On September 3, 2022 at approximately 1:30 AM at the parking garage located at *************************************************, my daughter and boyfriend witnessed, *************, owner/driver of Amigo Towing had unlocked and opened both the passenger and driver side doors of my vehicle and rolled down the windows all the way down. He had not yet hooked up the vehicle to tow it when he was approached; however, he ignored my daughter's request to let her drive the vehicle out of the premises. He proceeded to hook up the vehicle to tow it. Fortunately, my husband and I arrived to the parking garage (we were across the street) to stop the towing company from leaving the parking garage with our vehicle. In order for us to get our vehicle back we had to pay a $135 drop fee. ************* mentioned he found a gun in the vehicle which means he searched the vehicle without our consent. The gun was not visible or easily accessible. Not only did he unclock my vehicle, searched, left the doors unlocked and the windows rolled down and did not allow us to drive/move our vehicle out of the parking garage before hooking up, he purposely hooked it up in our presence only to charge a drop fee to release it. He is took advantage of our ignorance, and violated our rights. He broke into our vehicle, searched it, seized it, and made us pay $135 to give it back to us. He is using predatory business practices, breaking the law, and intimidating people into not taking pictures, surrendering their driver's license/ID cards before disclosing details about the location of their vehicle. I hope more people come forward and report him. He should not be allowed to continue to operate with unethical and unlawful business practices. Nothing in the Occupational Code ******** authorizes a towing operator to break into vehicles and search them. TDLR, regulating body, does not authorize tow operators to make entry into motor vehicles without consent. It is not part of the towing statute or rules.
