by your insurance provider, that the public adjuster was able to get for you, got lost in the mail and your insurance provider issued a new payment (Insurance funds being lost in the mail was out of our control). The day the insurance funds arrived (1/23/23) you called (i thought you were telling me you had funds in hand and were ready to get started) instead you called and told us you were sitting with your lawyer and having us investigated. I then asked you if we could sit down again and go over everything again but you said you did not have time and had no interest and were sitting with your lawyer. The next day (1/24/23) we (Founders Roofing & Construction LLC) got our lawyer involved and I had an agreement typed up releasing us from any obligations related to you or your property and asked for you not to defame us across social media or other platforms because these are issues that were out of our control. We cannot control how quickly insurance issues funds and we cannot control that the check they sent out got lost in the mail. It does not benefit Founders Roofing & Construction LLC to prolong the process and we were ready to go on our end. We met at ***** bank (location you selected) and I asked if you could read over the agreement and sign it and you refused. I asked what the issue was with the agreement and if there was any corrections you'd like me to make and I mentioned I wasn't sure where the disconnect and sudden frustration you had and threats came from. You said "Dont worry, I'm coming after you, you'll see, life rolls on" and you got in your car and drove off. The following Monday morning (1/30/23) you called and threatened to file criminal charges against me and said I had an hour to give you your money back. I told you that I would call my lawyer first before proceeding with anything. I called my lawyer and my lawyer said he still has not heard from your lawyer and once your lawyer reaches out we would work towards resolving the issue. You then texted me asking to send you a copy of the agreement and said you would sign it and send it over if i would send the check in the mail. I told you I didn't feel comfortable putting the check in the mail and id rather hand you the check in person after you signed the agreement to clear us of any obligations related to you and your property. You asked if we could meet at ***** bank again (Location of your choice) so we met on Friday 2/3/23 to sit in front of the notary so they could verify that you signed the agreement and see that I handed you your check, you pulled out a folded agreement of your own out of your pocket that I was un aware of and I asked you if you could give me a few moments to allow my lawyer to look over it. While we were waiting for my lawyers response, you said "I'm about to push the gas on your *** and get the attorney general on you" and then you stormed out of the bank. We have been actively trying to resolve this issue and give you your money back. If you wanted to cancel services and asked for a refund I would have gladly provided you with a refund, instead you called us and threatened us with lawyers, having us investigated, threatened to slander our business, and then threatened us with criminal charges over issues that are out of our control. If you had funds in hand and were ready to go, we would have installed your roof as quickly as you would allow us but instead you didn't want to move forward until you received the updated insurance funds and that's all we were waiting on. I never told you we were waiting for depreciation, depreciation doesn't even get released until after the work has been completed. We collected your deductible because we have to show proof of it by law and all we were waiting on was for you to receive your insurance funds. I never declined signing your "agreement" that you presented me with, I asked for a few moments for our lawyer to look it over. I would have never gotten my lawyer involved until you threatened me the day I thought you were calling to tell me you received your funds. I have been actively trying to resolve this issue with you and due to your consistent threats I had to involve my lawyer. Originally you had a builders grade roof and only 10 squares covered by insurance, the public adjuster was able to get your entire roof paid for including your fence and Founders Roofing & Construction LLC was going replace your 3 tab roof system with a Class 3 Impact resistant roof system at no additional cost and we agreed to replace your broken window on the front of your home that insurance didn't cover and we weren't going to charge you for that either. You mentioned that because of your high deductible, you wanted to keep the funds for the fence stain and not get that taken care of at the time, which indicated to me that you didn't have funds to pay for the entirety of the Roof, and we were waiting on you to receive the updated funds so we can put you on schedule. All of the administrative work (HOA & Permits) was completed and if you told us you had funds in hand, we were ready! As I've stated, the Insurance funds being lost in the mail and having to be resent are out of our control. We always go above and beyond for our customers. We would never try to do anything that would negatively effect our customers or do anything to provide you with a negative experience. We are still actively trying to resolve this issue with you and would happily provide you with a refund in full and not deducting what we have spent on permits but we haven't received any communication from you or your lawyer.

