Hi my name is Mario ****, my wife and I closed on our newly built San Antonio home on April 11, 2019 It was our dream retirement home or so we thought, however that dream recently turned into a nightmare when after moving a cabinet in the room next to our Master Bathroom, we discovered a leak. We called the home inspector who did our original house inspection who in turn suggested we call the builder about home warranty issues.. he suggested that it seemed like an issue with the spigot that fills the bathtub to which we responded that the bathtub has rarely been used. The bathtub is enclosed in the shower it is all in one enclosure. We then contacted Ashton Woods who said it's out of warranty and nothing they could do. A plumber was then called in to determine the source of the leak, he found that there was a defect in original construction with the pan liner and he then told us that the pan liner is normally installed by the tile guy. We asked that he state his findings on the invoice. We again submitted to Ashton Woods his findings they requested pictures which was sent in and they again said it was out of warranty and nothing they could do. Since then we had another plumber in who had the same opinion as the first that it was a Pan Liner issue which was at fault at original construction. Now we maintain that it was impossible to know of the leak until it was discovered (by moving a cabinet). As a result of the leak which went undiscovered since 2019 it is now December 2023, we now also have toxic mold, we have been taking care of our Grand child who has had constant congestion since he's been here. In addition to demolishing the bathroom and rebuilding we also have to do mold remediation. We reached out to the city of San Antonio to check for Pan Liner certification and they informed us that since we're out of the city limit we're out of jurisdiction and inspector from the city would have conducted an inspection. This is absolutely unfair and unacceptable, HELP.