      Mr. ****** has added in some colorful untruthful details and claiming to have a lawyer. When I called the number he gave for his lawyer, the number is not a working number. Nor has his lawyer ever contacted me to resolve the issue. If he felt threatened, then that would be all the more reason to settle this matter. No one has contacted me regarding my refund. I paid my deductible amount electronically, and would like to receive my refund via cashier check or electronic deposit. I don't want the type of roofing system he is offering.

      According to a police investigator ****** has done this similar thing to other homeowners. He has taken homeowners deductible monies and not delivered on the work. As demonstrated in his response, he includes false statements and takes no honest actions. I have requested the refund of my deductible and Z.****** continues to procrastinate and play games. It is not complicated to order a cashier check and send me ny refund. The actions of ****** are that of a common thief, he is making false claims to justify not returning my money. All I want is my money refunded.

      ******, I can assure you that since the day you called me (1/23/23) and threatened me with Lawyers and "Having me investigated" I got my lawyer involved. I texted you his office and cell number the day you refused to sign the termination agreement at ***** bank and I sent you an email with my lawyers office number and his email again so you would have other means to contact him. By you saying "if he felt threatened, then that would be all the more reason to settle this matter", I have been actively trying to settle this matter and I've spent time and money trying to resolve this with you. You're once again making false accusations. I spoke with the ****** Police Department today, 2 detectives and the dispatch. No other reports have ever been filed against myself or Founders Roofing & Construction LLC and we have never kept anyone's money and we have no intention of keeping yours. It's unfortunate that you continue to make this harder than it has to be and due to the circumstance, I'm following the legal advise I have been given. Also, regarding the comment about not wanting the roof system we offered, we can install any system of your preference and if you had any concerns with what we were installing, we could have addressed that. You have a builders grade 3 tab roof system and we offered you a Class 3 Impact resistant shingle at no additional cost to you. As I've mentioned time and time again, we take payments by ACH due to credit card fees being high for transactions that are large, all of our payments are processed through quickbooks and quickbooks does not offer a feature to refund via ACH. I want to make sure I am physically handing you a check and you are signing for it stating you have received it. We have met at ***** twice (location of your choice) and we had a notary present to witness the transaction take place. You called me again on Saturday 2/18/23 threatening me with criminal charges yet again, I told you my lawyer is reviewing/revising the agreement you handed me to make sure it makes sense for both of us and you said "Sounds good". For you to say "no one has contacted me regarding my refund" is completely false and I submitted proof of that on your original complaint.

      Again, I have not threatened Mr.****** and it's unfortunate that he has that point of view. Indeed I have requested that he refund me my deductible amount and he continue to procrastinate. Rest assured I do not want anything from him other than my deductible amount. His lawyer has a mailbox that has not been setup nor have I been contacted by his lawyer. He leaves me no choice but to contact him to follow-up. I can't believe how this business owner continues to stall. Whatever he thinks he is waiting on, it's been plenty of time. There is no reason for him to hold my money. I do not want him near my home. Once again I am requesting the deductible amount in a cashiers check be sent to me via certified USPS mail for this matter will be resolved.

      ******, You have threatened me numerous times with criminal charges, legal action and so on and I've provided proof that you have done that time and time again. I have not procrastinated anything and I have said from the very beginning, I WANT to issue you a refund and I said I would not deduct what we've spent on permits for your project. Due to your threats of legal action, I've had to spend time, money, and resources to ensure we can formally terminate our contract. Also, my lawyers mailbox has always been setup. You finally reached out to him for the first time on 3/1/23 at around 7:45 am and he returned your call and explained to you this process. You requested that my lawyer revise the Non-disparagement agreement and my lawyer revised it to your request and you STILL refused to sign. As I've stated, the non-disparagement is to ensure you cannot be untruthful about myself or Founders Roofing & Construction LLC. I can't keep you from expressing your opinions but you have already tried to lie on your BBB complaint stating there have been numerous reports of me keeping money and not delivering on work which is completely false and I've already talked to detectives and staff of the ****** PD regarding that lie. I'm going to drop the Non-disparagement paragraph on the agreement completely in hopes we can move forward so I can issue you a refund.
